Hi all..

Hope someone may be able to help me..

Just recieved a case officer after 2 years (175 applied Dec 08)

I have just recieved my police check from Ireland and there is an old charge of assault from 13 years ago.

I was fined but no conviction was recorded but it still shows on my check.

My former agent (the useless Liveinaustralia.com) told me I don't have to declare it as I was not convicted just charged. Now I am naturally worried that it may look like I was trying to hide it.

Anybody had the sme problems...

I'm no migration expert buddy but I would imagine that if it is showing on your check then you have to address the issue with your case officer. I am sure if you were upfront and explained the details of the incident and indeed the misleading information given to you by te agent you should be ok.

I agree with the OP.

 

Be up front, its not an offence that will affect your application, but if you dont decalre it and obviously its going to show up on your police record, you could have serious repercussions re the visa.

Do a covering letter explaining that you had declared it to your agent and the advice you were given. In the letter explain the circumstances and how you've never been in trouble since. Get a couple of character references to go with it - it really shouldn't harm your application.

Please don't worry but like everyone has said put a covering letter explaining the circumstances and that you were not charged. Get some character references and i am not sure but i think you can fill in a form on the immi.gov.au site about change in circumstances/additional information or something will go look - be back soon :yes:

Agreed. Its better to be upfront and include. If I am not wrong, the application form says to list all offences and convictions. Though no conviction was recorded, its would be classified as an offence. If its something that small, its probable not even going to have any effect.

Sorry, but if you were fined then you were either convicted or admitted guilt. Not mentioning it does indeed look like trying to hide it and only mentioning it when it showed up on your police check is not a good look.

I was charged with abh as a teen and got 80 hrs c.service then in 1999 when i was 25 went to oz on a whv and did not bother putting it on the form ,after being there for four yrs i went for my pr thats when the problems started. police checks showed the recored so they wanted to know why i did not put it on my whv form what was i trying to hide .they wanted the ins and out of the crime and how sorry i was for what i had done typed up in a letter .they said there was a very good chance the pr would get knocked back, was a hole lot of stress for me and my wfe .lucky for us it was granted and now we;ve got a passport so we're sorted.

so mate let them know what you've done and you were young and how sorry you are for it blah! blah! blah! ...

Would have been a damn sight cheaper to steal a sheep than to pay the Visa Fees lol
