Guest karl276 Posted December 24, 2010 Posted December 24, 2010 Hi all I'll start with some quick info, on a surch for a flight price to oz next jan for a wedding i stubbled across this forum and found a job in august i applyed september and got the contract of employment in november,all a bit quick for both myself and the wife but its something that we have wanted to do so australia here we come This is where my issue comes into play i have all along been told that we would be going out on a 857 sub section 119, but with a quick email with my contact he said we would go out on a 457 as it is quicker, now heres my qestions on a 457 4 year work visa can i apply for any PR visa whilst in australia or will i have to leave and apply and wait. Can we still become australian citizens after the said time if we have entered on the 457 visa. all advise will be greatly taken many thanks karl

Because a 457 is temporary, it may not count towards time you have lived in Australia aiming towards your citizenship. I think that you have to be on a permanent visa for that. The best and quickest way for you to go, would be for your new employer to make your position a permanent move after you have spent time with your new company. You can go down the ENS route, which is a permanent visa, it means you have to work for the same employer for 2 years. Look up ENS on the DIAC website for more information. Merry Christmas, John

Firstly, yes you *can* apply for PR whilst you are over there on a 457 visa, but the question is will you qualify for it in your own right or will you get the employer sponsorship that you need? If the employer is saying now that they won't sponsor you for a PR visa, what is going to make them change their mind in the future? You are either going to have to start your own skilled migrant visa application or you will need the employer to sponsor you. Is your occupation one that qualifies for skilled migrant or ENS sponsorship, not all occupations are eligible and if your is eligible can you get the employer to commit to it now? The ENS would be slightly easier than the RSMS visa you originally thought you were going to get. I do not think that you should go into this thinking that once you get into Australia on a 457 it is a given that you can get PR. You have to have a strategy for this. WIth regards to citizenship, in fact the time on the 457 visa CAN be used as part of the 4 years you need to clock up, so long as at least the final year is spent on a PR visa. Good luck.
Guest karl276 Posted December 26, 2010 Posted December 26, 2010 hello the empoyleer will sponser me to oz and will nominate me and my trade as a heavey dutey deseil engineer is on all the lists for migration i think that they just want to speed things up and i was worried that the 457 visa wouldnt allow us to do the full package as we all want and sometimes it is better to ask the question as i can see there is alot of peolpe that now the ways off moigration i thank you for your help in settling my thoughts karl

They have no obligation to do this and it is not an automatic next step from the 457. Do you have a family and which state will you be based in? You need to think about these things if you are going on a 457.
