  1. Is the cancellation done at the time of grant or after the ceremony? And how does that work if you keep your British passport? How would you gain re-entry? Does HA link your citizenship to your British Passport?

    Just after some clarification with regards to the RRV.

     

    Where someone has a current RRV, becomes a citizen and then gets an Australian Passport does Home Affairs cancel the RRV?

     

    Also, what happens with the RRV for the period between citizenship ceremony and the grant of an Australian passport? Is the RRV still in force?

  3. That is a million dollar question.

    My feeling is that it will depend on who gets in at the next election. If it’s the current government then I’d anticipate that it would go. However, they’d have to get it passed through the senate, I believe and that’s where it may have problems.

    So, in answer to your question no one can really say[emoji45]

    No it’s not a visitor visa. You get a visitor visa when you come to visit Australia. If you then apply for a 804 visa when in Australia you will be granted a bridging visa when your visitor visa ends. That is my understanding.

    Remember the need to be a genuine temporary entrant when seeking a visitor visa.

    Hi Alan - how do you if they are going to apply a condition 8503 on a tourist visa? Can you ask at the time of booking a flight?

    New to the minefield of parent visas. My parents are hoping to apply in the new few months. 
    I can't seem to get a definitive answer re the 864 visa. It says on border website the processing time is unavailable due to low volume of applications. Does this just mean the processing time is not available or the visa?

    Hi - that message is usually in relation to the processing times and not the availability of the visa.
  8. Hi - I have found the information posted on the DHA site stating 75% take 12 months to process and 90% take 15 months, but, I am unable to find out what month they are up to e.g. October 2017.

     

    Can anyone point me in the direction where I can find this info?

    I am in the process of moving my mother out to Australia from the UK. I am a perm resident and my sister is a citizen and we are her only children. My mother meets all of the criteria required for the 804 (non contributory parent visa) or 864 (contributory parent) visas. The question we have is which do we go for and we would appreciate any advice. As far as we can see, the only advantage the 864 has over the 804 is the visa process time and the fact that she will be a perm resident within @2 years (as opposed to 30 yrs+ with the 804). The visa cost is @$60,000 for the 864 and only $11,000 for the 804.
    The only risk we can see is if the Government change any legislation or the visa requirements which mean that she would have to leave Australia. Now everything we find online pretty much indicates that even if they did this, it would only affect new applications and not current applications, so she would basically be safe to stay indefinitely in Australia regardless.
    With visa processing waiting times of 30 yrs minimum for the 804, the reality is that she is unlikely to ever become a PR of Australia if we choose this visa due to her age (currently 68yrs old). 
    Which brings us back to the cost of the visa - is the 864 worth $60,000? Any advice or experience would be greatly appreciated.

    Hi - we are in a similar position and considering the options. She may not like it and return to the UK but we are still looking at options.

     

    My understanding for the 804 you would go on a Bridging Visa when the application is made. What I would like to know is do you go on one if you apply for the 864? The reason for asking is that if you don’t go on a bridging visa you would have to apply for the 884, which would increase the cost of getting the 864 by approx $5k.

     

    If they decided to get rid of the 804 and you had already applied I am sure there would be other options to consider, such as the 864 or maybe a new one?

     

    Would be interested to see which way to go and maybe we could compare notes via PM.

  11. So how are you going to get her there? Surely she isn’t going to lie about her intentions to DIBP and say she is going to be a tourist? If she’s selling a house, why not just apply for the CPV? More reliable all round I would have thought. 


    Just because she is selling a house doesn’t mean she isn’t a tourist. If it transpires that she would rather stay then there is the option of applying for the 804. Or she could return and move in with family. Don’t assume you know all the facts.
  12. Remember that the Government tried to withdraw the subclass 103 and 804 visas in 2014.   The measure was overturned in the Senate.
    The Government has even less control over the Senate now than it did 3 years ago.

    Hi Alan - we seem to speak a lot on this subject...lol

    The MiL has her house up for sale now so she is moving in the right direction. I hear what you are saying and whenever I search 804 it only returns the decision from 2014 in the Senate. There is no indication that they changing or stopping the 804. Normally they put a “leak” out that would indicate what is happening.

    We may have to see about bringing her over before the sale and take it from there. All fun and games.

A lot of agents feel that immigration will tidy up Parent Visa's  and as one new one has just started (5year/10year) one that because of the estimated 30 year wait on the 804 that  they will most probably  curtail the 804   we are just worried as we are 6 months into the 804 that they will abolish it completely........ not just close it  but nobody knows until it is announced    Agents seem to be saying they will close it.


    Normally, they will honour the visa that you applied on but as it’s government anything could happen.

    Has anyone got any ideas when the decision is likely?
  14. About 1 week  after we arrived.......applied and got our acknowledgment within 2 days plus a Bridging Visa A.  Everybody expects the 804 to be stopped so apply as soon as you can while it is still available in my opinion


    What makes everyone think they are going to stop the 804?

    Just looking for advice about the Subclass 804 visa for my MiL.

     

    She is looking to come here on holiday next year and will more than likely apply for the 804 whilst in Oz.

     

    It would be good to speak to anyone who has been or going through the process for this visa.

    6 - Probably one of the most important questions and that is what are the experiences like for those that have applied for the 804 - good and bad. Especially, with regards to the medicals.

  18. Well it's a year today since we arrived in Canberra from the UK. All in all things have gone pretty well. Apart from my dad deciding it was time to join my mum and me having a slight health issue it's been great. We both have jobs and the kids have settled into school and college. They are both playing rugby and have made some good friends.

     

    As for Canberra we love it plenty of things to do and places to see. The traffic is great and the roads are pretty good on the whole. The only thing that let's it down is the house prices and the amount of land you get with a house! Also, I reckon they are on the way to spoiling it somewhat with all the construction going on......doesn't make sense as the government are making plenty of redundancies!! Whose going to buy all the homes?

     

    Anyway, let's see what another 12 months delivers.
