I travelled 12th July to perth, and 27th to melbourne. Currently I think interstate travelling is banned to Victoria. If you stay in perth for 14 days you will be at quarantine and government will cover the cost. After 14 days u will be on ur own and average cost is 100 aud per day.

Victorian borders are open to all states. Victoria is not stopping interstate travel to Victoria. Only international arrivals cannot arrive in Victoria - so planes go to WA or SA or QLD. After you complete your quarantine in WA or any other state (apart from Vic), you can drive to victoria. Once in Victoria you then cannot travel anywhere unless you acquire permit from the state you want to travel to. Hope this makes sense

  3. Hi All

Finally after almost 3 years my application at the AAT (appeals admin tribunal) has been remitted back to the DHA in islamabad for processing. I want to know if someone recently had a similar situation and how much time did Islamabad immigration took to finalise the case? I am only talking about cases which have come from MRT or AAT to the DHA islamabad. Thanks for your help

    Hello guys!

I needed a bit of advice I lodged my partner visa application on 15th Jan 2019 for my wife 309/100 and I am currently on Australian PR. We have been married for over a year now got married in Nov 2018.During this time I visited my wife in Pakistan back in March and then invited her on shore on a family sponsored visit visa in July which was valid for months. She stayed here with me from July- Oct. On 5th October we wife got a call from immigration(AHC Islamabad) while my wife was in Australia and she was interviewed the normal spouse interview that happens in which they asked her about her name,DOB,my name ,DOB, marriage date, our future plans, our daily routines etc. After her interview I the sponsor got an RFI for online form 40sp and my updated PCC's.....I fulfilled all requirements and submitted all documents on 20th October....My wife returned back to Pakistan in end of october.....I then re visited her in December 2019 and flew back in January........... then on 10th January my wife again got a follow up interview call from the AHC in which they said that there is an allegation against you and your husband that your relationship is not genuine and continuing(and that is the reason why your case is suffering delays ......like normal applications in our home country get processed in 8-12 months) .....is this claim true? My wife answered that this claim is baseless and definitely there's no truth in it  giving all reasons that how she and I have constantly been in touch and visited each other throughout the year and plus we have over 400 photos us together uploaded on our immi account with friends, family of get togethers, social events, birthdays and what not both in Australia and Pakistan with proper dates and even all our wedding pictures. The interviewer assured my wife that yes I have seen all these proofs and we don't really give weightage to these allegations we just wanted to here about your stance....After a gap of 2 hours I also got a call from the AHC and was asked similar questions about our relationship in specific, routines, where my wife is living currently , how I would describe my relationship in one sentence, our future plans etc.

Has anyone ever been in a situation similar to ours where someone has levied an allegation against their application and if so then how long did the case took to process? Does anyone have any idea that how long will I have to wait more either for a grant or ultimate refusal even though I believe that we have sufficient proof on our application that our relationship is genuine and continuing(We even purchased a family car,a home on rent in Melbourne, furniture and attached all utility bills of the 3 months me wife was living with me in Australia, bank statements of all the transfers I made when she's in Pakistan, shopping receipts, trips we went on,travel itineraries, and bank statement of our joint account in Australia). Any advice or help will be highly appreciated as both me and my wife are extremely devastated after these interview calls even though no decision has been made on our application but such false accusations on such a genuine relationship are heart breaking. 😞 😞

Well first of all get an immigration lawyer on your case asap. Carina ford in Melbourne are really good. Immigration can be very unreasonable and they can refuse a visa. It is up to you to prove your relationship. Immigration lawyers know exactly how to handle. Immigration refused my partner visa and I am waiting for AAT hearing since Aug 2017. Such are the wait times. Do not go for a cheap migration consultant. It is a costly visa and now that immigration have received adverse information they will believe it. I would advise to keep a low social media profile as someone in your circle of so called friends is not happy with your relationship.

    hey mates

just wanted a quick advise on the 40SP online form for:

I had previously lodged sponsorship for my ex-wife and later withdrew it and resulted in no 309 visa.

Qs : Has this sponsor previously sponsored/nominated a spouse, de facto, prospective spouse or interdependent partner?

do I answer this to be a YES or NO?  309 visa wasnt granted before

    thx

You withdrew the application before the visa was granted so you did not sponsor anyone before. You will  answer NO to this question.
    Thanks

Can u tell me refusal reason ? Our immigration lawyer gave us three options after 2 visit visa rejection .either  reapply  , wait for spouse visa or appeal at AAT. But he told us at appealing will take long so it's better to wait for spouse visa or reapply . I don't get them they have given this option in there own law that people who r waiting for spouse visa can get visit visa easily and still refuses on that very basis 😔😔😔

Visit visa rejection reason is......partner will not return back to Pakistan. This is the standard reply. I am going to lodge a new application as I cannot be bothered waiting endlessly for a review.

It's 15000 aud we applied for it and it got rejected reason as I have already applied for spouse visa so they doubted I will go back which was really stupid reason we were even ready to pay

This is Immigration at its worst behavior. They have no regard for people and no one should be treated like this. If you want to get a visit visa this is how you can get it. Apply for visa and wait until they refuse it. Appeal the decision with AAT (only for sponsored visitor visa). Current wait times is 6 months for a hearing with AAT. If you are a genuine couple then AAT will revoke immigration's refusal and grant the visa. This is how you can get it. The visa you will get will be for 3 months maximum unless you apply for 1 year visa and then you might get for 6 months. It is worth for 6 months because the costs associated with bringing your wife and living in Australia is ~ 10K including renting a house and buying furniture and return airfares. It might be worth just you visiting back. I am in waiting with AAT for a partner refusal since Aug 2017. 2.5 years since we married and still not together. This immigration department is the worst in the world without a doubt.

    When care taker govt started?

There is no care taker government in Australia. the current Govt continues until Election. Care taker government happens in Pakistan - not here.

Immigration is slow at the moment as there are too many people. Trains are full, hospitals are full, roads are full.

do u reckon i shud hire and agent to file my spouse visa now? i m worried if IMMi is any strict with my 2nd application and case goes into any complications? or u reckon this 2nd application will also be the same as first one where i provide all evidences to prove the relation and my wife wud get 309 easily?

we wud like do the same as having joint bank accounts , myself sending her monthly maintenance money , we wud travel together for our honeymoon etc

You have mentioned engagement for 8 months and now getting married. This is really good for your application to prove you have not rushed into the second marriage and have taken sometime before coming to this conclusion. Also you previous application will not affect you - just clear your mind. If the case officer asks about the previous marriage and visa just tell what happened and that it did not work out so I cancelled the sponsorship. Do not worry about it - just forget it and move on. Second application will be the same as immi has not changed much. Just follow the check list and you should be fine. If you want to consult a lawyer only - I would recommend only to discuss what other ways you can bring your wife over without logding partner visa. Maybe there is a way to lodge onshore rather than offshore. Just check this with the lawyer.

hey mates ,hope everyone is fine and smooth sailing with their 309's

just wanted some help with my case , first marriage only last 2 months(no rukhsati) , 309 and 600 were filed but withdrawn and didnt resulted in a Visa grant.(all visas filed myself/no agent)

Then I am getting married again with my fiancee after having an 8 months engagment period , looking to file her 309 visa soon.

shud I hire a consultant to help me with my new visa file for 2nd wife? any complications expected or it shud be smooth as the pervious file? just a bit worried if immigration asks for anything new as its a 2nd marriage (i have divorce cert etc) , anyone thinks it wud be a prob with added complexity? i understand the visa process and the claims/proofs to provide to IMMI

    thanks guys

    Hi Saleemk

you should be fine. Because you withdrew your sponsorship application before the 309 was granted, you should not have any issues. Partner visa takes time and there is nothing we can do about it. Just sit this one out my friend. I have been married now for almost 2 years - 3 visit visa refusals. I know how to get the visa now.....but it is not worth the $$$ for a 3 or a 2 month visit visa. Anyways......if your visa was granted to the first wife then you would be required to wait 5 years before sponsoring another partner. So you are fine

Hi there , yes l saw too , it is too long, l applied in August 2017 , l don’t know does it effect us too or not ? Is itfor new application? Does anyone have any idea about that ?

I have just checked the department's website and they are hiring visa processing officers for 1 year across Australia. There are easily hundreds of jobs that have been advertised and now closed. My friend has also applied and he is progressing in the application. My understanding is that these times will come down in the next 3 months down to 18 months or less inshallah. No need to stress at this point in time.

Never hire a lawyer to handle immigration. Use a registered migration agent. they are specialists. There is no need for a migration agent to reside in the country where you live, hire one of the ones who frequent these forums - that way you know they are reputable.

Thanks Marisa - This is what I meant as well. Thanks for correcting.

  14. It is because of the nature of the question. Chances are they will make more mistakes and probably not ask the question. This forum is not for everyone. Paying a lawyer is an investment and for some people this is the best option. Agree with your comment for someone who know what they are dealing with to some extent. if someone cannot comprehend the visa they are applying - lawyer is the best option to help and guide them. A coin has 2 sides Nemesis and we should try and see the other as well. This brings me to a question I asked you before if you can please answer for me would be very helpful. When were you advised of 18 - 24 months waiting time for appeal process for 309 refusal? was it in 2018? 2017? or earlier? Thanks again

    Hi,

I have a confusion while filling Form 80, if someone can please help out. Qs.24 asks for if we are applying for a temporary visa? I assume answer would be yes as the first visa we will get is a temporary one and that will lead to the permanent one. Second part asks for the flight details, departure date which of course I don't have any. How should I answer this question? Please let me know. Thanks ?

Please get a lawyer for yourself. Thanks

We were told to expect 18 months to 2 years

    Hi Nemesis

Grateful if you can please advise on when did you seek this advice? was it 2017 or 2016? Thanks again. It will help me understand how much more time I have to wait. I am kind of in a rock and a hard situation where if I apply a new application it will take 10 months. With my appeal I have already waited for 9 months.....so really it is a matter of 7k worth spending on new application or not

I am Pakistani and so is my wife :). The Nikkahnama is available in either English or Urdu. You can choose either language or have one each in both. My wife and I are more comfortable in English so we chose only the English ones. We also thought it would be easier for the visa as we'd be spared the need to translate an Urdu Nikahnama. I realise this doesn't sound like a big deal and I should just explain to the case officer this fact. But you know how illogical case officers can be so I just want to be extra careful :) so is

someone can be illogical with a brain. These people have no brains mate - they are ostrich. anyways I think in this case you can say what it is and it should be fine.  Not a big deal really

    I have questions  my friends؛

Please guide me if you can

I applied for partner visa 10 months ago ok!

not news about interview or medical and when I talk white my lowyer he told me just wait wait ,,,,,

now ، I found  problem with my wife because she told me Why is not your visa issued?

I wanted to know does  the sponsor could prolong the proceedings ??????

I have a doubt ,,,, My mother in low  told  me this  your visa is not issued because it has been prolonged and I doubt I now I have problem with my mother in low why she say I can’t get visa ?????

sponsor just can withrow the visa yes !!!!!

does the sponsor can prolong the proceedings time the get visa or not !!!!!!

    Thnaks for help me

Your only way out of this is to withdraw the application. If the visa is granted before you withdraw your sponsorship then 5 year limitation will apply. It does not matter whether your wife travels to Australia or not. You can only sponsor 1 partner in 5 years unless you have special circumstances and you can prove your life will be very difficult if you would have to move back home for 5 years. no medical reports will help here either - Immigration is abusing this clause to the maximum. If all of your family is in Australia - as in your parents and siblings then you have a chance at sponsoring another partner within 5 years. I will stop here and let you respond. Please read this information in partner booklet on immi website
