    Hi SamuelL,

this February 2019 we provided BAS activity statement + letter from employer accountat and most recent P&L hoping to hear from tribunal soon but nothing has happened yet.

Do you know if after the PR will be granted I will still need to keep working for the same employer for 2 more years after the grant date?

It seems a bit unreasonable as I basicallyalteady worked these 2 years already, it feels like a new modern slavery system.

    Cheers

In general, yes you have to keep working for the same employer for 2 more years after grant, that count down starts from after the pr is grant, no matter how long you have waited for and worked there before grant.

But, as previously posts some people suggest that after you got your pr, they won't usually do anything about it even if you leave the company within less than 2 years, unless the company reports you and proves that you had no intention to work there for 2 years and gave false information when you were applying for your pr, then they might do something about it.

    Hi guys,

I hope you are all well.

I am just reaching out to see how many applicants have been treated unfairly by the Department of Home Affairs.

My case is pretty simple, I have been working full time for a company on a 457 visa for two years after my employer lodged a nomination for TRT 186 Visa and I have applied for the visa.

The nomination was quickly refused by the Department of Home Affairs for the financial viability of the business without requesting any additional documents to prove otherwise.

We lodged an appeal thru the AAT, almost two years have passed now and we don't have any news but I am still working at the same job with the same employer.

Is anyone in the same situation?

Thanks in advance for reading 🙂

They refused the nomination based on the financial viability of the business, but the fact that the business is still running and you are still working there and getting paid for almost 2 years now have already proven they were wrong, btw did you provide more documents to prove the financial viability when you lodge appeal?  Truely hope you can win this.

    Hi all,

after 22 months I got some bad news. Refused nomination.

the reason does not make sense at all and its totally unexpected. They refused because the previous sponsored restaurant manager left quickly after getting his PR and after that I was not sponsored until about 8 months later. Because of this gap they say there is no need for a restaurant manager. This is a big mistake because in those 8 months someone internally took over the role, however, unsuccessfuly and so they advertised later on the role and took me in. Unfortunately they did not ask to explain this situation and refused straight away (well after 22 months ). And we never expected that this was a problem anyway? Isnt it the point to actually first try to give the role to residents/australians?

I am a genuine applicant and this is such a stupid reason. When i saw refusals on here I always thought there must be something dodgy about their application and it would never happen to me.

Advice: How genuine your application is, dont take for granted that you get your PR. Especially in DE. I believe if they want to refuse it, they will find a way. Even tho this reason is stupid, the current system doesnt allow you to comment until 2/3 years later. Its unfair, but within the law so nothing I can do about it.

" the previous sponsored restaurant manager left quickly after getting his PR " This sounds more like the main reason for refusal, it's not about you, your application can be very genuine, but because of the previous sponsored person left quickly after getting his PR, that makes a very bad reputation to the restauant, almost like giving an idea to the immi that the last sponsor was not a genuine sponsor.  I think if you can provide very strong evidences to proof that the restaurant very needs you and you definitely will work for at least 2 years after PR, then they may consider, but I think it will be very hard.

You can, within 6 months, if applying within the same stream. But, you cannot if applying for stream. TRT nomination for TRT visa. DE nomination for DE visa.

ic, just thought may be you could save some time,  anyway your company got DE nomination approved before, TRT nomination should not be an issue, good luck to you mate!

Hi All.  I am back !!  I just re-applied my 186 with TRT stream. My previous 186 - DE got refused in Feb- 19.

The last few months were a rollercoaster of a difficult ride. But I came out strong and decided to reapply.

God is kind and works in mysterious ways, so here I am.

Good luck to all of you who are in a similar boat as mine. Good luck to all of us who are waiting. Please keep me in your prayers too.

One thing I would like to mention here : People who are anxious about the processing times, Guys please be patient !  Some people are in priority occupation list, so there application gets processed faster. For rest of us, it takes longer ! But right on processing time. They get processed by the end of the mentioned time frame given in the department website. Mostly never longer than that, unless there has been an issue with the application or the employer.

This I say, with my personal experience and mostly from what I have seen with others.

Also if any one has included adult dependant child over 20 in their application and had no issues, please let me know.

    Thanks for reading.

    CHEERS

    🙏

Just wondering, can you just use the approved nomination to re-apply 186 trt?
