    Do you guys know if the office that review the documents is in the same State of where you applied from or it goes to a central office?

    I think it’s a place where you applied.

    RETAIL MANAGER - South Australia 

    RCB - 07/2016

    RCB Approved - 08/2016

    Nom & Visa Applied - 09/2016

    Nom Refused - 12/2017 (as usual u all know the fake reason they gave)

    Visa Refused - 01/2018 (due to Nomination Refusal)

    Appealed at AAT Nomination 01/2018 and AAT Visa 02/2018

     

    Received an email in 03/2019 from AAT to submit for information regarding the business (my agent only know what documents, since it’s My Company Business privacy). 

    We submitted them via email to AAT on the 15/04/2019 same day NOMINATION got approved without any hearing.

    My Visa file sent back to IMMI on the 26/04/2019.

    CASE OFFICER allocated on 26/04/2019 and requested for S56, Medicals, AFP and PCC from Overseas for my wife.

    submitted them on the 9/05/2019

    and finally today I am here In front of you all as an Australian Permanent Resident.

The part that requires the employer to state a genuine need in the organisation in order to be sponsored is completely annoying and irrelevant according to me. "There is a job and you are there to fulfill the role of the requirements - simple as that and that's the reason why your being employed" I don't understand why it needs to be stated as a genuine need and how a CO can determine that there is no need for the position just by reading a few documents. Most of these cases are being refused as a money making racket.

    Can you imagine the money they are making with the number of refusals. Lastly it all depends on luck if you get a good CO they will give you some time to clarify their doubts and ask for more information but if you get a bad CO they will give you a refusal without giving you time to clarify anything even when things are as clear and transparent.

    Don’t worry bro.  there are so many people like me with you, who got 187 nomination refusal on unnecessary ground. After waiting for a year, I got refusal saying nominator could not demonstrate the need of another managerial position. So position is not genuine even though there are around 80 employees working in my company. They didn’t ask any documents. I don’t know the chances of Winning AAT because there are around 9 people before me in AAT queue from same company and the reason is same for everyone not genuine position.

    Congratulations, could you please tell me how many employees and managers working under you and what type of company is it. Is it big company or medium sized company.

    Supporting documents were sent in May.

    Still waiting for RCB approval...  my lawyer said its normal as Ballarat takes up to 6 months for RCB to be approved.

     

    Anyone has similar situation?

    I also applied March 2018, RCB approved within 2 months but they asked too many questions about position and business
