Thank you for all of your responses and advice. Unfortunately we don't have a migration agent working on our behalf to be able to ask; we have also included in our statements what we would do if permission was declined and we were not allowed removal of jurisdiction. You do really have to look at all aspects when making these applications as the Judge does require answers to everything to ensure the best interests of the children; which is totally understandable. Thank you for your comments and advice we understand all of your point of views; none of these have been taken lightly in our decision. We do believe children deserve childhoods and without going into every detail of our lives no one is aware of our circumstances. Our children are suffering here and are fed up, they are not left alone due to false allegations continuously made against our family. And authorities being involved to investigate as a matter of procedure; which are continuously closed. All they want is a fresh start and for us to be left alone to enjoy our lives and have expressed these feelings to the Court. Concerning contact two are not allowed contact with the other party and although it would be four children and a escort with have financial assistance to ensure that this contact will be maintained. We also have a large family & friend support network in Australia which is another reason for the family's choice to allow them to settle easier and not be isolated. As every loving parent would do we are just trying to protect our children. Take care, sjh.

Thank you sorry I didn't mention contact earlier we have said in our statements that the children can communicate through telephone calls, text message, letters, email, Facebook and Skype. We have agreed that the other parties are welcome to come out to stay and see the children (apart from the domestic violence ex as contact is not allowed at present). That we would also pay and escort the children to return to the UK during school holidays for contact to be maintained. Our children are aged 6,7,12,12,14 & 16. We are doing this to provide the children with better opportunities, environments, educations and lifestyles than we can in this country. The children have wrote statements about their feelings of moving and fully understand the changes with contact to which they are all happy with. Take care, sjh.

Hi, I'm looking for urgent assistance with our removal of jurisdiction case from the UK. We started our case over a year ago and was in Court for another directions hearing. We are a family of eight and our children want to make the move with us. But our ex's wouldn't give their permission so we approached the Court for removal of Jurisdiction in our children's interest. One ex never showed up and never sees the children due to a history of domestic violence but still has parental responsibility. The other two ex's do have contact (1 once a week & the other once a month)and won't agree to the removal of jurisdiction. After a year in Court they have now decided to place residence applications to delay matters. We were informed to provide evidence to the Judge concerning the removal so I provided over 500 hundreds of pages of info on visa, employment, rentals, bills, schools, income & expenditures, finances, activities for the children, information on the local area, local facilities, doctors, hospitals, furniture/car purchases etc. At Court today after a year we were was told that the Judge requires set information to making their decision and has guidance levels for each step. Was then told the information provided wasn't the relevant information. But I am not aware of the criteria the Judge is looking for and haven't been provided with this information either. We have legal representation and hadn't been made aware of the above levels and have been left to compile statements and evidence ourselves.
