  1. Hi All,

Just received email from my MA that our visas have been approved.

Checked my immi account after that and found status as Finalised.

I am really thankful to all the group friends for the information and advise.

    This community is really great.

Hope everyone will get theirs soon.

I would suggest stop over thinking all these new announcements - no one here knows a clear answer and all just based on speculation.  If we worry about all this we will seriously go crazy!

I completely agree with you...enjoy life

I would argue that the majority of Grandfathering roles now exist on the STSOL list, and not the MLTSSL - and we have reports that occupations on this list will be processed faster, as well as seeing people on this forum having their VISA's processed faster, not in all cases albeit.

Just found MLTSSL revised  on 11/03/2019 at https://www.legislation.gov.au/Details/F2019L00275

    My occupation is still there.

The ‘Grandfathering’ permits certain 457 visa holders who were granted their 457 visa on or before 18 April 2017 to apply under the current requirements for a ENS 186 TRT.

If you held, or had applied for, a Subclass 457 visa on 18 April 2017, you will be able to take advantage of existing TRT stream provisions:

    • Occupation requirements will remain the same (ie there are no restrictions as long as you continue to work in the same position for the same employer as approved for your visa);
    • The age requirement will remain at less than 50 years of age; and
    • The work experience requirement (ie. the requirement to have worked in your occupation at least two out of the three years prior to nomination on a Subclass 457) will remain at two years.

    Source: http://www.abacusvisa.com.au/news-flash/grandfathering-provisions-announced-for-certain-457-visa-holders

So basically, if you were granted a 457 VISA after 18th April 2017, you would not be eligible to apply for the 186 TRT under the new conditions, however if you held before, the Grandfathering provisions allow for this.

I have applied under the grandfathering provisions.

    Does grandfathering takes more time?

I applied in November 2018 under the new SAF levy scheme and saw some grants in this group for November, Dec-2018.

Wondering if mine is on the way or will take sometime due to grandfathering.

Hello everyone - just an update to keep you all up-to date with one of the hardest weeks of my life.

My PR has just been granted 🙂🙂🙂 Woah I cant even believe it and I'm literally shaking.

The decision to refuse nomination was overturned and my Visa was granted today 🍾

I will post again soon to explain the exact process and what went on since my nomination was refused - once I find the time to detail it all as was a complicated case.

Put it this way, my MA agent was unbelievable and I owe them so much.

Its crazy, I've went to feeling so down to so high in a matter of weeks.

I will post again soon detailing the whole timeline and what exactly happened....for now, I'm going to celebrate 🎉

This is a miracle........ and blessings of this group..

    Congratulations...

Hi ksttt - My nationality is Indian as well, however, I am based in the UAE. But I was asked to get my PCC cleared from India. For this, I first got my PCC from UAE, took about 3 days), on the back of which I got my PCC from India, which took about 3 months! Since your sign-off mentions India I would think the same would apply to you?

    Hi @Hydra

I have attached with my application the PCCs from Australia, India and UAE i.e. all the counties where I lived for more than 12 months in the last 10 years.

    Hi Ksttt,

this is based on my experience. my partner also had  police  check uploaded from UAE (Dubai to be specific) we applied for his police clearance in April 2018. It arrived 3 months later around July 2018 (3 months validity)and uploaded in our immi files.

a CO was assigned to our case this January 2019. He did not request for UAE police clearance anymore and considered the one we submitted in July.

again this maybe a case by case basis. I did ask our MA in January when our file was still received if we need to start reprocessing police clearances as they were due to expire/expired but she said to wait until it is requested by CO.

    Hope this helps.

Thanks a lot for your reply, this gave me a real example.

    Really this group is amazing.

    @Andytomas

Typically, all police clearance are valid for 12 months.

There are however, some countries that are valid for only 6 months. If you are not sure, it's like 12 months.

     @Hex,

My Police clearance from UAE was issued in October with a validity of just 3 months which has already been passed, should I submit a new one now to make my application decision ready or just wait for the CO to request it.

Sad news this morning - my nomination was refused 😟

I'm awaiting a meeting with my MA to find out the reason why - once I know I will share it on here.

My application was more complicated than most and I sort of had this in the back of my mind this could happen but hey life goes on. I wasn't actually as upset as I thought I would have been.

Still currently on my 457 so no need to make any urgent decisions at the moment however at first thought - I don't think I will appeal. I see it can take another 12-18 months for your appeal to be heard and to be honest I don't think I can put our life on hold for that amount of time again. My wife wants to start a family and I don't feel comfortable doing that whilst sitting on a bridging visa awaiting the possible outcome - no matter how strong my case may be.

So it looks like my journey in Australia has come to an end - I have so many great memories here and I wouldn't change them for the world. I believe in life, things that are meant to be are meant to be and I guess its just our destiny to be back home. Although they wont say it, both my Wife and my parents will be over the moon I bet - they really struggled with the thought of us having a family out here alone.

Good luck to everyone on here - the forum has helped me through the process and its an awesome community that you all should be proud of.

I probably will take a step back from the forum now and I doubt I will post much more - just need to start planning the move back to the UK. My company has offices back home so I'm currently looking into an internal transfer.

    Farewell and God Bless 🍀

I’m sorry to hear such terrible news @boo-yaa

Good luck for all your future plans. For sure there is something better for you.

This forum will really miss you and your guidance.

TRT stream - we just paid for the SAF levy. There is no need to upload any training evidence unless immigration request it. However they made it very clear that the SAF was replacing the training benchmarks. It would be highly unlikely that they request evidence of previous training expenditure.

You paid the SAF levy or your employer? I believe SAF levy has to be paid by the employer.

Hi everyone, I received my grant today... so so so happy.....

I applied in 186 direct entry in June 2017. Nothing happened till 2019. They called my employer and confirmed few details in Jan. After that they approved nomination. They asked for medicals and updated police certificates because I lived in UK for few years. Submitted everything on 30Jan. Today I received grant email. I am on the moon right now....

Everyone here is a great support. Thanks to all of you. I hope everyone of you received grant soon.....

    My occupation is: Marketing Specialist

Congratulations...hope everyone in the group receives his approval soon.
