    Yeah when AAT first opened our case they requested documents and then came back to us with a hearing date. So I went back with extra documentation and they called and cancelled the hearing the day before and said they have enough evidence to make a decision.

    I don’t know why your application was rejected in the first place but for me they said the position wasn’t genuine and it wasn’t needed. I submitted everything I could think of. Supporting Letters from the company/employees/proof salary payments and superannuation/supporting letter / stat decs from company accountant and payroll / I wrote a 4 page letter breaking down my role, my involvement with the running of the business/interactions with other staff memebers and how it was vital to the company and having to leave would have a detrimental effect on the business runnings and operations. I attached extra evidence of my work (emails/signed documents/agreements/contracts etc). I sent photos of work parties/work meetings/Christmas parties etc. 

    Some of it was double up but I sent it anyway.

    When received my hearing date, I submitted extra evidence and they cancelled my hearing and granted the nomination. Worth a try!

    That was the case for me. I submitted additional documentation (everything I could think of to support my case) and the case officer called the day before my hearing and said they had enough evidence and the hearing was cancelled. My nomination was approved.

    AAT requested documents in August 2022 as well. We submitted them in August and then they contacted us in November 2022 and requested a hearing and some additional evidence. I sent additional evidence in (two lovely people from this group recommended doing so) and they cancelled my hearing 🥹 and approved the nomination this week. 

    You should hear back any day now!

    You can extend the visa by applying on federal after AAT, which may extend for another year or two while you’re thinking of other ways

    Thanks however I’m in sydney and so is my employer al I don’t believe I can apply to any of the above visas 🥲

    I’m trying to remand positive however I like to know all my options just in case. 
     

    I just can’t believe they only give you 35 days to leave. After 10 years I don’t think I could even pack up my life up in 35 days.

  6. Hi guys,

    just wondering if someone can offer me some advice. My nomination was rejected in July 2019 followed by my visa in September 2019. Both parts appealed to AAT. I have remained on a bridging visa for the last three years. 
     

    AAT finally opened my case and requested further information - submitted in august 2022. I’ve just received a notification that they have requested a hearing 22nd December (nice little Christmas present).

    now my question is - should they refuse the nomination/visa, or states online I would have 35 days to leave the country. Can this be extended? Would I be able to apply for another bridging visa to give me more time to leave? 
     

    I’ve been in Australia for 10 years, like I don’t think I could pack my life up in 35 days especially with a 6 month old baby in tow. They say to be prepared to leave but I don’t think that’s possible. I have a life here, work, lease, belongings. 
     

    Im not trying to be negative, just trying to be realistic and make sure I know all my options. I’m sick of fighting so should the AAT agree with the refusal. I’m not going to fight it anymore. I just can’t believe they only give you 35 days so I’m hoping this can be extended.

  7. Hi @hussft,

    I spoke to my migration agent today as my 457 visa expires tomorrow and I will need a BVB as I’m going overseas for a month in August. 

    He advised that a 186 PR can be granted on or off shore. Should my nomination or application be rejected whilst I’m overseas then my bridging visa A will remain active for  35 days from the date of refusal. He did say I still had to abide by the terms of the BVB and return when I say I will.

    Sorry @jackgu310 this is not always the case. There are many cases when the 2 applications are approved months apart, in fact - there are many cases where the nomination is approved and then additional documents are requested for the visa. 
    - They are 2 completely separate applications. 

    So @Hex do you see this often then? Similar cases to mine where the persons nomination and visa are being looked at at the same time? Further information was requested for both. 

    I was hoping because of this, they may approve both at the same time as all further information has been submitted. Then again im aware there are no set rules. As i previously stated i was  just seeing if anyone else in a similar position as myself as its seems to be rare.

    @hongkoknger - only your employer/ migration agent will have access to this information so you will have to check them.

  10. @jackgu310 Wow finally someone else in the same boat. Honestly I thought I was the only one and started to get nervous. My nomination additional docs where submitted 28th May and assitonal visa docs 21st June - nothing since which is fine (killing me inside) however others have waited far longer so not going to sit here complaining. i was just interested to see if anyone else was in the same position as me. Please keep me posted on your outcome. 😀

    Silent reader here! 

    I have been monitoring this forum daily for some while and it appears that I seem to be the exception to the rule (although what exactly is the rule 🤔)  in regards to the fact that Immi requested further information regarding my visa application before my nomination has been approved. 

    It seems to be very common that people's nomination are approved before their visa app is even looked at. 

    As you can see from my timeline - my nomination and visa were both opened/assessed  a day a part. However I seem to have two case officers not one (lucky me) and two different teams looking at my whole file (although i am not too sure what the teams actually represent).

    I was asked to provided further information for both nomination and visa which has been submitted however both are still pending- no final outcome for either at this stage.

    Has anyone been in a similar situation as all i can see if anyone in the 'further assessment' stage, their nomination has already been approved?

    I am remaining positive that they didn't make me spend more $$$ on additional info for my visa just to reject my nomination haha and that it means I will get a Yes or No answer rather than getting one approved and then having to wait for the other.

    I am just curious really.
