Visitor visa to partner visa

I am an Australian citizen and recently got married with an overseas girl. I want her to be here with me ASAP. I am asking her to apply for tourist visa (Subclasses 676) and when she gets here, she can apply for partner visa (Subclasses 820 and 801).

 

I am not sure if it is allowed to apply for a new visa during your stay in Australia ? If it's not possible then what would be the best way to get her in Australia asap and she could stay here for rest of her life.

Are you currently overseas with her? Or are you in Australia and she remains overseas?

 

If you are in Australia and she overseas, then I think she might not get the 676 visa, because sometimes people have to prove that that really are coming over for a holiday and have things to go back to. An Australian husband in Australia might make that difficult. If she was granted this visa, then she could have the no further stay condition which would mean that she will not be able to apply for a partner visa onshore. You won't know whether you are going to get this or not in advance.

 

You could try this and see what happens, but applying for the offshore partner visa might be a better bet.

If she applies for an offshore visa, she is allowed to then get a tourist visa to visit you while she waits for her visa to be processed. she would then have to leave the country for a couple of weeks once the visa is ready to be granted.

Is your wife from a High Risk country or the UK?

 

If she's from the UK, then there shouldn't be much issue doing what you suggest, however it's cheaper and faster sometimes to make an offshore application then have her travel to visit you on a tourist visa. There are other members here who have done this and travelled on the 676 visa to wait out the partner visa being processed with no isses, however they have all been UK partners.

 

If your wife is from a High Risk country, this may be slightly less straightforward. Contact the relevant DIAC office to which she would apply offshore from her country to see what the lead time for applications is.
