  1. Hello guys,

    i’m having the test this Saturday. But i’m confused with my driver license now since i went to the bank and the staff there said my name on the license is wrong as it doesn’t have my middle name in there. I’ve been using it for years with no problems.

    does anyone knows if the Victoria license will show middle name or not?

    my name is 4 words ( 3 words middle name and 1 word surname) and the license only shows first name (1 words) and sure name. All of my other documents such as bank statements, passport, visa, etc are show all 4 words name

  2. Read really carefully the section S137Q. The conditions that might lead to visa cancellation in their say “AND” not “ OR”. 


    it’s not that easy like: ok, you didn’t complete 2 years, then we’ll kick you out of Australia.
    You still need to prove that you’ve made the genuine effort for the business and it said  “in the case of termination, the period of the visa holder's employment with the employer prior to termination of the employment (generally, periods of more than 12 months may be considered as a genuine effort) “

    And we can all see that your employer have done the wrong things when they don’t put you on jobkeeper.

    my agents said it’s hard to prove the jobs wasn’t genuine if you’ve worked more than 1 year.

The salary slips gives u all the details of Annual leave earned, superannuation,  no. of hours worked,  sick or personal leave to date , plenty of things. Also gives u how much earned in till now for the year.  Also it gives u details of It tax deducted.

     

    That's totally weird to me. Bit suspicious.

    I do have payslips and it shows everything you guys said, except any information about leaves.

    these payslips were the same with the one I submitted to CO when they requested. 

    the fairwork gave me a call back and said my employer is doing it wrong, and they can’t change me to casual without notice. Also my hourly rate at the moment, it’s underpaid for both full time and casual. 
     

    I decided i’ll talk to my employer about this.

    Yes, on the letter of offer, there’re my signature and the employer’s signature.

    I did give fairwork and Doha a call.
    Doha gave me a weird answer that: even they’re doing the wrong things & illegally, i still have to finish 2 years in order to not get the visa cancellation.

    the fair work: they’re quite confused and don’t know what to do, so they told me a person from higher position will contact me regarding the situation.

    My agent who has done 187 for me: i did pay them but since i had the visa, they don’t want to talk or doing anything else. They’re like their job is done and don’t want to give free advice.

    Actually, i found a letter of offer for my job. And it said: permanent full time. It’s not a contract, only a 1 side A4 with few words like the starting dates, the starting hourly rate,name.

    cause when i asked them about annual leave, sick leave, they said i’m casual so don’t have any. Does this mean they lied to me or trying not to pay me leaves?

    I really have no ideas. My agent didn’t tell me anything about employer’s documents when they submitted on behalf of them, the agent contacted them directly.

    My visa was granted quite smooth and early than I expected as well

    I didn’t sign any contract from the beginning. As i texted the employer yesterday then they replied that i’m casual. 
    So, between me and employer, there’re none contract or even a piece of paper say anything about job roles.

  8. Hello guys,

    I’ve been holding 187 for 11 months. And just found out i’m casual employee for the whole time as i asked my employer about annual leaves, then they said i’m casual so don’t have any leaves. 
    Therefore, i did few searches on Fairwork about wages for casual employees and turned out i’m underpaid for nearly 3 years (total time i’ve been working). As casual will get pay higher than full time, part time for not having any leaves. With a bit of calculating, they are now owning me aprox $20k 🤦🏻‍♀️

    Can this be a reason for me to quit the job?

    I saw someone commented in the 187 visa topic regarding the same situation like you, they gave the department a call and got answers that you can find a job anywhere as the covid19 is out of their hand and the visa won’t be affected.
    Maybe you can give them a call and see what will they say. They won’t ask any personal information

    Your background is exactly same as me, i’ve been working for 3.5yrs but only 1yr after PR. I want to leave just because it takes me 1hr1mins to drive (110km) and the wages is not worth it.

     

    I talked to my agent and she said i just can leave especially during the covid 19 situation. She said leaving after 1 year with 187 is fine and i can move back to Melbourne. Also, the covid 19 has affected so many business and lots of 187 employees has been lacked of, the department cannot do anything about this. She also said, if the employer report you and unfortunately we all have to go to court, it’s very hard to prove that the job isn’t genuine ( cause we’ve been working for longtime) or lead to the cancellation of visa.

    i’ve been working for my sponsor company 2 years 3 months in total but only 7 months after PR granted. And now, i want to take 6 weeks holiday to go overseas on November this year but employers not approve it. Can i just go even though they don’t approve it? The employers dont provide Annual leaves for all staffs as well. 
     

    Did anyone quit the job before 2 years end? My agent who have done my 187 and another agent who have done my 143, both said they’ve never seen someone get visa cancel after quitting the sponsor early.

    It showed “further assessment” after I submitted s56. Before that was “initial assessment”. And “finalised” when visa is granted. 

    But i’ve seen many cases on this forum that the status can change straight from “recieved” to “finalised” or from “initial assessment” to “finalised”. So, maybe the status is not really a big deal for us. 

  13. My visa is granted todayyyyy 🎉🎉 2 weeks after s56 submitted. There’s no words to describe my feeling now. This forum has been helping me a lots ♥️

    One thing that made me surprise that all of my applications were proceeded quicker than I expected. Also, my bosses have put the business on sale for 9 months now so very lucky for me.

    If the visa granted, there’re no problems with your visa and do not need to lodge again. But you still need to find a job in regional area and continue to work until 2 years are complete then u’re free to go anywhere.

    If the new owner keep the ABN, there’s no problems for the application. But If they change ABN, you’ll have to lodge a whole new application & nomination and wait all over again. 

    Cause my boss have put the business on sale for 10 months now but no one have buy it yet.

    DOHA sent me this when they required me to release pte score 3 weeks ago. This is how you send score to them.

    Also, in my case, i’ve sent score to them at the time I lodged application but they still asked for it again so it make me confused. So, i called Pte office and they told me to tell DOHA to contact them if they can’t access the score. And now i’m waiting for the outcome after submitted all s56 docs. Hopefully no problem about the pte score.

  17. I’m on the same boat with you. Most of people said nomination approved means 95% is done. But the visa could be refused if there’re some problems with health check, fake documents, got involved into criminal situations ( police check overseas and Aus) or not submit requested documents by due date. Without all of that problems, the golden email will come soon.

    I don’t want to bring bad news but here is the updates from my agent:

    For last few weeks, the refusals of nominations have been increased and will extend to more nomination applications. Most of the refusal reasons are not a genuine position without asking for further documents. It’s means CO open the case and refuse straightaway. This must be because of Immi has a limit of visas grant for each year, also this November 187 is out so they might want to leave some spaces for new applicants and get rid of those that have been waiting for years.

    I got nomination approved yesterday Monday 17/06, only 1 day after submitted required documents.

    Required documents for nomination: BAS, financial documents, payslips, PAYG, NOA, letters from accountant and boss.

    Visa opened on same day and requested: AFP, form 80, health check, release pte score.

    Occupation: cook

    state: vic

    visa, rcb, nomination: December 2017
