Hello Everyone,
I have a confusion regarding my direct stream visa 186. I got visa last year. I haven't spend 2 years with the company.I applied for visa with one company abn and got visa and now working with different company name with different abn for the same company. Even my role is changed in new contract now. So, I wonder if I leave the company now do i get problems in visa or not.
For 186 direct stream there is no visa condition that stated saying employee have to work at least 2 years for the company after visa grant.
Is this rule madeonly verbally and can we leave company if we want.
Since, the company name and my role is changed that I am not happy about so Can i leave company and if in case anything happen can I win the case under these circumstances or not.
Please suggest and share your experiences for this case.

I wonder why they would give false information.I told them i just got PR in july but still they said I am eligible.May be 2 years waiting period for new immigrants is vague in itself and we didn't understand the actual meaning or it might be different under what subclass we got the visa.
Anyway as you said we can just try and wait for their response.

I am facing same situation . I got PR in july and my parental leave will start from march.When I called centrelink regarding 2 years waiting period I got answer that I dont have to wait 2 years.
I am eligible for the parental leave.
Did anyone contacted central link regarding this matter and got same answer or not please update.

Doc was request on 13 may we submitted on 22 may and recieved pr on 1st july 2019

yes, at last they ask if i need licensing or not.I provided them letter from employer stating I don't need licensing and provide source as TBP board.

Can you please tell the under what occupation did you apply visa.If it is related to accountant and tax accountant you need a letter from employer stating you dont need licensing and provide source like for tax accountant TPB is the source and other.

Yes,during election everyone got visa in my company i was stuck because they ask for additional documents and now no news.Election is over so now wait is longer.

For a large company I would presume they can handle multiple accountants; management and tax/compliance accountants.It is possible to be a tax accountant/employee of a company but carefully thread on your job description so as not to confuse services which a tax practitioner normally does (requiring TPB registration) or as a management accountant which may be more applicable on your overall accounting work.
Sorry I used to work with a migration agency and quite familiar with many visa applications got rejected due to wrong application of occupation code thats why I was particular on your job and the ANZSCO job descption. But then again if you have your MA, they should have carefully used the correct ANZSCO code which really corresponds on your current work.

Its a million dollar company with 200 staffs and various branches and we have in house accountant ,tax accountant and other people to do accounting job.Don't you think it is possible.My friend already got PR as accountant from this company and I am in line.

I really hope the letter i provided to them works.My employer is not tax agent.It a normal company hope it doesn't make difference.Thank you for your help.

ANSZCO states that registration/licensing "may be" required. As Tax Accountant, you need to have registration if you represent your client as a "registered tax agent" to the ATO.
However, you can provide tax (financial) service as an employee representative (using your employer license) with limitations, while your employer is responsible in supervising your work and ensuring compliance with their licence and registration obligations.
A supporting letter from employer stating you do not need to get any registration with TPB should somehow show proof. In my case, I argued in my letter all relevant legislation and regulations for accountants and my employer concurred with what I said.

Thank you for the information.I just got simple letter saying i don't need licensing and attached tbp board website info.My letter is very brief.What do you think will that work.By the way did you get your visa or still waiting.Did you apply same as mine taxation accountant or just accountant.

I got nomination approved on 2nd april 2019 and still waiting.All we can do is wait till status change to finalized.All the best to everyone who is waiting.

Is there genuinely a pattern of higher priority job types being worked more urgently....or is this an attempt to lower overall timeframe statistics by working newly received applications quickly? Cynical I know but I've seen this sort of stats fudging before elsewhere.
I am facing the same situation.In my opinion once they ask for additional documents then it will take time to reopen the file. There is no system of clearing old files now there are looking into 2019 files instead of 2018.

I check with my MA.They said they are also not expert.I got letter from employer saying I don't need license to work in the nominated position and submitted that.Hope it will work.I am so scared now.

457 Newly arrived resident wait period for parental leave

They consider us newly arrived resident until we pass 2 years of visa grant period.I had similar case and my parental leave was refused based on 2 years waiting period.
you can apply family tax benefit A so at least you can get something rather than nothing.
