Eve Posted June 7, 2016 Share Posted June 7, 2016 Dear , Me and my partner are applying for partner visa. We have lived together for over 18 months before we split for 2 months. We met abroad where we lived for 7months and dated for 3before that. Also we lived for 10months in Australia as I was on Visitor Visa. During these 2 months of the split I applied for Extencion of Tourist visa that was refused. I also fell sick, was admitted to hospital with a condition that I cant really fake. I was given a bridging visa after bridging visa until I sort my condition and go through the blood checks and so on. It was complicated condition requiring treatment. Because I was already refused a visa I could not apply for any while in Australia. I left Australia 4months after the final date of my tourist visa. As everything was legal, reported to the Immigration Department with documents from the hospital and so on. After I feft, we have always been with my partner close even during the split. We were very close. I had to leave the country. During the split I noted in my applications that I am single, as I was. I could not claim that I was in this relationship as we were not for this short period. We were figuring out things. We regained our relationship as I left, we realised we really need each other. We talked and we are back together with serious plans for the future as we had in the past. We travelled to New Zealand so we can see each other. We are 24/7 in touch. As we previously planned to stay in Ausy before all that happened, I applied to Study my PhD there, and I was accepted. However, they refused my student visa. I claimed about my relationship with my partner on that last application, and they wrote that there is a partner visa if we are in relationship for that purpose. Lastly, I also tried applying for a tourist visa after I left, trying to go back as me and my partner wanted to see each other. I am in such a mess. Do we have a chance for partner visa? Shall we marry? Is marriage stronger prove of our relationship. We have been together for nearly 3 years. George Lombard Posted June 7, 2016 Share Posted June 7, 2016 Hi Eve, OMG you do need to sit down with an agent and talk this all through carefully. Probably it would be a good idea for your partner to visit an agent in Australia and conduct a three way conversation using Skype. As a first step you will need to retrieve the Department's documentation of your various applications using the Freedom of Information Act and in particular form 424 from the Department's website, just to clarify how bad the situation might be. Note that there's not necessarily a ban arising from you having left Australia as the holder of a Bridging Visa E, but there might be a ban arising from any false information in your applications, under PIC 4020.
