I just got few questions regarding the 857 PR visa restriction. One of the restriction was the visa holder needs to be in a regional area for 2 years before the restriction is lifted. My question are as follows:
1. Is it the visa holder needs to be in the regional area? or should it be the visa holder AND the employer needs to be in the regional area? The reason I ask this is that I'm planning to move and stay in Geelong (which is a regional area in Victoria), and work in Melbourne Area (around Port Melbourne area - Williamstown, I think). And it will be at most 45 mins drive from Geelong to Williamstown at rush hour.
2. I think this question will be awkward and unusual, and depends on the answer on question 1. If the restriction only says that I need to be in a regional area for 2 years, can I do a FIFO from Melbourne to any regional area (ie Mackay)? It would be working in Melbourne and flying back to Mackay as Mackay will be my permanent residence. I think this is absurd, but I think you can get away with this. Your postal address/residential address will be in Mackay, and still continue working in Melbourne, renting out a room at my friend's house?
3. What if your on a 857 visa, and you were assign by your regional employer to work for a project in a major city, ie Melbourne, for about 2 years, are you allowed to do this? What if your employer transfer you to another branch in a major city, are you allowed to do this?
I just feel confused as well as desperate to transfer to a major city as I'm becoming unhappy staying at regional areas. Hopefully I can gather the right information before I do this. :biggrin:
