Help - In a spot of trouble!

Hi I was just wondering if anyone could help or has been in the same position.

I have a Spouse Visa issued in 2001 class bc resident 640 sub class 100.

Have not been out of oz for 6 years and on one months holdiay in the uk and oh boy it is freezing here.

When leaving Australia I was told by customs that my visa had expired - very confused as there is no expiry date on my visa - just says remain indefinite etc.

Now I have to get some Return Resident Visa £135, I have no documentation here and had no plans on travelling to London to try to sort it out - not what I need to be doing at the moment.

Has anyone just gone back to Australia and sorted it out at the airport. I am just concerned that if I fly in I will be told to fly back or will be held for questioning.

I have an ABN mortgage wife kids etc etc.

If anyone could advise that would be great.

George

If you dont have a current visa you wont be allowed on the plane to leave so no chance of getting here and getting it fixed. Unfortunately you have to do it before you leave.

Yep, an airline would be making a big boo boo to take you on board.

It's recommended that you arrange one before you leave, PR visas being nominally good for just five years.

But you do need to arrange one now.

Have a look at Five Year Resident Return Visa (Subclass 155) and you may be able to do it online.

Hello George

Welcome to Poms in Oz.

The rule with visas that grant Permanent Residency in Oz is that the holder can remain in Australia indefinitely but the travel element of the visa is only valid for 5 years. If you could find your original grant letter, you would find that it says this and draws your attention to the options of Citizenship and/or Resident Return Visas in the future.

The Australian High Commission in London are usually very helpful in a situation like yours, but you have to be aware of the closing dates around the coming holiday period:

Holidays - Australian High Commission

You say that your wife is in Australia. Can she help by unearthing supporting documents, scanning them into a computer using a colour scanner and e-mailing them to you, to save time?

In addition to the 5 year RRV which Wanderer has told you about, there is (or used to be) some sort of short term RRV which is (or was) valid for 3 months. You need to consult Australia House promptly, I would suggest.

Best wishes

Gill
