  1. Hello friends, I have one question I am living in regional area from last two years, having 4 years of experience as chef. I got a sponsor in regional area can I apply 186 visa from regional restaurant and I haven't worked with this restaurant.

     or

    The restaurant should be in metropolitan area only to apply for 186 visa? Please help me.

    For 186 visa DE required 3 years of full time experience, I mean you applied for the same employer were you had work 3 years before.

    - No, you don't need to (by law) stay with your employee once the visa is granted however; 
    - If you leave the employer and they feel you shouldn't have or haven't "served your time", they could open a case with the immigration department, stating that you never had any intentions on staying on after visa approval. 
    - If they can justify that and generate a case, you could have your visa overturned and cancelled (I've only heard of one such case).

    My suggestion:

    - The employer has gone through the effort to sponsor you and get you into the country, spend the extra time and honor your deal.

    If you have to leave them discuss things with your employer and ensure you leave on good terms - this is always the best approach anyway.

    Exactly happened to me also. CO request documents my MA uploaded in visa file and email also but CO didn't look at any and refused my nomination. My MA request for review also. But after 28 days of nomination refusal we lodge the appeal, after lodging my review file was opened but CO said you lodge the appeal so we can't review your file now. After one month my visa refused due to nomination refused and I applied for AAT. 

    According to my experience you should have to lodge AAT with in time frame. 

  5. Hi I got my 489 visa recently. I got the EOI from NSW.  In my visa I got a condition 8539 (live, work and study in specified regional area). My MA is saying I can live in any regional area in Australia I don't need to move NSW. If I do so it will be any problem during 887 visa. Please guide me guys.

    Submitting pcc and medical while lodging visa is not compulsory but it's recommended to avoid any co Contacts and delay in your visa grant.

    Don't worry doesn't effect to your file. As long as the ABN and company name is same no problem.

Actually It my was my 187 visa refused based on natural justice they ask for documents and my MA attached all documents with in the time frame but CO didn't look the attachments and refused the nomination stating that documents not provided. But when my visa file was opened CO looked on the attached documents and said you have attached all the supporting documents but we can't approved visa due to sec nomination refused she refused my visa file too and said to apply for AAT. And recently my MA applied for AAT.

    Can I add my file in immi account.

    Demonstrating that there is a genuine need for you as employee will need to be shown - there has been a lot of refusals lately because of this.

    I would recommend using a Migration Agent - especially for the Business Nomination application.
