The Solicotor was awaiting feedback from the barrister on my case who was on holiday hence the delay its just the advice I was given thanks for your thoughts on this

Hiya leleash thanks for your advice I really appreciate great to hear from someone who has the badge hat and tstshirt I have the police report when he assaulted me and other agencies documenting the abuse. Was your case to do with a relocation ? Did you find the judge seen through cafcass inaccuracies ? Thanks again

Ok I just had a call with the lawyer and he said he had loads of these cases at the moment. The trend is the judges still follow case law and the will be an over riding factor so I am safe. He also said recently he seem a case that the father would not move out the property and this look bad on his behalf rather then doing what's in the best interests of the children serving his own selfish needs thanks everyone for your advice on this matter

Hi sammy thanks for your well wishes i just found out from my barrister him staying in the property does not put him at a better stand point but high lighting to the judge how unreasonable he is. Also the abuse toward me is document his is just hear say Bit of a relief phew

Yes I have done it all I am from oz so have set up a job, school and house to go to I was told I need to sort out the children's matter before finance and divorce has been sorted he denied all the abuse and then made allegations I am the abuser so depressing

Yes the abuse has been recorded and threats made in front of the children. disappointing I am trying to play fair and all his dirty games are working turning the kids against me. I am sure the courts are fair and will follow the case law set. It would be up to the judge to state who is the primary simply not a case of not leaving the property

Yes I understand and have sort legal advice regarding his rights to remain in the property and he is well within them. My question would would be surely by remaining in the property doesn't give you more parent responsibility over the children. Him remaining in the property and stating he is a primary carer is surely incorrect wouldn't this be up to the courts to decide.

Yes he won't leave the property I file for divorce over a year ago. Surely it can't go in your favour no leaving the property and gain you more rights. The last social services officer asked him to leave the property in jan of the year

She presented my exes lies allegations as facts without any and left out my ex abused me and was still displaying controlling and bullying behavior barely touching on it. Then to top it off my ex wont more out the property doesn’t help with the kids and she said we are both primary carers of the kids !!! I am beside myself and so worried I won’t get the leave to remove application based on her recommendations which was for the child to stay in the UK Please any advice would be greatly appreciated I am beside myself
