Lafha - on a 475 visa

Does anyone know if there is entitlement to Living Away From Home Allowance on a 475 Visa (NOT 457)? And if so has anyone in receipt or been in receipt of it? I assumed on a 475 there are no entitlements at all, but another poster has advised that it is possible on a 475, can anyone shed any light, thanks

There is no entitlement to LAFHA on any visa.

 

On a 475 the idea is that you are seeking PR, so I would be surprised if you are going to get it.

You are entitled to LAHFA on a 457.

 

Because its a temporary long term visa, Australia is not classified as your home country initially. Its only when you purchase a property or start the PR process that this is might then not be the case, because you are looking to make Australia your permanent home.

To say one is entitled makes it sound as if it is automatic if you have a certain class of visa when that is not the case.

 

If your employer is not willing and/or able to process the LAFHA then you wont get it.

 

Same goes for those that are PR or citizens who are working away from their home elsewhere in Australia. They could claim it IF their employer is willing and able. If not, they don't get it.

No, I will maintain that it is not an entitlement.

 

It is not a legal right employers don't have to administer it if they don't want to and nothing the employee could do about it.
