  1. Dear all,

    I had a call from my migrant agent today telling me that a case officer has been allocated to my file. It happened in the afternoon as in the morning the status of my visa was still as "received". After the call, I checked my status again and it was, and still is, as "Initial assessment". The documentation required is just a new "health check". Got 28 days to attach the new medical examination that I will do on Monday if I can. 

    My time line: RCB, nomination and visa sent in July 2016 (on the 13 July 2016 my ma received the email regarding the IMMI acknowledgement valid application received). 

    Basically waiting for 23 months and 1 day. 

    187 visa DE as a baker in South Australia. 

    Waiting for the good news...!

    Yes sir, my agent applied RCB, then Nomination and Visa at the same time, on the 5th of July 2016. After 3 weeks, more or less, the RCB has been approved. I knew it only because my migrant agent sent me an email with the approved document attached.

    The visa 187 once is granted doesn't say that you have to stay 2 years with your employer from the moment is granted, I've get my visa yesterday and i have no conditions or restrictions wrote on it! 

     

     

    Nah, it's your obligation to work for 2 years after the visa is granted. It is written under "your obligation" on the Gov internet site (https://www.homeaffairs.gov.au/trav/visa-1/187-).

    Dear Mohit100, I definitely think that Mr. Dutton is doing what is best for Australia. I only think they should follow a chronological order, or at least to give the priority to those who are waiting for so long.

  5. Someone knows the reason why the DIBP does not process the visa following a chronological order? I have been waiting since July 2016 for a 187 direct entry visa in South Australia working with the same employer since the end of 2014. Honestly piss me off seeing someone else waiting for much less receiving the PR...geez!

They did not ask for clarifications and my agent did not have the chance to provide any further information. The document checklist was so thorough that I don’t even know why they trying to find excuses to refuse the nomination. In no documents there is mentioned that the owner works within the business; as matter of fact he runs a completly different business himself and the coffee shop that I run is only an investment.

    Now the next step is the appeal. I just hope it won’t take ages...

     

    My goodness, and happened after waiting 18 months or so??? Geez, all the best for your appeal. Let please us know how it is going...

    How come your migrant agent did not know it? Does he/she have a bit of experience or what? What now? What's the next move?

    Absolutely agree. I spoke with my agent few months ago and he said there were processing April - June 2016...moreover holidays are coming soon, so they will stop for a month or so...

    What the hell are you talking about? There is no "forced" shit. The owner can be fined up to 200.000$ for slavery. Got overtime paid? If no, talk to the fairwork commission and sue them. At least you get back some cash. 

    If he fired you and your visa has not been granted, you lose everything...you need to find a new sponsorship. I suggest you to talk to your migrant agent or with the immigration department as soon as you can. I reckon without been 100% sure that you got up to 3 months to find a new sponsorship.

    Nah, there was a guy on this forum who got the visa approved few weeks ago. If I remember well, he submittted the application on the 22nd of April 2016. I am still waiting mine since the 5th of July 2016...

    10.3.3 Approvable occupations specified in the latest legislative instrument

    For RSMS any occupation specified in the relevant legislative instrument with ANZSCO skill levels 1 to 3 may be nominated.

    Regulation 5.19(4)(h)(i)(A) (ENS Direct Entry stream) and Regulation 5.19(4)(h)(ii)(D)(RSMS Direct Entry stream) provide that the delegate must be satisfied that that the tasks to be performed in the position will correspond to the tasks of an occupation specified by the Minister in an Instrument in writing. In practice, this means that:

    • when assessing nominations under Regulation 5.19(4)(h)(i)(A) delegates must confirm that the nominated occupation is included on the Medium and Long term Strategic Skills List (MLTSSL) or the Short term Skilled Occupation List (STSOL), which lists occupations that can be approved in relation to permanent employer sponsored nominations under the ENS Direct Entry stream;
    • when assessing nominations under Regulation 5.19(4)(h)(ii)(D) delegates must confirm that the nominated occupation is included in the legislative instrument in relation to permanent employer sponsored nominations under the RSMS Direct Entry stream.
    • delegates must be satisfied that the tasks of the nominated position effectively align with the tasks for that occupation as outlined in the Australian and New Zealand Standard Classification of Occupations (ANZSCO).

    Important:

    • As of 19 April 2017, the legislative instrument for Regulation 5.19(4)(h)(i)(A) referred to above contains two lists, the MLTSSL, which replaced the former Skilled Occupation List (SOL), and the STSOL which replaced the Consolidated Sponsored Occupation List (CSOL).
    • Occupations listed in the MLTSSL and STSOL are eligible for the PESE ENS Direct Entry stream. A full list of these occupations is available on the Department’s website.
    • Some occupations on the list are restricted to certain situations via a caveat - refer to the legislative instrument.
    • The list will be reviewed periodically and can change with occupations being removed or added. If the Direct Entry stream nomination application was made before the updated list came into effect, then the application will be considered against the list that was current at the time the nomination was lodged. If the Direct Entry stream nomination application was lodged on or after the date the updated list came into effect, then officers should confirm that the nominated occupation is specified in the current legislative instrument. If the nomination application and associated visa application are for a removed occupation, then the applications cannot be further assessed and the applicants should be offered the opportunity to withdraw.

    I totally agree what you have said. To be honest, we can see some examples for 457 back in July. I have heard some applications have been refused, because the occupations were not on the list. I know someone who has been refused after July 2017 because he is above 45 years old at that time. This man has already got his nomination and medical examination. However, let's still be positive to see whether the policy will be the same for 457 and 187 in March 2018.  

    According to my agent, it is true only for the 457 visa applications and not for the 187...but who knows

Like I've said before it's one of those things that depends on their interpretation of the rules and right now on the PAM3 their interpretation is if the occupation isn't on the list, the nomination can't be approved. I really hope they clarify this soon. 

    I had the same answer from my migrant agent, that is, all new laws/rules do not apply if the application has been submitted. They will apply for only new applications. Anyhow next week there will be an update regarding the visa processing time again...any bet?

    Hey Gupta,

    Applied for RSMS as a artisan baker on the 5th of July 2016 in SA. Nothing yet. According to the processing visa time, it takes 16 months for the 90% of applications...that means mine should be reviewed in few days. Really doubd it...cheers
