Applied 16 Jan 2013

Acknowledgement of valid application: 16 Feb 2013

Case officer assigned: 10 May 2013

Application withdrawn and re-submitted new one (due to problem with IELTS): 3 Sep 2013

Medical undertaken: 05 sep 2013 (results submitted 10 Sep 2013)

Visa granted: 11 Sep 2013

Hi everyone just wanna let you know I rang diac to confirm if there's two years work experience requirement to be eligible for RSMS.So the ans. is NO it's all just rumors at this stage.Cheers!!!

I have applied from South Australia as a cook. When my rcb decision made we had two letters 1404 form and Company naminator advice letter. How about in your case did u get any other letter including 1404 form?

Cheers mate.. atleast RCB told you why they were not satisfied but in my case they said nothing if u don't mind I'm keen to know which RCB and what trade you work in?

In my case I have lodged 187 visa with Not satisfied RCB in Feb 2013, In RCB advice they clearly mentioned that we can lodge 187 application with regardless of RCB advice. They also mentioned that we have opportunity to counteract on criteria which we have not met. RCB adviced me that Business have not met following criteria

1.1.1 Business description supplied: Explains nature and scope of business activities

Explains types of jobs required in business

Outlines goods and services produced by business

Explains how position contributes to outputs of business.

 

They advised that they have not found the Business description information documents even though my MA submitted in an online.

 

They also advised to lodge the 187 nomination by attaching RCB advice. After all my employer contacted rcb case officer to find out exact reason of not satisfied RCB,

 

they said "we have emailed you the decision of RCB so please follow the instructions and lodge an application by claiming your unsatisfied criteria. My MA and employer decided to lodge an application and they did in Feb 2013 by counteracting the claims. It has been four months now..... waiting for result in stressful life.... Any way guys hope every one get good news.....

To apply for state sponsership i think I need to score 60 points but i can't m bit short in points

so with skill assessment u mean u have full skill assessment or just provisional,,have you been through job ready program,,anyway if u have full skill assessment ,,i dont think so u need any cert 4 or two years experience,,,it covers it all,,

 

and also if u have full positive skill assessment ,,just apply for state sponsorship I reckon perth is offering , as u previously told ur rcb got rejected,,no offense ,why waste money on rsms visa then..??

Yup I have full skill assessment and have also done job ready program through trade recognition Australia

I was told it all depend on co i still applied decision ready because it was told by diac that still my workplace will get one chance to clear/prove if in case co needs more documents but anyhow i m still trying my best to chase the reason of -ve outcome if anyone out there can help me with what else can be done please reply,will be much appreciated.Thanx

My ma is helpless said can't do anything about it coz RCB is independent body so i rang DIAC and they gave one fax no. Telling ask my manager to fax your concern and DIAC will get back soon to employer it's been like more than two weeks since we faxed the concern but still heard nothing..is there anything tha can be done to chase (-ve)reason

Your migration agent should have been on this. It isn't sounding too good for you though without a positive rcb.

Hello NGP yea that's what catching my attention if it is unannounced then how they can put in effect even i apied on 30th may 2013 & my ma told me nothing about it even though they say it was in effect from 15 th may?? Confused

As i have already told you guys my RCB was not even cleared & worst part theyvdidn't even told reason for being unsuccessful my manager & ma both tried to chase the reason but no luck but anyhow coz i had positive thought so i applied visa application but still I m trying to chase the reason and still getting no were..

I would hope they would take the 900 hours into consideration as it used to be enough for a positive skills assessment on its own! You were only one month short, so fingers crossed you will be ok. It might be worth consulting an agent as to if you would be better off holding out or just reapplying.

I work as motor mechanic in Toyota delearship & i got my Tra assessed for that i had already worked 900 hrs as a trainee motor mechanic nd now m wrking as full time from last 23 months(excluding 900 hrs)because i was not aware of this policy change i lodged my visa application on 30th may this year so now m worried should i withdraw my case nd will i get my visa fees back or just let it go?

deep sandhu. i understand ur concern.i went to see migration agent yesterday and he printed the whole new policy for me which states that for example cert 3,4 and diploma of hospitality will require 2 years full time work experience is sponsored as cook.i know it is totally unfair as if pplz hv 2 years experience they wd go for ens not for rsms as they wd hv to move to regional areas...... and typical Australian 485 graduate only have 1.5 year to gain experience.so at this stage u might be asked for experience. tc 22g

Yea I had already checked that link its some dlegal website which is not DIAC's website and they also referred to check on comm law website which has got no information aswell so i don't know from where they got this info.

Have a look back for the link. I think it was mid may.

And last I heard immigration were refusing volunteer work unless it was for a registered charity as so many employers were taking advantage of people who needed the work experience for visas.

Yes, it seems there has been a change requiring two years work experience. There is a link a couple of pages back.

Read this article:

There has been an unannounced change of policy in PAM3 since 15 May 2013 which Members may not be aware of.

Schedule 2 of Subclass 187 states [187.234©] that [if an applicant has an Australian qualification]...

"the applicant had the qualifications listed in ANZSCO as being necessary to perform the tasks of the occupation."

For the occupation of Cook, for example, ANZSCO says:

Unit Group 3514 Cooks

Most occupations in this unit group have a level of skill commensurate with the qualifications and experience outlined below.

In Australia:

AQF Certificate III including at least two years of on-the-job training, or AQF Certificate IV (ANZSCO Skill Level 3)

DIAC policy [PAM3 Subclass 187] now says that an applicant with a Certificate IV can only count that if the Certificate IV had two years work experience embedded, or if the person has two years post qualification experience. [30.2 AQF Certificate III, IV and Diploma qualifications]

This would seem to be above and beyond the legislative requirements, and above and beyond TRA skills assessment requirements.

This matter will be discussed with DIAC at a meeting this week.

Yup everything was done,RCB said we neither refuse nor approve its just advice (opinion)that was asked by DIAC.so we have deal with DIAC and now I don't know what should I do now so stressed

Thanx heaps for your reply,yea its geelong (Victoria) rcb i work as motor mechanic in Toyota dealership and pretty much my agent had provided all the documents but in result my agent just got bck 1404 form says not satisfies no reason no other letter so my agent & manager both rang RCB to know the reason it ws bumped back but they said sorry can't share any info. You have to apply for nomination and then case-officer will hopefully tell us..so I have got no option rather then moving forward.Does it happen if RCB given negative advise nomination still get approved?

Here's my situation i had applied for RCB and got negative reply by saying doesn't satisfied,haven't got told any reason that why it was negative now my question is if it is still safe to lodge nomination and visa application & if not what's risk factor?
