Does anyone know if we have been stood down from a job ( not laid off or made redundant) . The time we spend waiting, say 6 months or so to go back to the job when it reopen for business, does this time will be counted towards our 2 year obligation? I'm confused because we haven't broken the service with our employers but at the same time not getting paid ( unpaid leave ) 😕

Hi Tien, I was in the same situation, My company got shut down all of a sudden and I lost my job. I contacted the visa officer to check my situation. I am on my RSMS-187 visa. They replied back saying my visa is not affected and I can search job in any part of Australia due to COVID-19. It depends on the situation. Please contact them.

  2. Hello everyone,

This is been a great forum. Could not login for a long time, due to stress at work. My office is going to close down and as a result I will be redundant. Although I know that my work is going to wind down, I don’t have a concrete date yet, do I have to wait for the company to shut down before looking for opportunities.

I am on my RSMS 187 visa, am now working from a regional area and its been just 7 months that I have started working here. Should I contact the department to inform the situation and seek approval before looking for other opportunities. Should I be looking for opportunities in the regional area or can I look at other cities. If I am made redundant I will be in a financial difficulty to pay bills, so one of my far relative is in Melbourne, Can I move there and look for opportunities.

    Thank you.

You are not at fault, and the company is doing the right thing by informing immigration. I wouldn’t have thought there would be any issue, you will still be working for the company. It’s all out of your control.

I don’t have any first hand experience or know anyone where this has happened, but as I say honesty is always the best policy when it comes to immigration. I really think you will be fine.

Thanks Wondering aloud. I have asked the HR to talk to IMMI and let me know the outcome.

I’m sorry but this is bad advice.

The whole point of the visa, and the main difference between this and the 186, is that you agree to work in the regional area with the nominated employer for 2 years. Otherwise there would be no differentiation between PR visas- but of course there is.

You must notify the department and they must be satisfied you made an effort to stay in the area and with the employer. They will probably be reasonable if your employer is transferring to another area, but not telling them, as is the advice above, is risky.

deleting since this is a duplicate

    Hi All,

Its just been a month sicne i joined the company and started to settle in the regional area. I wasnt ready for the below.

My HR manager called me today to say that they are shutting down the regional office and moving me to Melbourne which has the head office. They said they will contact IMMI to let them know about this and process the request. The business has been running under a loss for sometime and they do not have the funds to keep the regional office open as the clients have dried up.

Please let me know if you have come across any past incidents like the above and aware of resolutions. I had hoped to have complex less stay at the regional centre but now this.

    Please advise.

    Regards

Yes but he will not be working in a regional area. And no maybe not all 187’s are entirely equal based on the different ways you can attain one, but essentially the overarching obligation they ALL carry is that the nominated person agrees to:

thank you. My employer called up Immi to ask and was told that Immi reserves the right to cancel the visa if such a thing were to occur. Atleast the employer and me have clarity on this,

As I said, if you have no conditions tied to your visa you can work for any business and in any location.

In your case, as you would be staying with the sponsoring business just relocating as per their request and needs - you absolutely have nothing to worry about.

Thanks a ton MilaMocha. The business has now said they will contact immi and let me know what needs to be done.

If having to work for 2 more years with the sponsor is nowhere mentioned, you don't need to worry if/when/where the business will be moving.

Thanks as always for your reply.

What if the busines still has an office in the regional centre but is asking only me to shift to Melbourne while still retaining the regional office. Would this be an issue?

Just for my knowledge- Is getting s56 Email a good sign ?

For me i think so as it tooke me 6 weeks from the time of s56 to my grant. From the forum I see there are few whose s56 was requested and they have been waiting for a long time. I hope they start processing the applications faster.

Try logging in into your Visa Entitlement Verification Online (VEVO), this allows visa holders, employers, education providers and other organisations to check visa details and conditions.

    VEVO tells you:

    • which visa
    • the expiry date
    • the must not arrive after date
    • the period of stay (how long you can stay)
    • conditions (what you can and can't do).

Thank you for your prompt response.

There are no conditions mentioned in VEVO as well

Work entitlements  - The Visa Holder has unlimited Work Entitlements

Is it that the conditons are the ones mentioned in IMMI website that needs to be taken into consideration but not explicitly mentioned in the visa grant or VEVO.

Do you have any conditions listed on your visa, and if so- what are they?

I couldnt find conditions in the visa grant letter apart from "We have granted you a Regional Employer Nomination (subclass 187) visa".

Is there any section which is akin to condition but worded differently. Please let me know.

Can be dealt with by the same one if it's a quick decision but can to through a few it it takes longer. I heard that one CO usually gets 28 days to resolve a case, if they don't it gets transferred to a different one, who is again given 28 days.

oh oh, the musical chair. Wish they were transparent. thanks for replying.

I had another query and i think i know the answer. Can i lodge two applications and both of them being active. For example, I have applied for 187, can i lodge 186 as well?

  15. 22 hours ago, BryanM said:

I suspect that the CO who grant the nomination is the same guy who sent the s56 email, but this guy won't be the CO who assess the visa application, which means our case hasn't been assigned to the CO yet. That explains why the status hasn't change yet.

I was under the assumption that once it is picked up by an CO, it is dealt by him. We can just assume.

I've got that s56 email back on February 5th and I upload all the documents by february 20th. I also asked for a 2 vac for my partner that same day (that's a second application payment instead of seating the english  test).

    good luck.

  17. 17 hours ago, BryanM said:

I guess we have the same CO? LOL

Guess, the same with my CO. The status says received even though it has been close to 3 weeks since u uploaded the documents. Maybe the CO is on a easter holiday break.

17 hours ago, Rajat Babbar said:

Once you loged the application the status became received.

Once the case officer is appointed the status become initial assessment

Thanks for replying. Status certainly should have changed to "Initial assessment" as i received a S56 email. But does that mean that receiving doesnt necessarily mean that CO has been assigned or CO is on a holiday. Certainly confuses me, but there are few others like me who are in the same boat. 🤔

I have flipped through some of the posts in here, and noticed the status should have changed to initial assessment after CO asked for more info.

I am interested as well to know if the status should change. I had a s56 as well. anyone please advise.

My lawyer told me approval rate dropped to 17% as they are getting rid of 187 and also adviced to start looking for a new options...

do you mean that the they are slowing the approval rate? If it is, it is really scary. Hope they clear off the backlog.

Its strange that it is still showing received in your account where is after depositing the papers it should be further assessment.
Check it again brother it should be further assessment

Sorry, I had missed your post. The status shows received still. Is it different for others? Please confirm.

On another note, would it be prudent to ask my sponsoring employee to call IMMI and ask for status and mention that they require me soon. I am an offshore applicant. Please advise.
