DIAC will take into account the whole overall situation, as there is a child involved in some cases an earlier PR may be granted.
I cant quite remember when you were granted your 820, but I would certainly seek the advice of a Mara registered agent to clarify your position.
I have heard of a case where the temp visa holder (mother) was being thrown out. Having said that it was on A Current Affair and the fuss over it made DIAC re-assess the position and eventually allowed her to stay. i think that for cases like these, they have to be taken on the exact circumstances of each case so it may be best to contact Legal Aid or an immigration lawyer. The first consultation is usually free but have a look on your visa paperwork as I think I remember something on there about what to do if the relationship breaks down
