I was devastated by the news when i got it as I work at a quiet busy cafe more than 3 years with all my energy even during the covid 19 i kept it open for takeaway and home delivery option and made enough profit to survive during the worst time.so I am hundred percent legit cafe manager did not deserve this. I came across this job through online ad by given one of the ex business partner.  

The cafe was previously owned by 3 people who have another restaurants in the city and one of the their guy filled up my application and signed it when we applied the visa in 2017. During the sponsorship 2018 the business has changed the business partners but kept the ABN same for my sponsorship reason as the new business partners do not have a great experience in a very busy cafe they decided to keep the ABN for my sponsorship. Since 2017 , the profit has gone up to nearly triple under my management as i used to work in very busy cafe in sydney and melbourne for about 5 years before this job so i can understand the cafe`s needs well.

 

My question was that nomination was refused with the supervising reasons but the visa refused with application was made by applicant reason. The application was made by immigration agents and signed by one of their general manager who looks after all the other 3 venues and hired me for this cafe. 

 

i started to prepare a great evidence for my nomination reason but i do not know about the visa reasons as did not make the application so is there anyone who can give me their thoughts about this?

I think u should not focus on the reason for refusal of visa but you should focus on the reason for nomination. 

Nomination is primary. Like you mentioned the profits have gone triple under your management. You need to provide them evidence of last three years comparison of profits chart. You  also need to prepare a clear organisation chart where it can be seen how many staff are you managing ?

Also if the cafe has three partners. It means you have three bosses. Immigration wants to know why 3 owners need a manager on top ? You need to explain what other businesses they are managing and they can't work in these cafe. 

Lots of supporting documents needed payslips, other business documents for all the other partners like BAS etc

Once you get the nomination then you can prepare about visa reasons. I hope this helps

This is not 187 visa related but my employer is looking for chef/cook who has good experience with Indian Cooking to sponsor on 491 visa. if there is any suitable candidate on this forum or u can refer to any of your friend and relative.

processing time is same for everyone. Times of lodgement does not affect the processing time.

Visa file opened on 4 July and required pte score and spouse English certificate

My agent submitted  on 31 July and I got visa 7 August, I am in australia for last 13 years , I did too much struggle to get permanent believe me, my both kids are overseas ,you can not imagine how I am happy to see them.

Good luck guys who are waiting for this golden time

It is an independent grocery store with 1 casual and 5 permanent part time employees excluding me. Nomination grant Thursday and visa Saturday.

In 2017 one of the stuffs in my working place sue my boss to the fair work,because unfair dismissal and under payment. My boss got penalty. In 01/03/2019,my boss received a bar from the immigration. The lawyer named Jason answered my phone and analyzed my case in 16/03/2019 and said I have a big chance to win my case,they sign a contract with me.  I paid them $7800 including gst. And the lawyer team did submission about the bar to the immigration and take carriage with my case and told the immigration I have changed to this agent. In May,I didn’t get any news from immigration and worried a lot. So I asked my lawyer team if they can write a complaint to the immigration. The lawyer team replied me that because this is an additional instructions and I need to pay $1000 (plus Gst). I think it’s really unfair for me and argue with me. I signed the contract said they will help me with case and this is a part of my case. I didn’t pay them any more money and I wrote the complaint to the immigration by myself. The lawyer team said my case is very urgent and they said they helped me a lot so that’s why charge so much for me. But the immigration refused the nomination because my boss bad record. The fact proved that what  my lawyer did does not work at all. Before this,I asked my lawyer if my case fail,do you refund me? They said if it is their fault yes,if not no. After I received the refusal letter from immigration and asked the lawyer team if they can return part is my fee,they said they don’t pay the result fee. I showed them the screenshots to show that they promised me before if it is their fault they will refund me. 

Today this morning they replied me and said ‘We will be informing the Department of Home Affairs that we can no longer act for you. I trust that 7 days will be adequate time for you to seek a different lawyer.’ 

I don’t want to look for any agents now. But I don’t know how I can let the immigration know my situation and contact me directly. 

Can anybody help me to figure out what I can do. I will really appreciate it is you can give me some suggestions. Thank you very much for everyone.

Sorry to hear your story. Don't keep your hopes up with your visa unless you find a new employer who can sponsor you before this 187 abolishes only if you have 3years of experience at present in your nominated occupation but I think it will be more tough for you as you had spend a lot of money already.

First you should have withdrawn your visa the moment you came to know about your employer bar. Secondly doesn't matter who the lawyer is no one can challenge immigration from the bar that was imposed on your employer. Your new agent has absolutely misguided you. They definitely knew your nomination will be refused one day. Jason knew you being innocent and a good opportunity for him to fetch money within 5months from you. I will suggest you to write a review on their website to make others aware about the fraud lawyer like Jason who believes in making money fast.

You can write a letter and explain your situation to DIBP but DIBP will not consider your case anymore as whatever happened its between you and your employer. Immi has no role to play in it but just before giving up try writing them a letter and explain you were no where at fault. 

One of my friend's friend got refusal for the same reason as well. He is working now for a new employer after refusal and trying for sponsorship from him. So all the best for your future. I am really sorry for what happened with you. Please don't rush while hiring a agent again.

OMG! You had waited a lot. Hopefully they open your file soon as most cooks cases are looked these days. By the way where does it says 22months processing time ?

I've seen Restaurant Managers / Retail Managers get their visa Dec-Feb, the Mar-May there were lots of Child care related occupations that got their visa's and now it's Cooks/Chef may be they will be lots more till August...of course this is just my observation...I could be wrong

Retail manager in Petrol station but with Independent company and its huge company with good turnover even my petrol station include grocery, liquor, post and restaurant. One person already got rsms visa as retail manager in 2015 from same company. My owner doesn't work here as he owns 20 another petrol station even he is living in city.

Hi do u have any information about how much taxes your business is paying annually and also who is paying for all the invoices of the business? 

Does the person sponsored earlier worked for 2 years ? If he had left earlier that might be a reason of refusal.

If your employer holds 20 another sites with same ABN its very surprising for me .

Oh my God! That's really sad HARP . What is your timeline? I can help you only if I know a bit more about the business like are u working there ? When did you lodged your application ?

Is it franchise or independent ? service station/grocery store ? Turnover , no. of employees etc

Winning in AAT depends upon how genuine your position is.

You cannot create HAP ID . MA forwards a medical examination letter that she receives from department while lodging your application. You should take this letter to BUPA while booking your test. So, ask your MA for this letter.
