A quick question for those who applied 175 while awaiting Vic SS results -

If we decide to lodge a 176 later when SS gets approved - can we cancel our 175 application - hoping that we get the application fee back?

Hello Tycsee,

You can cancel your 175. However, the available time until the new points system will not be enough until you submit your 176 online applications. Furthermore, application fee is not refundable. So, you will not get your money back.

I recommend to you to apply on papers(if you receive VIC ss, and wish you do). The advantage is: your application date will be the date DIAC receives your papers, so this is the fastest way to have a running 176 application and be on the safe side. The disadvantage is: you have to wait at least 3 weeks until you receive your file number. also, you will not be able to track your application online.

I received VIC ss after I applied for 175 and I had to apply for 176 on papers. and still waiting for my file number since 14th of April.

Don't regret that you applied for 175. In fact, you are on the safe side now. it is May already, and it is critical time to risk.

Good luck mate:cute:

Still waiting for outcome of our Vic SS that we lodged on 4th Nov 2010. Heard diddly squat! Unable to apply on a 175..argh!

Hey WaW,

what is your occupation? I could not find your details on the first page. (Feel free to join us by the way).

Is there a chance for you to apply for another state? If so, then send VIC a last mail asking for the status and expected waiting time and if you're not satisfied with their response then it's time for "good bye VIC". 6 months is by far too much and they should expect applicants loosing their commitment to VIC.

Cheers

Uli

Hi,

We have applied to WA 3 weeks ago! Sick of waiting as agent was not geting any rreasonable replies from VIC.

I am a Social Worker, OH is a chef, he is main applicant. (I did not have enough post qual exp when we started the process. Although just completing my skills ass form now with the support from other PIOers.

We hope that WA give us sponsorship as it doesnt look hopeful from VIC. It like playing a game of chess isnt it. We started a year and a half ago, and it takes over your life.

We hope to hear back in the next couple of weeks from WA fingers crossed.

Katie,

Of course it's ILLEGAL for tourists to be searching for work.

The customs official has every right to turn you away ceasing the tourist visa if he/she happens to find Degree Certificates, Employment Letters, Salary Slips, etc., or something fishy which could be used in job searching.

But, a lot of people on Tourist visas do that. So, it's kinda like taking a calculated risk. It's your call anyway.

Why don't you try for Queensland or WA? They still have BA on their list, and last time I checked, Queensland was granting SS within 2 or 3 weeks (someone got it even in 2 days flat!).

P.S: Just checked your details on the first page, being a Filipino (classed as HR by DIAC), it's more of a risk carrying the docs I mentioned earlier when you land at the airport with a tourist visa in hand (Oh, me too HR, damn!)

Good luck!!

armandra!

Thanks amandra.. I just figured how will I be able to get a job offer if I will not go to OZ (not counting too much on online application)..

I already applied to WA 2 weeks ago.. I will try QLD once I get the 5 years work experience needed (mid May)

In my opinion, it's not for the Australian authority to prevent you from asking about the progress of your application. The agent is the one to be concerned about your actions.

However, be careful of your agent if you are going to bypass!

Additionally, a profissional agent will determine rights of both parties. So, I believe if you will refer to the contract, you may find a frame which the agent is allowing you to move within.

Haha well buddy, it is my opinion and welcome to anyone who wants to contradict. :wubclub:

I believe the Australian authorities mention the agent in its applications just to take agreement from the main applicant to expose information to external party (the mentioned agent).

I also believe, if the Australian authority finds that it has to interfere and prevent main applicant from contacting them without referring to the agent, they were going to mention it in available applications we submit. As you may noticed, all applications clarify rules accurately and clearly. I don't think they just forgot to mention this point :nah: I think it's not that important to them or even concern them to interfere.

However, as I just said, it's only my opinion :cute:

How did it go with you buddy? Where did you reach now?

Turn me brown:( I got most expected response from Victoria,

"there is not sufficiently high demand for your skills and experience to offer sponsorship at this time."

2231-79(CISSP & Network Security Specialist)

IELTS: 7.0

Applied: Already applied in May, 2010 Under 176

Already have SS of WA (But unfortunately my occupation isn't in current SMP of WA therefore currently my occupation is in CAT 4) That's why i applied for Vic but they replied, "we 'll not help you to come out of this mud"

Wish you guys best of luck.

Hey triumph,

sorry for your rejection. Please give us some more details of your application to VIC? When did you apply, did they request any additional stuff?

Will you try with the ACT instead?

Cheers

Hi Uli,

Thanks for the concern. Well i applied on 03 Jan, 2011. I got two emails in 1st week of March regarding my application number & delay. then i got third email regarding delay in last week of March and now i got rejection. I provided complete documents & they didn't ask for any further docs. I also informed them regarding my Current WA SS on basis of which applied i applied to DIAC in May,10.

I applied as there was a window of opportunity that i might get into SMP since WA removed my occupation (i.e. 2231-79(nec)) from their list in Dec,2010.

I 'll not apply to ACT since it takes alot of time and don't know what will happen in July 2011 & further it require 7.0 each band whereas i got 6.5 in speaking & overall 7.0

Thanks for the details triumph. So do I see it right that there is no plan B for you at all? Will you give up the OZ-story then?

My application is in pipe line at DIAC. I didn't give up though its a long road then.

I don't see any plan B. I am currently in CAT 4 (Though at the time of my application to DIAC my occupation was in CSL and i was in top priority )and i don't see any way to jump from CAT 4 to CAT 2 beside this VIC SS and of course 475 is a difficult option and i am from a "HR" country and employer hesitate to hire so frequently.

Do you have any suggestion / advice for me? Plz do share.

I am here to fight with all the circumstances:) but currently i am in dark. Don't see the way out or any plan B while my application is already with DIAC since May last. Anyways Thanks.

The easiest option for you will be to get an ACS-reassessment to get a proper ANZSCO-code. See also: http://www.immi.gov.au/skilled/general-skilled-migration/pdf/acs-skills-assessment-review.pdf . Apply for a code that is on SOL schedule3 and you'll then be bumped up to cat3. You should have your visa by the end of the year. I'd wait until the new SOL is out in July before applying to the ACS. Just to be on the safe side in case they kick some ICT-occupations off the list.

Or resit the IELTS and try the ACT but the outcome is questionable since they don't have so many places in their quota. Vicky once wrote that ACTs SMP team is very helpful so you might want to contact them before to check your chances.

Worst option. Wait for the cat4 to be processed. It is said to start in FY 2011/2012 but it might take quite a while until they reach the 2010 applicants.

You see, there's plenty of options. Go for it !

Wait is Over

My friend "iffi" got rejection, Following excerpt is from the email:

Thank you for your application for Victorian Government sponsorship under the 176 - Sponsored visa scheme.

Following a review of the information you have provided to the Skilled and Business Migration Program, we regret to inform you that the Victorian Government is not in a position to sponsor you under the 176 - Sponsored visa scheme.

Under the Victorian Government’s program, sponsorship is offered to skilled migrants whose skills and experience are in high demand in the Victorian labour market at the time of assessment. High demand may mean those skilled migrants whose skill sets are hard to come by or are rare and unusual.

During the assessment process the Victorian Government consults with industry representatives in Victoria to determine the demand for an applicant’s qualifications, skills and experience, and whether they have high prospects for employment in their field.

All decisions are made on a case-by-case basis.

While your occupation meets the eligibility criteria to be considered for state sponsorship, there is not sufficiently high demand for your skills and experience to offer sponsorship at this time.

Note that we would be happy to re-assess your application should you be able to obtain a valid offer of employment in your nominated occupation within Victoria, while your occupation remains eligible to be considered for Victorian Government sponsorship.

Refer to the Department of Immigration and Citizenship (DIAC) website for alternative visa pathways: http://www.immi.gov.au.
