I've searched for answers to some queries I have about the 457 visa but either ended up confused or convinced the information out of date. I just had a few questions which I hope people with more knowledge than myself can answer. For info, I'm in the UK and will be working in a hospital in a fairly non-medical role. - Are police checks compulsory, or do I wait until asked after applying? Do I need to fill out that form 80? - I was born in the UK and hold a UK passport. Do I really need to do IELTS or am I exempt? - Are previous employer references compulsory? - Is there an official minimum length of relationship for attaching a de facto partner to the 457? (I know it's 12 months for PR visas). Thanks in advance for your advice, Jonny

Wait until asked I would say. Do I need to fill out that form 80? Yes 99% sure you do - I was born in the UK and hold a UK passport. Do I really need to do IELTS or am I exempt? Not sure about that one! - Are previous employer references compulsory? If they ask for them yes!! - Is there an official minimum length of relationship for attaching a de facto partner to the 457? (I know it's 12 months for PR visas). Cant help with that one!
ali Posted December 30, 2010 Posted December 30, 2010 I didn't come on a 457 so don't know about the visa. I think that with any defacto you have to prove a relationship of 12 months. You also need to have some private medical insurance, so it may be worth checking the internet to compare prices and coverage
Guest Posted December 31, 2010 Posted December 31, 2010 To answer your questions :: - Are police checks compulsory, or do I wait until asked after applying? * Police checks have been compulsory for 457 visas, since Sept 2009 - so yes you need to do them. - Do I need to fill out that form 80? * Form 80 is not on the mandatory checklist for offshore 457 visas (http://www.immi.gov.au/skilled/skilled-workers/_pdf/457-application-checklist.pdf) for onshore 457 visas it is mandatory (so toss a coin and decide whether to supply it up front). - I was born in the UK and hold a UK passport. Do I really need to do IELTS or am I exempt? * For the 457 visa you don't need a skills assessment, but if you do try and get a permanent visa at a later stage you'd likely have to be points assessed. Although IELTS exempt by having a UK passport, doing it anyway can provide additional points. But at the 457 stage is not required (Exemption clause :: ComLaw Legislative Instruments - Migration Regulations 1994 - Specification under paragraph 457.223(6)(a) and subclause 457.223(11) of Schedule 2 - Level of Salary and Exemptions to the English Language Requirements for Subclass 457 (Business (Long S ). - Are previous employer references compulsory? * No they're not compulsory - the weight of the other evidences you supply is also assessed. (wording on the checklist says : "may include, but is not limited to"). - Is there an official minimum length of relationship for attaching a de facto partner to the 457? (I know it's 12 months for PR visas). * For a 457 visa, the 12 month rule does NOT apply. Pozz Posted January 2, 2011 Posted January 2, 2011 Peach has pretty much covered it all, except the police check. I was never asked to provide one with my 457. My professional registration in Oz needed it, but I dont think they had any ties with immigration regarding swapping information. Evidencing a defacto was a lot easier than I thought it would be; a couple of photos and some holiday receipts covered mine.
