We are currently waiting for 101 visa for my son. Now the new law has been passed that the visa can be approved while in australia. Has anyone travelled to Australia on a 600 visitor visa while waiting for the 101 visa to be approved. We are pr and he is British. Thanks

Currently, only PR and Aus Citizens (and their immediate dependents) are allowed to come to Australia. You can apply for a travel exemption and see if it will get approved.

    Hi all,

I got letter from CO for s57 natural justice comment on adverse information.

my wife applied her student visa after my 485 visa finished. We could not lodged visa because of health issues with my wife and my father. The person who lodge the visa did not mention my wife have 2 visitor visa refused. They raise the issue why you didn’t mention it as our records are showing different information and they ask justification for PIC 4020 as well.
my father was so sick and wife is expecting we were mentally so stressed and could not go through the application even my father passed away after one day of visa lodgement.
they provide us 8 days to respond but my agent didn’t check our application and 18 days elapsed already and we submitted our response after 8 days. Agent attached his declaration with explanation as it is his fault not us. Would it be justifiable and would we get our visa.
As we were on 485 with full work right so I start business with my Auzi friend and we mentioned in our statement as we are employing 5 people will this thing effect our GTE?

    your suggestions required plz

    hi there,

I would say your agent should have checked all the information in your visa application prior to lodgment but as an applicant, you are also responsible to check every single piece of information you provide/answer in the application form. I'm surprised that your agent missed the due date to submit the required information/ declaration, perhaps you need to re-assess if your agent has provided the appropriate migration services you have paid for.

    Hi there,

My Skills assessment has recently back fine today which is nice news (and my title is on the skilled shortage list). Unfortunately though because of the current state of the world with Covid still going on, it seems there are no states allowing offshore applications (from me checking each states gov website).

My main question is - Is it a complete waste of time trying to lodge my EOI at the moment and if i do so will it just lead to my EOI being rejected? I have 2 different states which I want to apply for (which do have the skills on their list, but just not for offshore applicants). Also, should I lodge more than 1 EOI - 1 for each state of the 2 states if that is possible or should it all be done under the same one?

    Thanks

You can create multiple EOIs so it's really up to you. Most states are not accepting offshore applications atm.

thanks RD and how long did it take from your initial EOI submission to the state to visa grant? I know this is variable and hard to predict but I'm trying to get a sense of total timeline.

    Hi,

Are you still waiting for your SC491 to be approved or is it already approved and you are just waiting for the borders to open so you could enter? Your grant letter will say by when you should do an initial entry normally it's 12 months from grant date.

    Hi there,

My husband would like to apply visa 143 Contributory Parent Visa for his 2 parents. I am not in support of this application as I think its a recipe for disaster. Please dont judge me. I am choosing to stay with him for now, despite him being violent towards me.

May I please ask if his application will be rejected if I do not sign Part M "Your Partner's Approval" in Form 40?

     Thank you.

If it's in the form and section M is relevant/applicable to the visa application, not signing it might have an impact on the visa outcome.

    Hi everyone,

I'm eligible to apply for the de facto 820 visa with my partner.

I'm also eligible for a 190 skill point-based visa (85 points and my occupation is on the skilled occupation list.)

Which one would you choose (besides the visa fees difference) and why?

Also, I'm currently on a 482. When my 482 expires and if I applied for the 820, the bridging visa kicks in and I get PR rights.

However, I don't know what would happen in the same situation if I applied for a 190 visa?

    820!

Yeah, i just assumed that with a drastic reduction of planned skilled visa migrants i would be disadvantaged due to industry and type of Mech Engineer. Shouldn't assume i suppose! I think the best options is probably a more in-depth professional assessment as you say.

What is the best way to get in touch directly?

If you are happy to pay to obtain guidance from a migration specialist, I'd say do it but if you are keen to do the process on your it's also doable but you will spend time reading, going through the requirements, etc.

Your occupation Mech Engineer plus relevant work experience might you might have options to obtain a visa in Australia. Don't spend too much time thinking about the planned reduction on skilled migration, instead, use your time to kickstart your migration process now or at least get your skills assessed by Engineers Australia to see if you will get a positive outcome or not then take it from there.

With your age, you will get a decent score with that easily. If your aim is to get to Australia the quickest possible time via skilled migration and you are not fussy about which state/city you will live in then you have more options and you might get your visa sooner than you think.

    Hi all,

We immigrated to Australia 6 years ago and then returned to the UK. I feel we made a mistake coming back and are thinking of applying for a visa again BUT me & my husband are 44 now. Is this too old? I am interested to know peoples ages when they made the move. Our kids are 12 and 8.

My husband is a Plasterer and feels he is too old to start at the bottom again as it was a struggle to find a job when we came before.

The first option is to see if you can get RRV. If not, then you might need to do the entire process again but with your age, it might be tricky considering Australia is closed atm and only a few offshore applications are being prioritized. The age clock only stops by the time you received the invite from DIBP.

    Hi all

My wife and I are currently on a 489 NT regional sponsored visa (signing an agreement to work 1 year & live 2 years in the NT).

We have been living and working in the NT for the past 14 months but now have plans to move to Queensland (still within a regional or low-population growth area) respecting condition 8539 of our visa.

Question: Will the fact that we will not have stayed in our sponsoring state for the whole 2 years as agreed, effect the outcome of a future 887 application we make?

Thanks in advance for your kind advice.

You have a moral (not legal obligation) to stay in NT for 2 yrs. If you leave NT before the 2 yr period it is possible that it might affect your 887 (no one can guarantee that because your 887 visa application will be assessed by a C.O.)

Please keep in mind that only DIBP can grant and cancel visas and not the state(s). There is a risk involved so if you will feel comfortable getting advice from a migration specialist do it as this one is a sensitive matter, but then again, most migration specialist will not provide you a direct answer to this.

Other states give out 'release letters' but others don't. I've heard others have done that because they have a valid reason like they are applying for jobs for the past 6 months but can't find any, so they sent an email to the state outlining their situation and provide evidence of job rejection emails as proof. In your case, you have a job so I'd say unless you have a strong & valid or compassionate reason to move out of NT do it, if none, better to stick it out until you finish 2 yrs just to be on the safe side.

DIBP assesses visa applications based on legislation, regulations, policies, etc. so as long as the applicant meets the requirements for the visa SC they are applying for then there should not be a problem.

    All the best!

    Hello,

I am a Physiotherapist with 10 years of experience, aged 36, looking to migrate to Oz with my husband (who is a dentist and has excellent English skills, and he's 35 with 10 years of work experience)

We would like to move permanently to Australia in the next few years, and are trying to understand a clear path (easiest one?) to do so, we are open to all possibilities

As far as we can understand:

    - His job (dentist) isn't on any long-term skills list any more and is only suitable for a temporary regional visa

    - Which means we would have to lodge an EOI under my job (Physio), so 189-190-491 could be possible pathways?

    - I checked with a point calculator I should be able to get 80 points

    - We are open to a change in jobs if it is necessary to get the PR (I've read several articles citing jobs with lots of vacant spots like carpenter / panel beater?)

    - I am an excellent cook / pastrychef, which I have been doing as a hobby in the past several years. My husband is an excellent programmer

    - We particularly love Queensland but are open to other states (we loved South Australia as well as NSW and Victoria so it's not an issue)

Based on this information, after things "normalize" this summer, what do you think would be the most feasible pathway to PR?

    Thanks

I think you don't need to change jobs/career coz Physiotherapist is in the skillslist.

Whilst Australian borders are still closed atm and not many visa approvals for offshore, use this period to prepare your migration journey (if you have not done started it yet). Don't delay , coz you might lose points with age if you reach 40 and migration rules change often.

    1. Obtain your skills assessment. Check https://physiocouncil.com.au/overseas-practitioners/visa-skills-assessment/

    2. If you are claiming points for your partner's occupation, skill assessment is needed

    3. If your skills assessment is successful and you have the supporting documents for the points you are claiming, you can lodge an EOI (multiple EOIs are allowed)

    4. 189 is PR and you can live/work anywhere in Australia. 190 is a PR visa - State sponsored, you have to live in the sponsoring state for 2 years, 491- this is a temporary visa for 4yrs, you need to live/work/study in regional areas/or sponsoring state for at least 3 years and meet all requirements then you can convert this to 191 - which is a PR visa.

You have to consider how soon you want to be in Australia and then choose the visa that will give you that the quickest. If you are not fussy about which state you will live then you can explore 190 or 491 (regional). Perhaps 190 is a good choice if you don't have high points as this one is direct PR.

Btw, don't get scared with 491 Regional Visa because the definition of "regional' for immigration purposes is anywhere except Metropolitan Sydney, Brisbane and Melbourne, which means big cities like goldcoast, woolongong, Newcastle, geelong, Perth, Adelaide, Canberra, Hobart, Darwin, etc are 'regional'.

Another thing to remember, only DIBP can grant and cancel visas, your sponsoring state for 190/491 cannot cancel your visa especially if you have a valid reason that you can't fulfill your moral obligation to the state.

    5. For state sponsorship, each state has its own process, requirements, occupation list, points system on top of what DIBP is required. If you have time to read you can check state migration websites for details (ie NSW state migration, VIC state migration, South Australia state migration, etc.)

    Good luck!

Offshore 😞  so it would be a case of just waiting until they are accepting offshore applicants then?

if you are offshore, with the current border closure, you might not have a big chance. Do you have all documents ready like skills assessment, etc.? I'd suggest, keep an eye once the border and state open its doors for offshore.

Each state has its own website that outlines their state sponsorship requirements, which occupations they can provide sponsorship for, and the state sponsorship process. It is actually straight forward.

Each state has its own process but normally, you will need to submit an application to the specific state first telling them you are seeking sponsorship from them (provided you meet their requirements). If you are successful in your sponsorship application, you will get an invitation from DIBP to apply for your visa.

    Hey everyone,

Basically I've had the thought on my mind for a while of wanting to move to Aus but feel as though I've definitely taken the wrong route to achieve that so I'm just after some advice.

I'm 24 years old and in the final year of a generic business bachelors degree (finish in May), I've noticed that most business-type jobs on the SOL are either those that are very difficult to get (e.g. Management Consultant) or only on the SOL (e.g. Marketing Specialist) - which has recently been removed from any state's sponsorship list.

I'm still at a point of confusion on where to go with my degree by this point, and the idea of undertaking a Masters conversion course into Quantity Surveying has been quite appealing to me, partly because its on the MLTSSL but also because I feel as though I'll probably prefer this to a corporate-type career. The only issue I have is that I'll be tied to working in the UK for a few years following this and I'm worried it might be taken off the MLTSSL in that time and I don't want to shoot myself in the foot; I've noticed that its not on any state sponsorship lists at the moment but I'm wondering if I'm right in thinking that could be temporarily due to COVID? The maximum points I could probably get through this route is about 85 if I apply in my early 30's following 5 years of experience, or 80 in my late 20's following 3 years of experience, and I'm fully aware that for independent visas I have no chance unless I get 90 points so it seems like a bit of a gamble, does anyone have any advice or views relating to this?

Another option is to do an ICT conversion course which I'm aware is in high demand but there are no local universities to me in the UK that offer such a course, so I'd end up spending a lot on commuting which doesn't feel like it would be the most sustainable option.

    Thanks in advance.

    Hi,

This is a tough call to make. I understand where you're coming from but sounds like you are trying to predict the future. With the current and rapid changes in SOL, MLTSSL, state skills list, who knows by the time you are ready, none of the occupations you have in mind are still in the list.

Not a lot of options here but perhaps you can look at the historical skills list and you'll see the trend of which occupation is stable on the list.

From my perspective here are some the occupations that are quite stable

    - trades

    - health/medical-related occupations

-engineering (subject to CAP/quotas on some)

    -education/ teacher

-ICT ( priority occupation for now due to pandemic but also remember, lots of ICT professional all over the world)

At the end of the day, it's up to you to decide.

Is it possible that is because I have merged the original document which is not in English with its translation into English in one Pdf? Do I have to separate them into 2 Pdf?
    Thank you for helping me.

If you have submitted colour copies, VETASSESS will not ask you to resubmit (I'm hoping they can distinguish colured from black and white 🙂

Can you not reach out to VETASSESS to get clarity?

    Hi Paul,

Could you please share what concessions are made for the 489 to 887 transition? and is applicable for those who are loosing an year in 489?

I got my 489 SA grant in Nov 2019 and I haven't made my first entry yet. I am aware of the letter published for all 489 visa holder on waiving the no later than entry date which is Nov 2020 for me. I lost one year already and not sure how much more I need to wait, but would be good to know how the process of moving from 489 to 887 would be for people who are loosing time due to this.

    Hi,

With the current pandemic, DIBP is fully aware of the issues visa holders are facing plus it's Australia's decision to shut the borders for non-PR so technically its out of your control even if you want to come back they will not let you in. Concessions have already been to some visas but I think at this stage, I'd suggest don't worry too much about your 887, I'm sure there are lots of others in similar situation like you. Remember, Australia can't close its borders forever. All the best!

    Hi,

For GTI, you need to submit an EOI using the Global Talent Contact Form. Your will get notified if your EOI has been successful or not. I'd suggest try submitting an EOI first and see if you will meet the GTI parameters.

Note that, GTI may sound that you need to have an exemplary career, qualifications, thesis, etc. but you will be surprised that others got approved without even having a PHD.

    Goodluck

Thank you, Paul! It is a complex situation but I would be ok if I have to wait a year to come back. I don't mind. I am just trying to gather information to feel secure before taking any decision.

I overheard that people are being granted 1-year BVB. I think in one year it would be possible to come back to Australia.

Maybe someone in this forum has been gone through BVB after covid

First, don't leave Australia without BVB.

Second, you can try submitting an application for BVB for a compassionate reason due to your mother's health situation. There is no guarantee your BVB will get approved though even if you mention it for compassionate reason but you can give it a try.

Third, if ever you will be granted BVB and with the current pandemic situation, you are aware that temporary visa holders are not allowed to come back in, if pandemic situation will continue and you departed Australia on BVB, there is a risk that you might not be able to come back.

All the best to you and to your mum!

    Hi there,

I've only seen your post today but it's good that you hired a migration specialist.

Are you currently located offshore? If yes, there is only a small amount of independent visa application from offshore being approved due to pandemic. Sounds like you are only at the early stages of your journey, maybe by the time you gathered all documents, things have changed and borders in Australia have opened up.

Hi we would have 70 maybe 75 and yes sadly that’s with the English test ( not superior though as heard that’s almost impossible to get)

Are you onshore or offshore? Plasterer is on South Australia state sponsorship skills list for SC190, SC491 and they only require at least 65 pts as long as you meet their state nomination requirements. At the moment, due to pandemic, most states do not accept offshore application for State sponsorship, you have to be onshore and living/working currently in the state.

  21. 14 hours ago, Jo2007 said:

Hi all, we are looking at a skilled visa as my partner is a plasterer however the points are confusing on different sites. It says you have to have 65 to apply. But on a different site it says if you have 65 points you are unlikely to be sucessful and you need 80+
whats everyone else’s experience with points/success?
I’m not sure a plasterer is high up on the list anyway so that won’t help

Yes 65 pts is the minimum as per DIBP requirements. It depends on what visa type you are applying for.  Normally, independent skilled visa SC189, the higher points will get invited to apply first.

There are other visa types which only require 65 pts and you will get a chance to get invited. These visas are normally through State sponsorship (SC 190, SC491). Have you explored this option yet?

    EOI submission if FREE.

    Hello,

Could anyone please clarify what this means from the SA state immigration site? does 2-digit level just mean the first two digits of the ANZSCO code need to be the same?

For the purpose of state nomination, closely related occupation is defined as within the ANZSCO 2-digit level.

    thanks

So you won't get confused, here is the link to the Australian Bureau of Statistics which has the ANZSCO. when you search your nominated occupation anzsco code, it will come up with information about the occupation and also the list of other occupations closely related.

Hope this helps! DIBP uses the Australian Statistics ANZSCO

    Hi all,

I'm a Senior Registered Mental Health Nurse, originally from Brighton, England and currently living in Melbourne. I had my 186 visa declined due to a technicality late last year with over $10,000 thrown down the drain but that's another story! I'm now in the process of applying for a 190 State visa and my migration lawyer thinks I have a good chance of getting nominated.

I've completed an EOI, and I was under the impression that I then wait for the State of Victoria to contact me (if they want to nominate me) and they do this by viewing my EOI in Skillselect. Correct me if I'm wrong but I thought that the State then may choose to select me via the Skillselect page and if they do it triggers an invitation to apply for a visa?

However, I have just now registered an account on LiveinMelbourne and I am confused with the Registration of Interest (ROI). Is this something in addition to the EOI and if so how do I actually complete an ROI? The LiveinMelbourne page won't let me and seems about as helpful as the Immigration website i.e it takes you round and round in circles like one endlessly frustrating feedback loop. I cannot find the link to complete a Registration of Interest. Is this because the only way to apply for an ROI is during the tiny monthly windows of opportunity i.e is it only possible to even find the link to register an ROI during the next window 2/3 - 8/3? Or is it that an ROI can only be completed once my EOI has been selected by Victoria from Skillselect?

Any assistance would be much appreciated.

    James

    Hi James,

Victoria has changed their nomination process as they want to prioritise occupations that will help Victoria recover from pandemic (ie, medical professionals, allied-health occupations, etc. if your occupation code is Registered Nurse (Mental Health) - 254422, then there is a chance that you might get nominated. One thing though, you mentioned that your previous SC186 application has been declined, what's the reason why DIBP refused your SC186?  There are restrictions on which visas you can apply if your previous visa application has been refused, especially if you are onshore during the visa refusal.

Here is the current nomination process..

    a. You need to register and submit your intent to get sponsored by Vic and you can do this by creating an account in livein Victoria site and submit your Registration of Interest. Victoria has listed a schedule by when submission of registration of interest is allowed and when Vic will do their selection process. You can only submit during those dates.

    https://liveinmelbourne.vic.gov.au/migrate/skilled-migration-visas/registration-of-interest-for-victorian-state-visa-nomination

    b. If your registration of interest has been selected, you will receive an invitation from Victoria to submit your application for Victoria State Nomination

    c. If your application for Victoria State nomination has been approved, you will receive an invitation to Apply/lodge your 190 visa application to DIBP.

    Key things to note:

    a. Make or update an Expression of Interest on the Department of Home Affairs' SkillSelect system. You must have updated or made your Expression of Interest on or after 1 September 2020.

    b. If your registration of interest has been selected, it does not guarantee that your Victoria State nomination application will be successful.

Hope this helps. If you are using a migration lawyer, he/she should be able to explain and guide you with the process.

    All the best!
