danskitt
Hi all, I wonder if anyone can help. My wife, two children and I are going to live in Sydney. My wife is an Australian national and I am British, our two children were born in England. I have researched my visa which would be a subclass 309 and I assumed that the kids would be able to apply for dual nationality so wouldn't need a visa but I am not sure Thanks Dan
Guest
I'd think so. Apply for Aus citizenship by descent, then when that is through apply for Aus passports. We did this for our son before he was 6 weeks old and it was all sorted in a few weeks. Your partner will need to apply and iirc will need to go in person for passport application. O and make sure you get Aus specific passport photos, usually done in a shop. A uk booth won't cut it for Aus passport pics. We found plenty of shops able to take passport pics for most passports. And get uk passports sorted also do can leave uk on uk one and arrive in Aus on Aus ones Good luck
Quoll
It all depends on the origin of your wife's citizenship. If she was born in Australia then your children will be citizens by descent. However if she has her citizenship by virtue of Australian parents but not having been born or lived there for any length of time then she cannot pass her citizenship down one more generation. danskitt
Thanks for the replies guys. The kids can get dual nationality through their mom.
wellieboots
Yes you can apply for Aus citizenship by descent for your kids and once you have that you can apply for their Aussie passports. And your visa will be the 309 or the 100 - as you have chldren together, if you have been together for over two years then you will be eligible for the 100 hopefully, so that you have PR straightaway and don't have to go on a 309 and then upgrade to the 100 2 years later. Good luck!

JoandJon
Just wait until you start looking for the evidence If you're hoping for a 100 to be granted straight away, make sure to include evidence of your history together to prove you've been together for the 2 years. It's still not guaranteed, but it's more likely. (Hubby went straight to a 100 and we did exactly that)
