Hi All,

I am separated from my husband from last 8 months. I have a child of age 2 years.

We are planning to go to Australia on tourist visa. Will I be able to take my child with me, without the consent of my estranged husband (hes not ready to give his consent)

Is there any way out by which me and my child can go to Australia?

Thanks.

If you are based in the UK, depending on the contact arrangements you have in place, you are normally only allowed to take your child out of the UK on holiday for about 3 weeks before you need consent from the other parent.

I'd seek some kind of legal advice unless you are just going for a normal 2-3 week holiday.

For the visitor visa, in most cases Australia do not need consent from both parents in order to issue this type of visa when one or both parents are accompanying the child

You'll have to check your legal standing in your own country. You may be breaking the law if you take the child out of the country without consent from the other parent.

its not very clear and depends on the legal standing re parental responsibilty as per

https://www.gov.uk/permission-take-child-abroad and one parent does agree that could cause problems. See also http://www.sydneymitchell.co.uk/news/legal-implications-taking-children-abroad-if-you-are-separated maybe get advice from citizens advice.

The OP is not in the UK, so will have to check the legal responsibilities in her own country.
