  1. Hi All,

     

    I have applied for my 187 RSMS application in May 2016 when i was on bridging visa A and because of that i was granted a BVC with Nil conditions.

    In December 2018 my nomination and visa was refused that business doesn't need a manager.

    we appealed to AAT and i was given same BVC with NIL conditions and yesterday we have lost the appeal and now going for FCC and will have to apply for another BVC.

    My question is about working rights.

    Will it come with same working rights as my previous BVC ?

    or do i need to apply for work rights separately?

    i am asking all this because i need to make arrangements at my work place by giving them enough notice if i am going to loose my work rights for some time.

    Incase i need to apply for work rights by showing financial hardship, do i need to mention about my de facto partner name as my family who is on a student visa and not capable to supporting me or should i not mention about her, Is she my family in Australia??

     

    Please please please help me by answering these couple of questions about my working rights when applying for a new BVC for my FCC for 187 RSMS application.

  2. Hey everyone. BAJWA migration consultant trying their bedt for all of yous who are banned by section 48.

    If this get waived then all of yous have a chance to apply for any visa onshore. So this is very very very important to go through.

    What i was trying to ask is, was my 2 months of taking the medication extensive? As it says i have to say yes if i was on extensive treatment?? Thats why i am confused

  4. Long story short

     i have finished my tb treatment last month and going for a health examination.

    Due to being on tb treatment and visa and financial issues i was bit worried and overthinking so 3 months ago my gp put me on ssri for my overthinking and mild anxiety.

    After i finished my treatment my anxiety disappeared completely but now i have to give my health exam and there is a question

    If i have or do i suffer from mental health??

    What should i say- yes or no?

    And do i take any medication??

     

    How will it effect my medical test??

    Anyone who has some knowledge

    Please help because i dont want to do make any mistake.

    I am trying to generate my hap id for a health declaration as i want to give my medicals before i apply for my visa(offshore) for some reasons.

    In my immi account its asking for my aadhar card(national identification from my passport country and i am living in Aus since 2009).

    I dont have Aadhar card or a voter id or pan card (never thought of making one).

    Its saying provide a reason if i dont have it and it will delay my application.

     

    can you please guide me?

     

    And if i have to provide a reason, then what would be the reason?? As its obviously my mistake as i should have made those documents when i visited back home in 2014.

    almost 18 months waiting they open the business appeal last September. I sign in on this forum because when I got my nomination refusal and appealed  I used to read all of the comment and question here. 

    So you applied for aat in july 2018.

    And the case opened in december 2019????

     

    Sorry i am not understanding.

    They just check the business when they open the case.  I am from VIC so luckily we  my exp meet the new visa requirements so I applied for new visa witch is the TSS as a chef MLTS  the reason we appeal is we dont have any choice its like do or die for us coz we apply 187 direct entry way back then there is no need for a exp but when they change the new visa rule and our visa is refuse we dont have a choice but to appeal to buy some time to complete the 2 years exp their asking its been a hell of a ride and sleepless night for almost 2 years but we made it when you appeal you cannot apply on shore so we go home and apply offshore but before we go home we make sure all of our papers is on our lawyer then we go back to AUS and they just ask for my police clearance because the AFP miss spell my surname but when I send my police clearance after a day I got my Nomination approve can work till 2020- 2024 after a year  can apply for another 187 so our PR will be faster instead of  finishing the another 3 more years.

    When was your case opened?? After how many months of applying for AAT? And what made you to sign up for this forum if you have got a new visa bro/sis??

    We appealed on july 2018 and we haven't hear anything yet from them but unfortunately the business is close so the ATT found it out and said that the business is close so their is no reason for a  review and on this matter they send a refund form on our agent. if you applied oversea unfortunately you dont have a right to appeal. I rather withdraw it so you wont have a record on them it will be hard to apply for new visa when u have a record  

    How and when did they find out? Did anyone report them or when they opened the case? And which state?

    I was on 457 and applied for 187 but the nomination was refused on 2 May 18 and subsequently the visa on 12 Jun 18. The reason was the immigration deemed the sponsor will not able to pay my salary for the next 2 years.

    I contested the decision by appealing to AAT.

    Appealed both for nomination and visa on 29 Jun 18.

    Now that I have been terminated last Friday and my 457 visa has already expired and I am not on bridging visa until decision of the appeal is finalized.

    My ex employer will notify the immigration that my employment has ceased - however I can delay this since the regulation says that the employer must notify the immigration 28 days after the termination has been handed down to the employee.

    1. Will my AAT application circumstances changed as in no longer valid?

    2. Will I have 35 days or 28 days after my visa (only if) is cancelled?

    3. What would be the option for me to stay in Australia?

    I know that I should consult this to migration agents, but I'd like to see every little possibilities that I have. So it'd be appreciated if you can share your experience or knowledge.

      

     

    Kindly let me know about what happens in this situation with AAT after consulting with your migration agents because as far as i am aware AAT and Immi both are seperate and immi has nothing to do with AAT.

    Also let me know what your migration agent says as everyone say different things.

    I am in same situation where i really need to 6 months more to leave as i am currently on TB treatment and want to cure this bfr i leave.

    But you should definitely speak with a registered migration agent - most will do consultations over the phone/skype or via email so you don't need them to be located in the same city as you.

    Thank you for your reply. I also looked into it but one of the condition says that the applicant must not be a threat to public health and TB is a threat to public health. I have contacted few migration agent via email but no one has responded yet and my anxiety is killing me.

  13. Hi everyone, kindly help as i am in a very tough phase of my life.


    My name is karan and I live in Brisbane. I am currently on bridging visa c which was originally granted to me when I applied for RSMS on bridging visa a in may 2016.


    My nomination got refused in july 2018 and I applied for aat in August 2018.


    I am still waiting for my AAT review from last 12 months but now the employer wants to close the business as he wants to get out of all this. So how long i can stay on this aat bfr they open the case and if i want to then how can i postpone the review because


    2 weeks ago i have been diagnosed with active tb.


    Tb clinic has started the treatment and they said that it has to be continue everyday without missing a single dose.


    So far i go everyday in their clinic to take the meds.


    As tb treatment is very strict


    Everyday upto 9 months and i cant miss the treatment not even for a single day as it can make the treatment complicated.


    Tb clinic told me that i cant fly or leave australia either if i am planning to and i am already on a bridging visa c for AAT after the refusal of 187 RSMS which can expire anytime if they give negative decision as i am very scared about my health.


    TB clinic have also notified the department.


    So now i want to find out if i am eligible to apply for any visa to finish off my treatment if my bridging visa gets cancelled or immi will wait for my treatment to finish even though AAT takes the decision?


    Tb clinic told me that my visa wont get cancelled as i am on tb treatment but i dont want to take any risk as i want to finish my treatment here in Austalia at any cost.


    Please find me some answers as its really been a stressful time for me.


    Or find me some other option so i can please complete my treatment without breaching any law or visa conditions.
