Need some advise for appeal on the issue of Cap"n"Cease for pre-sept.2007

I want to ask some immigration issue regarding cap"n"cease that what is going on , how much applicants got ther money back how much remain to get , and also how much are to wait to file case or want to contact with new Immigration minister chris bowen for the consideration the case etc .

By the way I want to case register as an appeal through good lawyer if I have right to appeal , do you think that we have rights to appeal against the dicission or have no rights , Remember I had applied for " General Electrician " BN-136 Independent class . I will appreciate to all reply in this regard .

Is there any lawyer/solicitor , who can describe me the situation about Cap"n"Cease issue how to register the case and what should raise the points , because I don't know how to react on this issue , Please reply .

Hi moving2melbourne - Kate ,

 

Actually I have ask two solicitors about register the case , One have said you have no rights in BN- 136 CLASS and second one is asking my full detail agianst cap"n"cease to file up the case .

So bit confusion , that's why I need some advise from here at this forum but still nothing found . Please if you have any knowledge about the law that can I any body launch the file against cap"n"cease or not , there is no right for me/us . Waiting for reply.

Here is an exhaustive statement of your rights - You have none.

 

CL indicated some time ago his opinion that cap and cease could be successfully challenged.

 

I referred one case of mine to him and I referred others who were not my clients.

 

I do not know the current status of the issue.

 

I have received a communication from the DIAC rejecting my claim that s65 should prevail and reiterating the purported legality of the cap and cease decision.

 

I recently applied for my my client's entire file under FoI. You might consider doing the same.

hi all

i am also the one of poor applicants ask for refunds but still not filled refund form yet. i have also email to cl in aug and in reply they want to seenotification send to me. i forward it but have no further response. now few days ago i do same but no reply again.to whom i should contact.

me too want to fight against but dont know right way .could you tell me the contact id of solicitor to whom you had contacted.i regularly see commlaw for any action on legislative instrument 39 but didnt found any thing new about its disallow moment or passing.its coincidence i am electrician too but my visa class was changed to 137 in feb2k10 on sponsoring by victoria.all of my document was finalized and nothing was pending to finalize my visa that time. i m from india (pb) and you?

FoI (Freedom of Information) Use form 424a.

 

Under recent changes there is no charge for FoI requests for personal documents.

 

It is possible that the cap and cease decision although legally possible was not legally made in some or all cases.

 

It is also possible that a capped and ceased applicant could argue 'reasonable expectation' under ADJR - historically application grants have been rolled over to the next year when the planning level for a given year was reached.

 

Even though I have run the mongrels in the Federal Court (to amuse myself and furnish another chapter for a book I was writing) I am not a lawyer and I cannot give legal advice.

Hey Lucky, I really appreciate your effort for fighting against this injustice. But dear God knows what would be the end result. Look at me, they say Minister can not can and cease 496... But what they can not cap and cease? We are already suffering like you guys. I am waiting since last 40 months and the end result is still waiting. Now I am on Priority 4 which is dead and buried. Lots of people raised voices against this injustice of earlier Minister but all those thread either disappear or deleted.

I can't say about franchises or representatives in india but I saw the CL official Web. site ,there is no official representative or frenchise from CL & associate .

Now second is that I didn't send FoI , But I am willing to send FoI shortly too.

Guys freedom of information in Australia is equivalent to Right to Information act of India which has proved very useful here in our country... Can my brother who is Australia citizen ask for the delay in the processing of my application.
