I currently have a permanent residency visa that was granted to me when my parents applied for a visa and are currently living in Perth. This visa expires in January 2013. I am currently still in th UK however. I have been engaged to my fiance for a year and we have been together for 2 years. We have decided to up and emmigrate for a chance of a better life, but I'm completely unsure what route to go on. Would it be best for a spouse visa or a defacto visa or would we have to apply for him to have a normal working visa? :biggrin: Any advice you could give to me would be extremely helpful. BackToAdelaide Posted January 31, 2012 Share Posted January 31, 2012 Hi Hannah, by the sounds of it you should qualify for a Partner Visa (you can be married or in a de facto relationship - it's the same visa). I'd strongly recommend you having a look through the Partner Migration booklet on the DIAC website http://www.immi.gov.au/allforms/booklets/books1.htm (click on Booklet 1). Have you been living together for at least the last 12 months? That's really the key thing here. If you can prove that then he can apply for a partner visa. The bit I'm not too familiar with is that you're a PR rather than a citizen and there is a requirement about actually living in Australia but there a few other threads on here about this at the moment and it doesn't seem like it's a black and white answer. Or he could go ou on a working holiday visa and apply for the spouse visa once you're out there (more expensive and longer waiting times, but if you wait until you've been living together three years then you'd get the PR visa straight away instead of the two year temporary one). kayleighmarriner Posted January 31, 2012 Share Posted January 31, 2012 hi sorry to interrupt with current chat, i think im in the same boat? would love some advice any will be greatly appreciated. im currently engaged to my australian citizen fiance weve been engaged 5 year and been together for 8. we have two children together nathan 5 thomas 2. we are in the process of saving up as we are hoping to emigrate for a better life in august this year my fiance has a job offer in melbourne. as time is ticking we really need to start getting things prepared, and hes always busy at work so thought i would start it for us. my fiance has an australian passport. will he need to fill any other paper work in or is that him done? if so which ones? i have resarched on net but everything is just so complicated. will our two children need any forms filled in other than passport applications? if so which? i obviously need a visa, what would people reccomend? could i apply for a permanent residence one will i have to get a temp one then apply when im in oz? i sound really pathetic but does anybody know exactly which forms i need to apply for this? i have forms 47sp (application for migration to australia by a partner) and 40sp (sponsorship for a partner to migrate to australia) is this all i need with all of the evidence etc.... they ask for? is this my visa application? or is this another form? on this form it also asks for dependent children, will i have to put the boys names on here? or because they are my fiances children will i not need to? would be so grateful if someone could help me, thanks very much x x x kayleigh x x x:rolleyes::rolleyes: Link to comment Share on other sites More sharing options...
Guest Posted January 31, 2012 Share Posted January 31, 2012 Kayleigh, was your partner an Australian by birth? if so, your children need to get citizenship by descent and Australian passports. only you will need a visa. Guest Posted January 31, 2012 Share Posted January 31, 2012 You don't need both, we did get both at the same time for our eldest before we left the UK. And then just the Aussie one for our youngest, until we started planning our return visit to the UK and then we applied for her UK passport as the Aussie post office (yes really!) just in case their were questions on arrival at Heathrow.
