Exactly a year to the day since I started work my position has been terminated due to company insolvency. I got one days notice, I am owed a weeks wages and 3 weeks annual leave which I probably won't get back as there is so money left in the company and I can't claim from GEERS as I am not 'permanent resident'. I have applied for a new job and the sponsorship application/nomination is still being processed and has been for over 4 weeks now. To be honest we cannot afford for me to not be paid for any longer and the new company who are trying to sponsor me may not even be eligible as they may not meet the 'training requirements'. Me and hubby have been awake all night thinking of what we need to do if we have to go back to the UK, we will need to make a decision soon, if we keep paying rent, bills and living we will not have enough money to start again back in the UK. Can anyone give me any advice on the following: 1. If company is insolvent will I have to pay for own flights back? 2. Can I get the tax back from July to now? 3. Can I get the super back? 4. I would think that under employment law they'd have 2 pay your lost waged & annual leave. 1. If company is insolvent will I have to pay for own flights back? 2. Can I get the tax back from July to now? On next years tax return that calculate if your owed anything. 3. Can I get the super back? Yes, once you have left oz & are no longer in hold of a valid visa, you go on the ato website & can claim your supa na l Also, the sponsor has to pay your flights back, it's part of their obligations with DIAC.. My previous employer DID NOT make any super payments in the last 12 months and I have to wait for outcome of insolvency to see if I get any of that back. (Not likely, I have seen the figures!) Tax office say we can make an EARLY tax return if we intend to leave the country but none of this helps to raise the money for the flights home But thanks so much for your reply cdb - I work in IT, I come from a Newspaper Production/Prepress background. I was sponsored as a 'Business and Information Officer (NEC) as I have quite diverse IT skills, but primarily I was here to improve production of the student material for an Education provider who previously had no IT Systems in place at all! Fat lot of good I did them lol! The new company who is waiting to hear about whether they can sponsor is a small printing company who need IT/Prepress Manager which would be perfect to me but they have no training in place at all which makes me wonder if they will get accepted and to be honest everyone seems to hav stopped talking to me which makes me worry further We are now thinking that we will sell all of the stuff it has taken 12 months to accumulate and head back to the UK, it is a very hard decision! As for the super, everyone who is working should check with the fund they are with to see that the super payments are being made. My best friend has just lost her job and found out that her super had not been paid for the last 12 months and none of the other employees either. They have put in a claim for reimbursement. If we check this we can nip it in the bud and avoid problems. A lot of firms when short of cash seem to think paying employees entitlements comes last when they should come first. Top tip that. It wouldn't have occured to me to check that sort of thing. Hop, my heart goes out to you and your family. What an awful situation to be in, and what a rollercoaster the last 14 months have been for you.
