Little bit of background first: I lodged my 485 back in July last year and this was just granted last Friday (15/06/12) – relief, however the stressful part is yet to come! I was planning on applying for an 885 however my occupation (marketing specialist) isn't on the SOL anymore... So I was to apply for my 885 today then I'd have to use the current SOL, not an option for me. I am now thinking of going for a 856 - my employer has always been happy to sponsor me however I didn't really want to consider this as a possibility. Issue here is I've only been with them full-time for a year. I'm on my 485 until December 2013 - might be a timing issue. In order to apply for the 856, my understanding is that: I need to have been with my employer for 2 years IF on a temporary visa (457 would be the only one to apply to me) Or, I need to have been with my employer for 3 years Not 100% sure about the first point as this is what is advised under the eligibility requirements however, when I use the visa wizard, nothing of the sort is mentioned. Do I need to be on a 457 for this requirement to be true? And I am assuming the immigration starts counting the two years from the day my 457 is granted?
