virtual_bajwa
Hi VB I have moved Rah Rah's post. The only person who can correct the title of a thread is Site Admin. He has gone on holiday for a fortnight with his family. (Site Admin = Cerberus1= Rob.) Rob has a laptop with him and can control PiO from the laptop. However your thread has been running for some days now and tonight is the only mistake with it, plus it is such a minor mistake that I feel it would not be fair to disturb Rob just to ask him to change the thread title at the moment. Do you agree? In the meantime, every single person who is in pickle with the pre-September 2007 applications comes from a High Risk country, it seems. Most people have an IELTS score that exceeds the score required at the time. Shades of the White Australia Policy all over again, I am beginning to think..... Cheers Gill Thanks Gilly, I was going to mail you sometimes today. Anyways no problems, mean time I had added a head note at the start of his thread in BOLD RED pre-September 2007 applications. So applicants will be aware of this thing.

The cap specifies a maximum number of applications in certain subclasses to be granted in the 2009-10 program year. Any applications not granted before 30 June 2010 in the relevant subclasses will be taken to have never been made and will be returned, with application fees, to the applicants. They do not apply to onshore skilled applications They do not apply to Skilled Independent Regional (SIR) subclass 495 applications. They do not apply to any skilled applications lodged on or after 1 September 2007. The caps (ie maximum number of applications to be granted by 30 June 2010) will be as follows: Skills Matching subclass 134: 245 Skilled - Independent subclass 136 and State/Territory Nominated Independent subclass 137: 2,506 Skilled - Australian-sponsored subclass 138 and Skilled - Designated Area Sponsored subclass 139: 546 It is unclear how many applications will be capped, but the latest estimate from DIAC was in the order of 8,000 applications. And on the ground it has to be implement. So I request all of us who are effected should get ready for the fight. Let's hope that such a situation does not arise. Hi Electrical Guy Like you, I also subscribe to the news bulletins from Acacia Immigration, which is run by Mark Webster. He is a Registered Migration Agent, occupies some sort of senior position in the Migration Institute of Australia and he is the one who gives interviews to Peter Mares of ABC Radio. I got the news that you have posted either late last night or when I got up this morning. I came to the conclusion that I haven't seen anything to convince me that the Minister has done anything except applying the formal Caps to some of the visa subclasses. Applying the Caps does not necessarily mean that he also intends to start terminating visa applications, it seems to me. Andrew Metcalfe is the Secretary of DIAC. This term "the Secretary" is civil service jargon for Chief Executive Officer. Mr Metcalfe is the Big Boss of DIAC, in other words. He signed the covering letter sending DIAC's notorious Submission #602 to the Inquiry about the Visa Capping Bill 2010. The date of the letter has been altered in handwriting from 22nd to 24th June 2010. It would make sense to issue the Capping Instrument on the same day, which is what happened. Without it, some of the claims in the DIAC Submission would not be true, and I suspect that the Inquiry Committee has asked why the Minister made a claim in his interview with Mr Mares that simply wasn't true on 4th June 2010, the date when the Minister made his airy claim. DIAC's work has to go on, whatever happens. However Julia Gillard also became the new PM on 24th June 2010. If she decides to call the General Election in August, as the pundits seem to be saying is probable, I can't see that she would do something that would alienate a significant number of her voters in advance of the Election, which terminating the pre-September 2007 applications would definitely achieve. There might only be one Family Sponsor of a subclass 136 application in a given suburb. However, is that Sponsor a Citizen (and therefore a voter?) How many friends does he have? Which suburb does he live in? Is it within a marginal constituency where every single vote in favour of the ALP candidate is likely to count? The other thing is that in their Submission, DIAC complain that Section 39 is a "blunt instrument." If they use it on the pre-September 2007 applicants, they will not achieve the end that the Minister claims to want. According to him, Australia only wants a small number of immigrants from now on and those immigrants must have the skills that Australia genuinely needs. If you believe in fairy stories (though personally I don't) the new SOL contains the list of skills in genuine demand. Which includes Electricians. If this clot gets rid of Electricians for no other reason than that they applied for visas prior to 1st September 2007, how is this going to help to solve Australia's allegedly genuine need for migrant Electricians? Guest Gollywobbler
Hi VB This is a great news but will be confirmed by DIAC once it will be published on to the homepage of DIAC. wait and watch. Are temporary applications, launched before September 2007 like 496 and 495 ,being exempted from this capping. If yes, will they start processing the applications immediately or will hold us ....? They cannot cap the applications for Provisional SIR visas. Any Instrument purporting to do so would have no validity in Law. Without the ability to Cap the applications in these two subclasses, they cannot terminate the applications for them under Section 39 either. Therefore the only way in which the Minister could terminate yours and Rahulpatel's applications is if his Visa Capping Bill 2010 becomes Law. Personally, I don't think that his Bill will become Law. I think what will happen is that Parliament will insist that Parliament must oversee any proposals for Cap & Kill that go beyond allowing the Minister to use Section 39 if it applies to the subclasses in question. According to something I've read in the last couple of days, S39 was introduced for the sole purposes of controlling the number of applicants for Humanitarian Stream visas and applications for Working Holiday visas. Parliament never intended that S39 could or should ever be used in relation to applications for any other type or types of visa. If I were Parliament, I would be a bit blerdy annoyed to see this new Visa Capping Bill suddenly ponying up in front of me when I and my colleagues have already told a previous Minister for Immi that he cannot have carte blanche and the sole say with any other types of visa except for the two types for which Section 39 was intended. I would tell the Minister to buzz off and to stop being such an ankle biting little pest as far as his new Bill is concerned. If the Bill bites the dust, inevitably the next question will be, "Why have people been hanging about since before 1st September 2007 in order to have their visa applications processed?" The Opposition Senators will definitely ask that particular question now that the issue is out in the open courtesy of the Rudd/Gillard Govermment. In short, I think that the new Gillard Government may well be pressured into doing the right and honourable thing for once in its miserable life. Cheers Gill

Cheers Gill Cheers Gill Thanks Gilly, So that means our fate is still hanging in air and depend on the decision of bill. Like thousands of other who are waiting in Australia about the fate of the bill , we are also part of those thousands. Even I have a impression that it's not easy to get away with this bill as MInister's own fellow ministers are also raising eye brows against this bill. So may be this bill will never passed in the parliament and fate of thousands of people like us will be handed over to the next Government. And even for the next Govt. it would not be easy to take the action against these people. So better start processing these applications and reduce the backlog. Guest Gollywobbler
Thanks Gilly,So that means our fate is still hanging in air and depend on the decision of bill. Hi VB My impression is that the other Ministers in the present Government may well be raising eyebrows in private. However the Opposition's eyebrows seem to have shot up into their hairlines and have done so publicly. There is a strong perception that apparently the sitting Government in Australia always gets what it wants shortly before a General Election in Oz. I hear the people who are saying this but I am not convinced about this idea that there is some sort of "tradition." Parliaments tend to resent attempts to sideline them, which this Bill seeks to do. In the UK under Blair's "Presidential" (ie autocratic, dictatorial and dangerous) style of "leadership" both Parliament and the people got used to the idea that Parliament was a has-been as far as Blair was concerned. He decided what would happen and he simply left the Press to tell Parliament about it afterwards, the Press having been manipulated by Blair's creepy spin doctors first. I get the feeling that the Parliament in Australia is much more old fashioned than the Blair's Babes routine in the UK in recent years, where the Babes just rubber-stamped everything because that was their job and they were not given a choice about it. My impression is that the Aussie Parliament refuses to be sidelined. Also, what is "traditional" in Oz, really? Until last week, it was not "traditional" for Australia to have a female Prime Minister but she got the job in 5 minutes flat, in a bloodless coup, so where is this "tradition?" I continue to hope that the Visa Capping Bill will be chucked out and that Parliament then demands that Australia will just have to put up with 12,000 Cooks, 11,000 Accountants etc and that visa processing priority must revert to "first come, first served" and be done with it. electrical guy
Cheers Gill thanks sir for your deep looking in this issue. what is your conclusion if they have not terminate pre sept applications in current f y.would it be implemented in next F Y for same reason in early stage.as u observe electricians are always in demand ,in past they are on modl and now also in sol, ensol,ss of most states and smp of nsw. i lodged my application in bn-136 (ielts-6,14 years experience with two year of formal training in trade).med/pcc were submitted on demand .but my case was pended by csl processing priority.for taking me ahead i got Victorian state sponsorship but then they shifted me in bn-137 instead of 176 reasoning that 176 was not in existence the time i lodged my pr.my last worry is about the acacia mail that anyone left behind in fy2k9-10 will get their refund

U must have noticed that u will not able to find a single man who will be saying that his money is refunded. So don't worry matey. Wait for the time. I know it's easy to wait for such a long. But this is how they operate. even think tank in DIAC do not know how to go ahead with these pre september applications. As it has been predicted by the punters in Australia that there will be elections in Australia in August. So may more one year waiting is on the line. As yet, nothing is happening on the ground with the proposed Killing of the visa applications. All that they have done so far is to Cap some of the visa subclasses. My feeling is that DIAC will not try to do anything else for the moment. Today and tomorrow, they will have their hands full with ensuring that everything with their website is ready for 9am AEST on 1st July 2010. They might well not try to do any more than they already have until the General Election is out of the way. I agree with VB 100% when he says, "Let us wait and see what happens next." I think that VB is absolutely right and I think that Mark Webster might well be jumping the gun on his website. Cheers Gill
virtual_bajwa
Hi guys, I was browsing another forum. And I come to know that one of the guys got the letter from Manager of Adelaide Program delivery branch. That "his July 07 (136 PR visa) has been" CEASED" and he will be refunded shortly." Hi VB Thanks very much for this information. I wonder when "shortly" might be? Six months time, maybe? Maybe longer? Why aren't they sufficiently well organised that they send the refunds with the notice of termination? Please could you paste up the link to the relevant post on the relevant forum? You recall that a few months ago someone else posted similar news but investigation revealed that it was a false alarm. Many thanks :notworthy: Gill

Guest Gollywobbler
Hi again, VB In the applicant's shoes I would make an IMMEDIATE formal complaint to the Global Feedback Unit and I would e-mail a copy of my complaint to Andrew Metcalfe. It is completely OUTRAGEOUS to purport to chop somebody off at the knees after 3 years of patient waiting and then to have the sheer and utter audacity and ill-manners and lack of consideration to tell him vaguely that he can carry on waiting for his money until somebody eventually gets around to sending that "shortly." Why hasn't this Manager person got the ordinary decency and common sense even to tell the poor person when, precisely, this time called "shortly" might expire?:policeman::realmad: Cheers Gill
