Does anyone know how we can write an email to DoHA? I could not find any email address on their website. We still could not get a definite answer regarding Toefl Test- Home Edition. I even got in touch with them via phone, but no concrete answer. I know that they are not perhaps very responsive, but I think it is still worth to try. Thanks.

Hi Mate, Home affairs has confirmed that home edition won't be accepted

For primary and dependant the BVA on 186DE will be without any conditions. But will be activated when 457 expire. and from this moment dependant and primary should be able to work for any employer. But definitely it is good to confirm it with MARA agent.

    Thanks for sharing info. Appreciated.

It seems so, but you need to be nominated by any employer, and 457/482 have to expire in the meantime and your sponsor cannot withdraw your nomination in that case you shuld be able to work not only for the sponsor.

Actually I want to know mainly for 186 DE dependent because before primary applicant for 457 and now dependent on 186 DE. 457 will be expiring soon so will that work conditions carry or no conditions ?

  7. 1 hour ago, Laura Zorzi said:

My biggest apologies (above all to you Adam), you are right about the conditions on the bridging visa.

I am so inundated with 186s TRT – where remaining with the sponsor is a must – that I missed the point and focused on changing employer/sponsor! I had a very similar case some years ago, where the 457 visa holder was getting nominated for a 186 DE by another entity (although he never accessed his BVA as the 186 was granted before the 457 expired).

The 186 DE is a permanent visa so NIL conditions on the BVA. Given the current scenario, the 186 DE nomination must have a strong case though. So need to be very careful.

I hope you can forgive my (human) oversight and still appreciate my contribution to this forum 🙂

    Hi Laura,

Do you mean that after 457 expires the same work conditions will not carry for 186 DE BVA? In that instance can work to any employer (on BVA)?

    Your response will be appreciated.

    Thanks

    Ok, I found an answer:

The legislative instrument will apply to nominations made after 28 days from the commencement of the instrument. The commencement of the instrument is the 3 September 2020.

Therefore the new requirement will apply to all nominations made on or after the 30 September 2020.

I agree and also found some more information on below link

    https://ministers.dese.gov.au/cash/supporting-australian-business-fill-critical-skills-needs

Specifically below line for all the occupations,

Existing skilled migration occupation lists will remain active and visas will still be processed, but priority will be given to those in occupations on the PMSOL.

Thanks mate. The turnover of the company was 1.2 mil ,there were couple of concerns/challenges that we faced for the nomination :

    1)    The Structure of the company
    2)    High Risk Industry
    3)    Genuine need of the position
    4)    How the position relate to the contribution of the company

2 MA were reluctant to take the case mentioning high chances of refusal deeming it as an application the DHA will scrutinise more closely. We had to argue that the role fits within the nature and scope of the business operations,  but they were reluctant to help us because it will be more work for them i believe.

    Thanks mate.

Mine only financial hardship orher than everything is fine .... Let's hope for the best.

Thank you so much Paul,  even with our qualification, work experience and all the documentation we had some MA dint wanna take on our case as they believe we dint have a strong case especially on the company who is sponsoring us. Some personal and financial aspect were a concern for us as well. There's more i wish i could share but yea we are blessed. Thank you.

    Congratulations mark....

May I know what was your company turnover. I am also in the same situation. Initially my MA was denied to take the case as it is high risk application considering company financial status. Your response will be helpful.

    Thanks.

    Hi,

    Thank you for answering.

Have you or anyone you know applied in the same scenario?

Yes, all my experience (close to 4 years) is noted in my skills assessment. Are you sure that the experience before the skills requirement met date counts too?

    Thanks again.

I have applied with same scenario and 2 of my friends already got visa approved with same scenario. There is no doubt in it.

Same for me as well. I have close to 4 years of relevant work experience but ACS took 2 years out of that for Skills Assessment. I talked to an agent and they said that only the experience after Skill Requirement Met Date counts which leaves me with a little less than 2 years of experience.

In the requirement for 186 visa, DOHA has written "have at least 3 years relevant work experience, unless you are exempt" which is a bit vague.

I am wondering if anyone else in our situation has applied for 186 visa and if they can share their experience.

    Hi Mate,

The Home affairs doesn't count that metdate.... all u need refer in your skill assessment that is your all experience are noted. If yes your all good to count ur experience.

    Hi guys,

This is a bit of a strange situation for us...my husband is a 457 holder since October 2016, and just got eligible for 186 TRT, but we are still collecting money and about to give PTE in December.

In meantime, the company, 4-5 months ago, decided to sponsor another guy (different position than my husband's) on a 482 visa. Yesterday they got the refusal letter, stating The company does not have sufficient finances to sponsor another employee (the turnover is around $400k, I don't know if that's low, and they are total of 4 employees, lost 1 just 2 months ago) . They are planning on appealing this decision, as this guy is a close friend of theirs and they want to have him as an employee.

Now they are asking my husband to hurry up with the TRT application (which we will, of course), but we are in a limbo....what will this refusal mean to us, as we gonna have to be nominated for PR from the same company that got refused on financial grounds? Are we OK, as my husband is working for them for more than 2 years now and is still the only sponsored employee, or his position can be refused as well?

Someone gave me the advice to send letters from the accountant and the CEO together with the application, stating that the Company will be able to provide work and finances for my husband in the next 2 years, adding any on-going or future contracts with the clients. Has anyone done this, will it help? I mean, we'll do it anyway, won't cost a thing, but everything else will....

We are a blood donor and an aged care volunteer and we contribute so much to this country...it would be so unfair if they'd refuse our application based on previous events, but the past 2 years showed me that nothing is fair when it comes to immigration..

Any advice will be highly appreciated and helpful, thanks folks!

    Hello,

May I know your application status? As I am also in the same situation. Your response will be appreciated. Thanks

I think it's up to multiple factors, not just yearly turnover and investments.

In my case, the first company got nomination rejected due to "can't afford me in the next 2 years" had about 10m turnover and signed up for 30m as series B. But the gross profit and bank deposit didn't look beautiful. But that company survived the financial turbulence and I think my position would be pretty safe even in COVID-19. My current company had about 10m turnover, but never takes any investment since seed funding because the profitability is quite healthy. I applied right after probation ended.

I think there is no straight answer here. I'm not even convinced for the first rejection and so we put a case in AAT. Since you have lodged nomination, let's hope for the best.

Thanks mate. For the first nomination, have u applied through MA or company?

And which year u have been applied for first nomination ?

For others on this forum, Appreciated if anyone shares their experiences on my situation.

    Hi there,

I got my 186 visa granted today. It's been a bit rough to get there. The point-based system for 189 went to crazy arm race soon after I got my 65 points. And then my first attempt on 186 nomination was rejected due to tech startup financial roller-coaster. Meanwhile,  the country I came from has been trying to screw up the world by all the ways it can.

I hope you all will get your positive response shortly! Wish you all safe and sound through this crazy time.

@restaurant.manager As a silent reader, I saw a lot of your depressed comments. I felt the same, most of the time. I just want to give you a virtual hug and pray for you.

    Hi Mate,

I was a silent reader in this forum from last 1 week. I have applied for 186 DE nomination on Developer programmer in last week. My company is start up (which was started in 2016) and there revenue nearly USD 230k per annum and also they have investors which are investing around USD 300k per annum. I have a question that the amout and turnover would be enough to approve my nomination? What was ur start up company turnover ? In which year i been applied from them? What are ur thoughts on my case. I appreciate if anyone share their experience on this situation.

    Thanks.
