    Thank you very much for the info, in terms of responding to immigrations email ' invite to comment' do i ignore it and wait for the 28 days to end? Then appeal? Or do something different like write them a letter? 

    Will i definitely get a chance to lodge with AAT for my visa? Even if i do nothing in thiese current 28 days?

    Also can i ask if you have been through this yourself or no people who have?

  2. Hi all, 

    In need of some advice please? 

    My nomination was refused on may 23rd. From here I have recieved a notice to comment which immigration has told me my options are to either withdraw my application (dont want to do that) or to not respond and then my visa will be cancelled 28 days after the 23rd of may. 

    My employer has lodged with the AAT. 

    If i do not respond im told i then receive another letter giving me 35 days to leave the country. 

    Can I not stay in the country whilst the appeal is on going?

    Turnover is 12 million and as i said the document i recieved literally dosent give a reason. 

    I rang immigration today and they said the refusal was based on insufficient documents from my employer and mentioned AAT

    Agreed! Its pretty stressful being in limbo for so long. I applied when the processing time was 5-8months (oct 16) with the expectation of spending around 2 and half three years max in the outback. Now looking at 4 years minimum and unsure if thats really what i want. 

    I figure ive been waiting nearly 20 months now so im just going to try and wait the decision out and hope spirits are lifted, weight of my shoulders etc or if its refused then thats the decision made for me and i wont have the' what if id of stuck at it' thoughts. 

    I know it dosent feel like it but everyday that passes is one step nearer to a decision, everything crossed for everyone ☺☺

  5. Hi all, 

    Im feeling the wait time pain 18 months this week:/ fingers crossed for everyone.. 

    Just two questions im hoping someone can help with first one is for a friend applying offshore for a 187, would they have to wait for the application to be approved before being able to enter Australia? Could be a silly question but i applied onshore so have no idea? 

    Second question is ... i leave the Aus next week to visit family on a bvb, say worst case scenario (stressing a bit) could my visa get declined whilst out of the country? If so any leniency to return and collect my possessions sell my car etc? Plus ive already booked the return flight to Australia...

    Hopefully im stressing over nothing but when i return i will be over 19 months waiting so all feeling a but close for comfort

    ?? atleast we are near the top end of the wait time now so hopefully not to much longer to wait... unless.... they extend the processing time again ?

  7. Hopefully someone can advise me?

    i just logged on to my immi account to see they have updated the processing time to 15-17 months. 

    I’m currently 15 months into my wait for PR but applied and received a bvb in October that expired last week. 

    I have a pre planned trip in may to Europe as I never expected the process to take so long (on application process time was 8/12 months) and I was just wondering if anyone had any experience of applying for a second bvb? And basically if I need to be worried or not?

    All good ?? I actually had to change my dates on the BVB so I spoke to THE most helpful lady I have dealt with within immigration. So I took the opportunity to ask her loads of other question too ?.

    30 minutes later my BVB is emailed through ??

    My mother was sick and I supplied evidence of this along with the application so I don't know if that helped at all or not.

    If you leave, your BVA will be cancelled but not the actual visa application, that would still be processed but bear in mind, most visa applications applied for onshore require you to be onshore when a decision is made.

    Thanks snowflake, can I be nosey and ask how long you was/have been on  BVA for? and is your visa application work related? 

    I only ask as for your situation there would be something very wrong if they didn't allow you back to see your sick mum. 

    My situation is way less of a deal I've been working for my RSMS employer for a year and a half  )12 months on BVA) and what I thought was a two year commitment is fast becoming four. 

    Im basically after a break from the outback and to see some friends from home who I miss and probably won't see again for atleast two years which is more or less what I put on the application (applied today) so will be interesting to see what happens. 

    Do you know the reasoning behind why you should be in the country for application decisions? Aslong as your doing what your supposed be doing you should still be allowed a bit of time away for whatever reason? 

     

  10. Jw if anyone has been through this process recently?

    Im currently BVA but have two weeks off work next week and I'm really keen to book a flight to Thailand as my best friend is there and I haven't seen anyone from home for a long time now.

    Would it be too risky to apply for the BVB today and just hope it comes through before I leave? I'm not sure if it's one of those visas you receive instantly? (Almost) 

    Also say I didn't apply for the visa, I understand I'm not allowed back into Australia but would I stay on BVA still awaiting my PR in Thailand or would everything just be cancelled? 

    Hopefully someone can shed some light

  12. Hi Razza I applied for 187 direct entry October 2016, still no communication from immigration. 

    Just a long waiting game. 

    I did read two stories on here for two people being approved on 187s from October 2016, so fingers crossed things are starting to move forward

  13. Spouse visa I'm not to sure on but in terms of taking any action I don't think there is anything you can do other than to simply wait. I'm in the same situation on bridging visa since October 2016 awaiting 187, I've contacted immigration 4/5 times just to try and get any information I can but they always just say to look on the immigration website for further information and that I will be contacted if they need anything. 

    A frustrating wait but hopefully will be worth it!
