  1. Hi every one

Im in sydney waiting for my off shore partner visa into my 7th month of waiting now. Do's anyone know or when are people getting there visas if its the 8 or 9 month???? the waiting is killing me.

HI Dean Judd, my OH's came through just under 8 months we applied 28th August 2012 so that should give you a feel. Once you are 1-2 weeks away from the 8 months wait, I would email your CO and request an update on the application status. Probably worth looking a overseas flights for at 8 /9 months mark to see what you can realistically do as the CO will ask for flight details once your application is at the finalisation stage. So good to have a rough plan. Not long to go now.

  2. Hi, my husband applied 28th August 2012. No word from KP our CO yet however he did say in previous verbal communication that the finalisation date "would typically be 8 months so for example 28th April". It seems to be 8 months on the button at the moment. Big however, he knows we are not in a rush as husband has a 457 so already in the country. Not sure if that makes a difference. So not long to wait i suppose. Good luck

  3. Thanks George. It is inconsistent. Which is what has thrown me/us. I didn't notice that bit before and of course, because just about everywhere else it said passport was ok or birth cert, we though passport would be fine.

    In 47SP, part E, #50 it asks

What is your fiance or partner's citizenship/residence status in Australia? Tick one box only

Australian citizen by birth (please attach a certified copy of your fiance/partners birth certificate)

and other options that don't apply to my husband like Aus citizen by grant, PR of Aus and NZ citizen.

That is the only place on my application is asks for his BC. But then in the notes is tells me either birth cert or his passport is acceptable. The next question 51, asks for his Aus passport details, which of course I can provide.

I think we'll apply without the birth cert and like you say, if they want it, they can ask for it.

I agree with GeorgeD send off the application ASAP and if they need it they can ask for it. At least you will be 'in the queue'.

It would not hurt to apply for it anyway at a later date.

  4. Help!!!

Quick question as its thrown us a bit. On the application booklet it said hubby would need to provide either his Aus passport or BC. So we carried on planning to use his PP. Filling out application it's asking for BC and PP in two places but elsewhere then says his Aus PP is fine.

Are we ok with only the Aus PP for the application? Otherwise we have to get a BC copy sent over from Aus.

    Thanks in advance :)

    Hi Snifter,

I used my passport (notarised copies) to apply.

I did also sent a copy of a certified copy of my birth certificate from 1972 (not original BC).

For some reason an original birth cert was not issued at that time in Perth.

A notarised copy of my certified copy birth cert was used in the application and this seemed fine.

I would ring the visa applications office and check.

Please note to apply for Oz passports for my children outside of Oz, I needed an original birth certificate. So I had to send off for one anyway. They birth deaths and marriages offices post one to you very quickly, its worth getting.

Hopefully someone else can clarify if the BC is necessary.

  5. My OH submitted application August 2012. I had thought based on recent POI threads that July/August applications were starting to be processed...however our CO KP today wrote back to say the visa is likely to be processed in April.

The reason given for this is apparently due to the high volume of applications and therefore longer processing times expected to get through them all.

So I am hoping (Plan B) OH 457 sponsorship comes through from his employer comes through before we fly on the 7th Feb.

Otherwise we would have to go out on a tourist visa...we only have one way tickets. I wonder if one way tickets would be an issue on a 3 month tourist visa?

  6. Hi Ems4321, my husband has been offered a job too, due to the visa delay he is going on a 457 visa in the meantime. If I had known this at the start of this process we could have done the 457 months ago and be moving now! As it is, we go in February. The 457 visa process seems fairly quick and the medicals and character checks for the spouse visa are used so you don't have to redo them.

  7. The big mistake people make (me included) is trying to understand the link between the amount of work required to process a visa approval and the length of time betweeen application and grant. There is no direct relationship, the two timescales are completely unrelated! It will probably take a good few hours for a CO to review an application and carry out any further checks. If everything is good then your application probably very quickly goes into a pile to be approved at a later date. The length of time it sits in that pile has nothing to do with your application or your situation. It is decided by visa quotas, legislation and working directives. Your only input is when you actually sent it in and where it placed you in the queue.

It used to be that you would have a speedy process if you gave them all the info up front and did your medicals and PCC prior to application, but pretty much everyone does that now and the processing time already takes that into account. If you didn't provide enough info or the meds, etc then there is every chance your application could take longer than the published time. There really isn't any way to speed up a Spouse Visa application other than apply for a diffferent visa in the meantime! Counting on getting lucky with an early grant is not a wise thing to do...it will most likely end in tears. You will find that most COs will tell you quite early on that you have given them all you need and you will be fine to get your visa...in x number of months from now.

Helpful advice, thank you. I will proceed with getting my husband an alternate visa (457) in the meantime. The other posts were useful, glad to know others are faced with the same situation.

  8. Completed spouse visa application 28th August. I was under the impression that it would take 5 months to process and then was told 8-9 months which means May or June 2013! We had planned to move at Christmas however have now booked flights for the start of Feb 2013. My husband will enter on a tourist visa. Due to the time lag his prospective employer is going to push through a 457 visa sponsorship so he can start working straight away. Can anyone tell me why there needs to be an 8-9 month wait? The 457 visas are processed in 1-3 months. The CO has already told us everything required has been submitted. Paid a hefty fee...why the delay? Surely €1500 covers and administrators time? I note they intend to significantly increase the visa processing fees for 2013.
