  1. As I understand it, it is $5000 for a class action if we decide to file a case as a group. And it is my time so I can do what I please with it. We may not get the visa but someone's got to make the DIBP realize that they have been unfair and next time they take a moment before playing with people"s lives.

     

    It seems that actually it is $5k for each main applicant. My concern is that even thou the lawyer would win on this particular "cap and cease", DIBP will find another way and 6 months later kill it once again. And this time with all their homework done, so no risk of any law suit again. This is my main fear.

    Once they broke my confidence in being fair, I can't trust them anymore that they could do the right thing.

  2. Hello Dyanne...been awhile since we last exchanged posts. Well..you just smashed my last bit of hope to pieces...I thought to myself maybe I am going to be one of those last 36.

     

    Alas..time to start from scratch...

     

    Easiest way to at least move to Australia in some capacity is to attend a university degree program...

    Sadly I received the doomed letter a few hours ago.

    Now I just regret I didn't listen to my big brother (my sponsor) 4-5 years ago when he said to check and try other options. I was too afraid I would end up in another queue by other legislative changes.

    It was a wake up call for me showing me that injustice and lies are made even in a country which seemed to me as having a spine. Everywhere it is all about politics, manipulation and reality distortion.

    I am disgusted and question my willing of ever going to Australia, not even as a tourist.

    I am just full of mixed feelings now...

  3. Have not heard anything from DIBP yet others say they have? I checked the online account and it says under status "Assessment in Progress". Is that a generic status message that has been used for everybody so far? I did do some research but honestly could not remember what the prior status was thus whether this means anything or not...clueless...

     

    I have the "assessment in progress" status since May 2012. I didn't receive either the email from DIBP with cap and cease. Maybe they need time to sort them out. It is what they do best, "take their time".

    Category 3, schedule 3 - is it referring to occupation in demand? I remember there was another list of occupations in demand back then but it is not the same as SOL list. My nominated occupation was on the SOL but not on the other list.

     

    If I remember well there was a critical skill list (CSL) as the first radical change during 2009, but after that I don't remember, because each time I was on the last possible scenario. My occupation was removed from SOL in July 2010.

    We applied for 176 back in May 2008. After the first 6-12 months of expecting news 'any minute now' we eventually decided to just get on with life and stop living in limbo. Since then we check periodically but like many others here there has never been any change/updates. Can anyone please let me know when the last FS 176 visas where successfully completed and if there are any updates as to when May 08 applicants might get an update? Thansk All.

     

    I am also May 2008 applicant and still around, waiting. I've never heard any successful story about 176 FS applicants in cat. 5 group. Hopefully, I will hear yours and you will be hearing mine. :)

  6. We applied for Family Sponsored 176 in June 2008 and were asked for police checks & medicals in early 2009. As we had to get police checks from Dubai this delayed the process and then DIAC changed the rules and our application was put on hold. In late 2010 we were asked to redo medicals & UK police check and were finally issued FS 176 PR visa in December 2010.

     

    We did use an agent, so not sure if that helped.

     

    Your case it's not the same with ours, which are still waiting after 6 years. And it had nothing to do with having an agent or not. I would say it was a pure luck having applied for the right occupation which was still on SOL. When your case was allocated this was the priority list in force:

    Cat 1 - employer sponsored;

    Cat 2 - State sponsored and on the SMP

    Cat 3 - applications on SOL, schedule 3;

    Cat 4 - all others

     

    So, my guess is you were on cat 3, because I was cat. 4 and I'm still waiting, even thou I applied the month before you.

  7. Look at the allocation table. It shows January 2008 which is pretty much the cut off date for their retroactive changes to immigration program. Applications in our category after that have been on this seemingly endless hold.

     

    The prioritizing in processing applications came into effect in 1st January 2009. So, when I applied in May 2008 they were still processing the old way, based on the application date order. In September 2008 the financial crisis hit the world, so I guess their rapid change of legislation was because of that.

    I remember that in April 2008 they were processing some applications from November 2007, so they were only a few months behind. After that, everything stood still.

  8. In 2012 I thought it was a good sign, but since then, almost 2 years passed with no other information.

    In June 2012, my colleague from Human Resources told me that someone from Australian Embassy called her and asked details about my job (duties, how many working hours/week, if I get paid). Immediately I logged into my online account and saw the change of status which occurred 2 weeks before that call.

     

    Normally, I would say that it was a CO allocated. But after all this time, I have no idea what it was. I might be in security checks which I've heard could take up to 18 months (I am from high risk country). Still, it's 22 months...

  9. I applied for 176 FS offshore almost 6 years ago. For me, that particular moment was the perfect timing because I had just reached the 12 months recent work experience and I was 3 months before turning 30. At that time the maximum points were given for age group 24-29. Because my occupation had only 50 points, I needed all the points I could get. Luckily I was able to claim maximum points for Ielts and in the end I had 105 points (limit was 100 and for independent I needed 120).

     

    After 1st of July 2010 my occupation was removed from SOL and never appeared back. So, I am stuck on this dead end road with no other option than to wait.

     

    I still hope they will touch our applications during 2014.
