  1. No not at all Mate if you want to leave then leave. I am just saying this guy is a bully from what you are saying and will always be a bully, and HR by the looks of it have failed in their duty of care to their employee. It does say ENS can be revoked if you leave within 2 years but you are allowed to put your side across, so as long as you obtain all the minutes of the mediation sessions you have a valid reason that I do not believe immigration would chastise you for.

The more evidence you get on this individual the better it will be for you a letter to HR stating after numerous mediation sessions you are still being bullied and you do not believe HR are taking it seriously enough. Documentation is the key, this individual is forcing you to resign as he is making the relationship unworkable. you could potentially have a legal claim going forward, Maybe speak to Immigration with your concerns they maybe able to help you rather than hinder you.

    Good Luck buddy

Thank you to all for providing the advice. I really appreciate it. I now know what options are. I can leave if I want to and if it continues I will go. I will discuss it further with HR and hopefully the situation will get resolved. Knowing I can leave certainly takes the pressure off as I know I have a choice if things get bad.

    Thanks again

  2. ok so things not so great .... have you got any written evidence that you have taken mediation ... if not get a copy of anything written down... then tell your company to shove their job where the sun don't shine... they cant touch you if you can prove there is a break down of the working relationship with your job... the only thing they can hit you with out of pocket costs if it is written in your contract that you will work the minimum 2 years ... it has to be written in... if no such thing in your contract you can walk tomorrow and they cant do a thing, and they don't have the power to revoke your visa either unless you broke the law... leaving a job does not break the law especially if you ever had to discuss the situation which l doubt. Also the idiot causing the trouble probably be glad to see you go... win win.....

There is no costs on their behalf. I paid it all including the costs of the company nomination. So there is nothing in my contract that states I have to stay or reimburse them.

There has been notes taken during the mediation, things are ok for a few days after, but then he will just kick off over something. I would like to stay but not like this. I can't see the situation being fixed and even if this issue is addressed, it may not be comfortable to work there. I can get another job quire easily as my skill are in demand so I not that worried if I had to leave and my wife can support us both for a while.

I get the feeling that Fletchaman thinks I could be in trouble if I decided to leave.

  3. Have you had any meetings with the said person with HR present, so you can air out your differences

Yes, we have met several times with a mediator. Afterwards it is ok for a few days, but then it just goes back to how it was before.

  4. Can you not put in an official grievance or escalate it over HR, as it seems they are not helping you

That is an option, but once you get to that point of going over people's heads the situation gets that point, I wouldn't see any future in the company.

  5. Hello,

I have been visiting this site for a number of years. Thank you to all the contributors, I hope you can help me reach a decision.

I was granted PR on a 186 employer sponsored visa at the end of June.

I enjoy my job here is Australia, however there has been a re-organisation in the last couple of months and I now have a new boss to report to. We don't get on, he puts me down and shouts at me in front of other employees including members of my team who report to me. This behaviour has not gone unnoticed and our relationship has been elevated to Human Resources. We have had several meetings with HR to try and resolve things. There are ok for a few days before reverting back to the usual treatment. I do not see this situation being resolved.

Short of it is, I have had enough and I am considering resigning. I am lucky that my wife has a good job and can support us while I search for something new. My concern is that if I resign, the company will try to take my PR as I only have had it about 5 weeks. I love my job but I just don't want to go to work any more knowing what I am going to face.

Please advise, can they take my visa?
