Migration Review Tribunal advise

Hi all, received the sad news of my sister's application as a Skilled-Regional Sponsored (subclass 475) that was refused on 21st April, 2011 due to not meeting the criteria of her work experience versus the skill assessment that she had.

We have the option on getting the result review via MRT, should I do it or not? We did all the application by ourselves as we cannot afford a migration agent, do you know a good migration agent that is not too expensive to charge...

any feedback is good..thank you

Yes, if you use a migration lawyer.

if you cant afford, then just forget about it.


Visa 885 applied on 29th Dec 2009, 2231-79 nec, CAT 4, Reassessed as 261312 (Developer Programmer) on Mar 2011, CO allocated on 6 Apr 2011. GRANTED on 8 Apr 2011!!

thanks, do you know roughly how much it cost you? who would you recommend as a migration lawyer>?

Hia we used an amazing agent and we didn't pay alot for their services, the only problem is they are closed for the holidays until Tuesday 3rd May.

 

I'm trying to work out how to send you a pm with her details.

It is probably because of the amount of years she may have worked in that particular occupation or relevant similar work experience, for example; if the state says it wants 7 years exp in that occupation or other similar relevant employment to sponsor - there are different requirements for the skill level such as for professionals, or trades. the requirements for the skilled assessment are not the same as those for state sponsorship of that skill.


Moved back to Perth in May 2013.

yeah should have been more specific, she did a BS in Accounting however, NIA refused to give her the skill assessment as its only considered a Diploma in Australia. So we then got a Branch Accountant skill assessment from VETASSES however, she has been wrking in a hospital for over 2 yrs as Accounting assistant..but they said it doesn't match her wrk experience to branch accountant..

My feeling is that you would be throwing good money after bad if you pursue this.

 

It has not been easy finding a description of branch accountant as it is no longer on the lists, but this is an old description. Certainly my feeling was that it would be something to do with working in a bank or building society and very different to what we mean by "accountant" elsewhere.

 

You mention your sister worked as an accounts assistant in a hospital. This seems clearly unrelated to the description below.

 

I don't think you are going to win the MRT. However for your peace of miind, perhaps speak to an agent to get their view.

 

Branch Accountant (Financial Institution)

 

Administers the accounting processes and related operational activities of branches of banks, building societies, credit unions or similar financial institutions.

Tasks

 

 

 

  • receives and analyses regular reports of branch accounting activities and reports to the branch manager
  • investigates discrepancies in customer service officers' balances
  • ensures branch procedures for the clearance of funds, security and general operations are maintained
  • may grant or approve loans within limits set by the institutions' regulations
  • may supervise clerical and administrative staff

If they cannot refuse you any other way, they refuse on work experience.

You will have to pay the $1400 MRT filing fee plus half of that for me to lodge the application, if I think you can win it. If you do not win it you will lose $2100. If you do win I will take the $1400 filing fee, which will be refunded.
