  1. Hello guys! My Rsms was approved last July 3 and still pinching myself. When I got my PR I told to myself these other people waiting will be next at its the new financial year, means new quota. Today I read back this forum and no body get their visas yet since then. How could it be? I don't want to be unfair. Mine only took 13 months as a chef.

    Every case is different. This is my second application. My work is located in a very remote area and it's a big company a 5 star Resort with 700 staff members. I have a lot of work experience and worked 2 jobs for 6 years with minimal days off or sometimes none. Theirs a few months I earned $1400-1600 a week clean after tax. They can see that in the summary of my tax teturn we provided them. In short I paid thousands of taxes with them including the 35% tax they deducted me when I took my supernuation when I left the country. They knew I contributed a lot in the Australian economy. I think this factors also adds up to your visa case.

    I did my medical last May 2016 before I go offshore so it has been expired since May 2017 good luck and god bless mate

    Good afternoon dear friends
     

    I am having a bit of dilemma and not quite sure how to proceed so I would like to listen some of personal experiences as well as some advice regarding reporting employer to Fair Work and consequences for my situation.

    A bit of background:

    I am employed as Motel Manager and had my visa sponsored by the company as RSMS 187 located in the NSW South Coast, it has been granted on the March 7th 2017 while away on my annual leave. I have been working here since October 15th 2015 acting accordingly to the agreed terms to increase revenue, manage and maintain the motel and so on. Worked most weekends and pretty much all holidays and festive periods since that date without receive any penalty rates on the grounds of having only 4 days off per month. So far, so good I quietly delivered my side of the commitment, however, from January 19th 2017 I have not been paid on date sometimes up to 7 weeks delayed including my annual leave which was not only paid vary late and without the load of 17.5%.

    On top of that the owner is constantly harassing (threatening to report to Immigration, accusing me of "testing his intuition', supposedly received a number of guests complaints about myself and the rooms presentation, that he would give a chance to sign my resignation but not fire me even though he verbally told me that I was fired or that I am no longer employed, and so on) and accusing of wrong doing yet without present any details or proof, with even more frequency these days as my wife is now pregnant and cannot be on site due to a risky pregnancy, for that matter living in Sydney to attend appointments and monitoring her pregnancy. Note that my wife has never been on the formal agreement but usually regional motels hire couples, never received a dime for her work. 

    After being ripped of from the promised commission, increasing revenue by 35% from previous 4 years along side other KPIs this constant harassing is taking a heavy toll on my nerves and after speak to managers that look after businesses nearby I found that he has a fame for pushing people to the edge till they just leave, as a matter of fact, prior to me there was 11 managers in 5 years, being myself the only one staying more than 12 months.

    My questions are:

    • How to proceed with reporting conditions to Fair Work?
    • What sort of formal notice shall I provide to the employer?
    • Consequences to my current visa situation and future job applications?
    • Has anyone experienced any similar situation?

    Hello Daniel. I totally understand what you've been going through as I myself had a bad experience with my sponsoring employer before. I was sponsored in a regional remote area in qld I already started working after my (1st) Rsms was lodged but unfortunately the nomination was refused. The employer doesn't want to help anymore then. I spent $20,000 moving up there and visa fees for nothing that I saved for 3 years. It really hurts me bad. The conditions sucks working long hours and under staff and I've heard and seen staff that they just keep on firing.

    In your case you got your PR. you can report them by not paying you but don't quit wait them to fire you coz otherwise you will not meet the requirement of trying genuinely to stay with your sponsoring employer. This is my second Rsms applicantion and I've heard a lot of good things about my new employer. For me having a good employer and work staff that I can get a long for 2 years would be a blessing and just think of my salary as a bonus coz it's really hard to stay wake up everyday in the middle of nowhere with that cruel heartless selfish environment.

    There's nothing wrong or suspicious about adding a dependent after the application has been lodged.  As long as the applicant has sufficient evidence that the relationship is genuine, then DIBP would process it similarly to any other and both the applicant his wife will get a PR visa at the same time.

    Many genuine relationship have been rejected even they have babies and living together for a long time, they made it harder these days but hope you're right hope he get through these and just that simple.

    Did you do it by yourself or you should have ask a migration advice coz as far as I know once you lodged your visa that's final you can't change it anymore. You should have applied a partner visa instead after you get your PR. You are single then after few months you get married that's suspicious. You should have establish/build a relationship first for evidence. You can attach minor documents like medical, tax return, etc.. but a partner that's a different story mate. You might get your PR but not your wife and you need to apply a partner visa then that's the best scenario you can get but I'm just guessing better ask a migration lawyer.

    Did you declare her as your partner in the questionare when you lodged your visa? Or you didn't include her and just added/attached her now?

    We are in the same boat man, mine is May18 nom May26 visa chef offshore no update till now. Everyday I try to be positive but it's really hard now these days. It's been too long.

    You doubt anyone's lives in jeopardy? Are you waiting? Are you waiting offshore with all their problems? It is easy to say to you to wait unless you are in their desperate position you will start realising/understanding things.

    from what I understand there is fixed number of visas granted to each occupation every financial year. The most popular occupations are managers (of all kinds).  Therefore these fill up fast. The tradie type of occupations and very highly skilled don't get many applications therefore they are continually granted throughout the financial year.

    What does this mean for you??

    if like me you have applied as a manager or cook etc (19march16) and still  are waiting what I believe has happened is that the annual limit has been reached for this financial year. For the tradie occupations, because there are fewer applications they still getting their grants approved. I believe we just have to wait till the new financial year starts on 1st July and then I expect there to be quite a lot of visa granted (or refused, depending on your file!!!!!!!) for manager occupations. So don't expect too much for the rest of this month. Look forward to July  

    Hope that helps you guys. 

    I'm guessing that if you are waiting for July and you have been waiting more than 13 months you would be likely get your visa because if you will be rejected they don't need to wait a new financial year you will be rejected by now. Does it make sense? So heads up you will get a good news on July!

    Is immigration dept waiting for any upcoming changes in Rsms visa that will result in a withdrawal of applications related to STSOL occupations? As they have done with some of 457 visa applicants.
    As processing time is getting increase every month.

    You are over thinking, cause of your anxiety, relax, be calm and have a lot of patience. They had already made changes and Rsms wasn't affected but the new changes will be implemented on March 2018 for new applicants only. If the application is mechanic, welder and any other hospital related they get their visas in 6-8 months but if it's a managers, cook and chefs we have to wait 14 months and some are even over. That's how their system works now.

    You will need a skills assessment then unless you have a related qualification in Australia. Getting a skills assessment is not easy it's a big job you need to be specific in what all you do, gather all your legit documents/evidence. You need to prove to them that your skill is equivalent to their 2-3 years Australian qualification. Good luck!

    Following additional documents are being requested by the Department in all cases. These have not been specifically requested, however I suggest that you arrange to provide these ASAP to enable me to update your case file:
    Letter from company's accountant stating that nominating business has the financial capacity to provide full time paid employment and superannuation contribution to the nominee for a minimum period of 2 years as required by the regulations.
    Balance Sheet and Profit & Loss Statement (for the past financial year). The financial statements must be audited and signed by company's accountant.
    BAS Statements (downloaded from ATO/Tax Agent portal) for the following periods: (January 2016 - December 2016)

     

    they didnt ask me personally so was little slow , I recommend everybody waiting from last year just update these documents sooner you can so you not ending like me searching for new option

    Why your MA didn't know about this? Coz my MA ask me these documents before we lodge my Rsms. I worked 7 years in Australia and I send them all my Payslips that I can find in my file, I requested the Payroll department a summary of my wages/salary for the period I worked with them from each employer. I also asked a certification letter that I worked with them. I also requested ATO a summary of my tax for the last seven years.

    Did you applied only nomination and not yet visa? Yeah it's really so frustrating it's been too long and I'm even offshore.
