Sorry to hear about your Refusal. Immigration is treating every application as Forge and refusing it without requesting further documents.

But if your case is genuine, if your RCB was approved and you have been working for the employer, I would suggest you to go for AAT with a good agent. Because you don’t have much time left to decide or apply for any other visa. After applying for AAT, you can work on your Nomination File with your Current Agent or New Agent. You will easily have minimum of 12 months to prepare your documents for this Nomination or any other visa options.

But saying that, if your NOMINATION is Refused, your Visa also will be refused in few weeks. If your visa get refused, you will not be able to apply for another type of Visa ON-shore. You will definitely have to exit the country and wait for a decision.

According to my knowledge and experience you have only one option, apply for AAT straightaway, but your employer has to support your 200% throughout the process.

let me know if you need any help, I’ll try my best.

    cheers

Thanks 🙏 for replying really appreciate

my rcb got approved employer will support me 300% I been working from last 2 years

    just few concerns

if I apply AAT for nomination refusal my visa file will also get refuse

if yes How long AAT processing time will be

can I wait overseas for AAT decision or I have to keep working for same position until not get decision

    thanks

  3. Hi guys I need solution

i applied retail manager from nsw in aug 2017 at 24hrs service station.

On 16/05/19 my nomination got refused.

i am on BVE with full work right and no travel. Problem is my family is overseas and I didn’t met with them since I applied

l also applied their tourist visa 3 time but got refused because they are added in my 187 file.

Now what the best I can do should I go for AAT or find another ways.

    thanks

    Hi Kedrick

Very sorry to hear this. Even if owner does work in the business, business still needs a manager. It entirely depends upon the turnover of the business. They should check the turnover, profits . You mentioned that you applied offshore then how come you are working there from last 2 years or am I mistaken to understand anything ?

Because I am on BVE with full work rights

and previously I went overseas on BVb than applied 187 and come back

  5. Its very strange reason I been working as a retail manager from last 2 years today immigration called to business and my owner was here to visit and check financials so he answer the call that why immigration said if owner work there then there is no need for manager now how I can challenge this???

Bryant, you don't need to worry...under certain circumstances like the company shutting down or you being terminated by your employer does not affect your visa. You can work for another organisation as long as you stay in the nominated regional state (in your case QLD) however if you can't find employment in that state and find employment in any other state you will need to write to the DoHA and explain why you need to leave QLD otherwise you don't need to inform immigration at all.

What if the owner sell the business to another company and they don’t want you to work

Being that your family menbers are included in your application, it would be very difficult for them to meet the genuine temporary entrant (GTE) requirement which is attached to all temporary visas. In other words it would be too difficult to convince immi that they would return after visiting you. You may want to talk to a migration lawyer but they will most likely tell you the same thing.

    Thanks for your suggestions
