Guest Victoria Posted July 21, 2007 Share Posted July 21, 2007 Hi, My partner is an Australian citizen and we are planning on going back to Australia in Dec. I was going to apply for a working holiday visa and then apply for a permanent one once we had gained enough evidence as although we have been together for more than a year, we havent lived together. BUT, i have just found out that i am pregnant and i will be due in March 08. I am now unsure as to what options are available to us and whether i would be able to get medicare or would i have to pay privately? I really need some help and advice if anyone can reply please. Stuju Posted July 21, 2007 Share Posted July 21, 2007 Hi Victoria, Im in oz on a spouse visa, i know you said your not married yet - but i am very sure that you will have no problems - i think the best way is for you to go on a defacto visa which is almost the same as spouse, i do know that if you have a babe together (on a spouse visa)this gives you automatic permanent residency - i almost got it but we lost the babe at 15 weeks and my chidren are from a prevoius marriage. The good news is that when your baby is born as his/her father is an Australian citizen it will be an Australian citizen by descent wherever in the world it is born. If it is born O/s you just need to prove to nearest Australian commission that its father is Australian and it will be given an Australian passport. You on the other hand: giving birth to an Australian citizen doesn't change your visa status, neither does being in a relationship or marrying an Australian. My suggestion: move in with him as soon as possible and although you can't prove living together for 12 months you can argue the waiver because you have a child. Spouse visas are temporary for 2 years and then permanent. Best of luck with bub.
