Hi there, back in early 2012 I was hired as a restaurant manager on a 457 visa, I was told I had to pay for my Visa, visa agent and flights -Which I did. The contract I signed for my immigration visa stated that my working hours were 38 hours a week. When I arrived and started working it was actually 99 hour pro rata fortnight, that my annual salary stayed the same 50,000. Some fortnight I worked over hundred and 30+ hours. some weeks I went over three weeks of constantly working every day before I got the day off . When I did get a day off i get called up at 5 AM in the mornings and told I have to come to work. I was just told as a manager i should suck it up and that any hours extra I worked I wouldn't be paid for.
The owner was constantly getting into trouble by fairwork, whenever they investigated her, she gave them false information and filled out Payslips herself without staff consent. Many of my shift started at 4 AM and I would work through until about 5 PM in the afternoon I wasn't given any extra pay for these shifts. I was also made to work public holidays with no extra money or time in lieu. Have since left the business after working for her for two years and I have now gained my pr with another company.
My old boss used to get very defensive when she was drunk, and if anything was wrong at the restaurant and I was at home after finishing my shift she would call me up numerous times and be quite drunkenly abusive on the telephone. Obviously after two years of this got to the point where I couldn't take it any more. More importantly my husband couldn't take anymore. It's been over a year since I left and she still hasn't paid my superannuation that I have taken to the tax office. The thing that really gets to me the most though is she still hiring people on a 457 and the work situation is still the same. is there anything I can do about this? is there anybody that I can complain to? is there anybody that I can take this further with?
When I first left the company I called up fair work to discuss this with them- my situation , but they really didn't seem too interested and they really weren't interested in my whole Visa obligations.
I understand that I'm not going to get compensated for all the extra hours that I worked and all the time that I was underpaid but I don't want other people to feel the way that I was made to feel and work under the same situation that I was made to work under.
