Hi ya we have just been through exactly the same thing I am an Aussie resident and I came to Oz in Nov 6 months pregnant, my fiancé is British and has a criminal record he applied for a tourist visa so he could be here for the birth we applied for his residency in November and as it was going to take 9 months he had to apply for tv in the mean time.

    It was taking so long for the tv and getting near my due date I got the hospital to write a visa letter to say I needed him here for support as soon as they received the letter they granted him the tv and then whilst on a trip back to the uk as his 3 months were up we had an email from our agent to say his 300 was going to be granted on the 7 month mark,I was so worried because of his record but its all turned out lovely and we are very happy in Melbourne with our beautiful baby girl. All the best and for the birth I'm sure it will be fine

Weve got it, my fiance got his PMV visa granted on Thursday, he has been here on a TV for three months and was due to leave on the 6th May, i wrote to our CO to ask if she could tell us if his visa would be granted around the time of his trip back to the UK as it was around the 8 month mark so we knew weather to book a return flight or weather he could have a one way back to Oz we received a paste and copy email from CO from the immigration website saying about processing times. i had mentioned that we had had a baby and my fiance didnt want to leave us for long but also was copy and paste about compassionate circumstances, having a baby not being one of them. So disheartened we accepted he would return on another TV and booked a return flight to the UK for Aug, he flew out and a day later we received an email form our agent from the CO saying his visa could be granted in the next few days on his trip back. He arrived yesterday on his PMV and were over the moon, what a relief, wedding booked for Jan, yay and now to get a job. We applied 9/10/12 CO 15/10/12 medicals 5/11/13 visa granted 16/05/13

  3. I did declare it but only stated 'drink driving conviction date..' and nothing more, but to late to amed now. Guess emailing them now to give them more information slice is also a bad idea as well! Still he got his visa so I'm hopeful I will as well as your friend did. Thanks for posting

    He went through an agent and they know whats coming and what will be asked for so got my friend to send the explanation with the application it saves time, if they have any query on anything they will just ask for additional imformation, you will be fine

  4. Hi, I applied for my subclass 417 visa online yesterday. I have a drink driving conviction from 2010, I did declare this but reading in some forums it seems there is another visa you can apply for if you have convictions. I don't mind getting my police record with just this on and presenting in if required in my application as I have never been involved with drugs/weapons or in jail. The friend I applied with was accepted in half hour, I was expecting a delay with mine but now worried and may have wasted 365AUD! Just wondering if anyone has applied this way with like convictions or has any advice? Many thanks

    Im not sure what a 417 visa is as long as you decalre it when my friend applied for his residency he included a little statement explianing about the drink driving how it happened and why he wouldnt do it a agaun and he got his visa

Hi There bet your very excited to say the least just wanted to let you know i tracked fiance visa says being processed and our agent emailed me this morning to say she has emailed character assesment unit direct to ask do they need anything else before granting the visa, aswell as explaining that every case is so individually assessed so fingers crossed we hear something soon , all the best

    News on my front: the fiance is leaving Heathrow in approx 4 hours! I know my signature says he is already here ;) I got a bit excited. He arrives tomorrow night.

    Now one more stress - the questions at immigration - especially as he is ticking 'yes' to criminal convictions!!!!!!!! He's only got a 3 month TV and a return ticket so hopefully there wont be any dramas. TOO EXCITED!

Hi Ellie, it is all very stressful this visa stuff its the whole rest of our lives in the balance, my fiance applied for a PMV visa in October i came to Oz in November as my Visa was due to expire in December, i am also expecting our baby which is due in 8 weeks, we have applied for a TV whilst we wait for PMV as i need support form my fiance and help with the baby not too mention he doesnt want to miss the birth he already has missed out on so much kicking etc and i could do with a hand waddling down the road! Our agent has applied for both visas and says its ok and if you read posts on this forum lots of people are doing it, when you want to acheive thing you have to make sacrifices we are going to use loads of our savings as fiance cant work till he gets PMV and the flying in and out to be granted the visa but we are madly in love having a baby and cant bear to be apart its already been two months of heartache we are still waiting on the TV as my fiance has a criminal record form his youth. our agent emailed them today to see how much longer. so fingers and toes crossed and go for it (-;i am very stressed as you can imagine but its only a few months when you have the rest of your lives

    Hey guys and girls...

    Having so much trouble with this visa stuff (before I have even sent it off)

    Sooo we have been tying to get the money together for a while now (unfortunately my partner lost his job in August and has been out of work since!) Nowww he has had to fly back to Oz to be with his family...using half the visa money for his flight ticket, which can't be helped and I've just come on here to see that the waiting time is 8-9 months! Which is a hell of a long time to be without my lover. I reckon I can get the money together on my own by the end of Feb which means it'll be Xmas before I see him again :(

    What do you rekon my chances of getting a tourist visa are while my de facto visa is processed? I understand I will have to be out of the country while it is approved which does mean extra expense I just dont know if I can go that long without seeing him!

    Also, will the fact he is now back in Australia and im in the UK make any difference to the application?

    Hiya,oh im so happy for you i cant or well i can imagine how your feeling. I dream of that day all the time, i sent my agent and email this morn so hopefully when i wake i will have a reply, can i just ask has your fiance been here before if so did he tick yes to convictions before, when i bought OH out here in Jan our booking agent told us that as OH conviction was over 20 yrs ago it wasnt an issue and put the visa on his passport ( little did we know)he told us that all convictions were spent, when we got his acpro report we saw its not spent, arghh anyway so when OH and i came in jan this year he ticked no to convictions, we have had all that too explain too. the travel agent has written a letter saying that he thought that was the case so that helped.

    Dont worry about your other half ticking yes to convictions i have been told that customs will make call to check he has the right visa and wave him through were you will be waiting, how bloomin lovely and exciting, thanks for replying to my posts. If we dont here anything in the next couple of days OH is gonna chase things up as im getting mega stressed if they say no i think i may go into labour there and then ! bet your not gonna sleep much tonight

    yes his convictions do come to more than 2 yrswhen added together mostly juvenile things, i don't want to step on our agents toes they do this day in day out and aren't worried.We know that his application is now in Hobart at the character assesment unit awaiting consideration, well it was on the 21st Dec.I was hoping the CO's would speak to each other as all my OH character refs and our stat decs are with the PMV application, the 676 CO does'nt even know im pregnant or that we have applied or PMV as far s i know unless a little flag pops up with passport numbers and names. it does mention on the bottom of the email form Hobart that you can track your application with the TRN number, passport number and DOB etc im tempted but they might email our agent direct and then it looks like im going behind her back i might email our agent again and see what she thinks. OH application was lodged on the 15th of Nov he had a phone call at work from AHC CO asking how much of his sentence he actually served he told her and she said i'm happy with that i will now forward your application to assessment unit in Hobart and that was 7 weeks ago, if they needed to investigate more would'nt they contact us for more information. There are so many grey areas, i wish they would give you little up dates instead of this forever waiting.

    Take it from experience...it won't do you any good! It won't make you any less frustrated, in fact it probably has the opposite effect!

     

    It takes as long as it takes. Generally speaking DIAC will tell you the processing time for your appliaction when you apply, and your application will be dealt with in that length of time. Over time, new applicants may be told a new, longer, processing time, but yours will generally still be dealt with in the time you are told. Every now and again, the odd random application slips through the net a little bit quicker. It's luck, not any magic to do with that person or application. If your application takes 9 minutes, 9 hours, 9 days, 9 weeks or 9 months of actual graft by a person to process it makes absolutely zero difference to you...it will still take as long as they said it would take when you applied.

     

    On the plus side...generally speaking, if DIAC tell you it will take X amount of months, then it usually doesn't take any longer than that...it would be a nightmare if they said it took a certain length of time and then took double.

    When we received our notification of application our CO said because of my OH criminal conviction they couldnt give us a time frame. Have you seen other other applicants that were told this ?

    any imformation would be great, we applied for an e676 VV 6 weeks ago whilst we wait for PMV and that hasnt come either my our baby is due in 8 weeks and im getting desparate

  11. Hi Everyone

    I am in Australia as PR I arrived 6 weeks ago leaving behind my fiance having applied for PMV, we are going through the same agent that helped me get my PR because my OH has a criminal record form a misspent youth. Application sent on 27/09/12 and CO appointed on 10/10/12 further info and medicals requested on the 11/10/12 and sent. Medical done on the 5/11/12, application was front loaded with police check and statement about convictions.Email from CO says she cant give us a time frame but our agent thinks around 8 months. I am 31 weeks pregnant so its the worst time to be away from my OH and he is very down in the cold wet grey UK we skype for at least an hour everyday but its just horrible being apart. You may ask yourself why did you come with out him, well my 5yr multiple entry was due to expire in December and i would rather our baby be born into this beautiful country.Much easier to bring bubba like this and we thought not such a wrench for out parents.

    As its so important OH gets here for the birth and to supports me whist he waits for PMV we have enough savings to financially do it so we have also applied for an e676 VV for 3 months, that was applied for on the 10/11/12 CO appointed on the 15/11/12 OH received a phone call from CO on the 16/11/12 asking about his convictions, she said she was happy she had everything she needed now application is at CCU in Hobart awaiting consideration. The wait is agony we just want to be together especially at this magical time, this is both our first child, i take video of bubba kicking and moving and send it to him but its not the same, Christmas was cancelled for us this year but fingers and toes crossed next year will be an Aussie Crimbo with lots of champas. I know its quite a in depth situation but would really appreciate anyone in a similar situation. i have scoured PIO looking for anyone in a similar situation but everyones case is so individual.
