chrisandangela 10 Posted November 12, 2011 Hi We are in Oz on Subclass 676 Tourist Visas. We are wanting to apply for Sponsorship Visas to continue our stay in Oz after the Tourist Visas expire, but we've heard that the "No further stay" condition in the Tourist Visas means that we cant apply for the new visas unless we have left Oz. Does anyone know if this is true? We can't understand the reason for this if it is true and is there any alternative way to avoid leaving, as we have family connections here and we've made many new friends. Thanks Chris
Quoll 6,201 Posted November 12, 2011 http://www.immi.gov.au/media/fact-sheets/52bWaiving_Condition8503.htm If you have a no further stay condition imposed then you agreed to that when you applied for your visa and you are only here as tourists and immigration expects that you will behave as tourists and depart when you said you would. They dont much like people who arrive on tourist visas and then expect the goalposts to change for them just because they want to stay. You may well not want to go, made connections etc etc but if you have the condition on your visa then you will have to, surely you have always known that you are in Aus as tourists?? I do hope you havent been working while in Aus because that would be a big no no. If you dont have the condition on your visa (and only you will know if you do or not) then you can apply for other visas if you are eligible and can find a sponsor etc
chrisandangela 10 Posted November 12, 2011 Thanks for your reply. No ... not been working ! We knew about the no further stay condition, but didnt realise (if our circumstances changed) that we couldnt apply for a new visa while still here. Thanks for your help
lebourvellec 738 Posted November 12, 2011 Check your visa to see if you have the no futher stay condition on it, it is not always applied to all visas. 8503 is the no further stay condition
Guest Posted November 12, 2011 You could always go and come back on a different visa without a no further stay condition on it
