    Just to share some news,

    Today the department of home affairs rang the company I work for to speak with the director.

    They wanted to confirm if I have been still working here.

    So I would say they are working on something, hope this is a positive outcome but we never know.

  2. How are we going this week guys?

    This week my MA contacted me because they were assessing my application. So they requested a few additional documents to the nomination and also some documents to my visa application.

    I've sent everything on the same day and now I am just on the painful wait period.

    And by the way, the status on the website has not been changed yet

    The problem lots of people face is that, when you use an MA, that email goes to them and in many cases, it takes the MA sometime to notice and update you on same. 
    - I told mine about my approval the next day (meaning they had the email for 24+ hours and only knew about it because of me). 

    If you not using an MA, different story (as the email should come directly to you). 

    I always monitored my account (tried keeping it to twice a day (morning and evening) as I didn't like relying on MA's.

    There is also an article from EA discussing about the topic. We couldn't get any formal letter from EA, as they can't claim a false negative (which means, they can't prove there is no requirement to be registered in NSW, although they know it's not required lol). I spoke with both EA and Board of professionals in QLD asking about the obligation to be registered in NSW and what has been requested in my case, and they were both perplexes.

    in regards to the requirement, it's there on the home affairs website, as a generic request: 

    Licensing, registration or membership

    You must be licensed, registered or a member of a professional body if it is mandatory in the state or territory you intend to work in.

    But when it comes to Engineers, it's a bit blurry and according to my MA, that'st the very first time she has had such request from a CO and neither of her colleagues faced the same as well.

    So What are you providing them now?

    According to the National Engineering Registration(NER) scheme from EA, you need at least 5 years exp as a professional engineer to be registered as such. Without the registration, theoretically, you are not "an engineer"... however, this is the law and requested in QLD, as an RPEQ engineer. VIC has recently passed a bill to turn it into law in the state as well - all because of the Opal tower, and others, here in Sydney - but in VIC isn't mandatory, by law, as yet. NSW has 2x Bills being discussed, but none approved as yet - which them implies it's not required.

    So, our understanding is that the CO is asking about the NER (or similar, for instance with the board of professional engineers in QLD), which at the moment I don't have and haven't seen anyone, from an engineering background, to be asked to provide for immigration purposes - unless you are located in QLD, then I would say 190 and 186 would definitely require the registration.

    My understanding was that skills assessment was sufficient.

    • My company's turnover is about $1b, not including the other parts of the group.
    • s56 Visa request: Evidence of registration/licensing if required --> I am located in NSW, where it's not mandatory to be registered as an engineer
    • s56 Nomination request: Contract with mention to min 2 years, genuine letter, detailed position desc (which has already been provided since the first application) and again the evidence for registration/licensing for the employee.

    I have got my company to re-do my contract, no big deal. Genuine letter ready and signed off by my general manager (direct boss), position desc is pretty the same (as it's an official 5 pages doc from the company and the doc to explain why the registration isn't required is the same as the one for the visa application.

    Unfortunately, it took us a while to put together some docs and we expect to submit them today, 3 weeks after the initial request - extremely anxious on how long it's going to take for the case officer pick up these docs again, considering the initial assessment was quite quick (including Xmas period).

    OBS: medical and police checks done in Dec, hence the reason the CO hasn't requested it - that's what I think so.

    Thanks for sharing.

    I've got a very similar profile but I am currently on 482 visa which was approved dec/2018 in less than a month,

    When you say registration, what type of registration you are talking about?

    eg. Last time I applied for a different visa, the wait time was 2 months when I applied, but each month it increased and eventually took 9 months to process.

    I've applied my nomination on the 21/10/2019 and My Visa on the 03/12/2019 Medicals were done on the 17/11/2019.

    The question is, the time frame (5 to 6 Months) starts from Oct or Dec?

    Also, I truly believe that the size of the company matters at the time of the nomination approval. What is your opinion on this?

    I've applied my nomination on the 21/10/2019 and My Visa on the 03/12/2019 Medicals were done on the 17/11/2019.

    The question is, the time frame (5 to 6 Months) starts from Oct or Dec?

    Also, I truly believe that the size of the company matters at the time of the nomination approval. What is your opinion on this?
