However, our Non-Migrating child needs to applied for Child visa 101 after obtaining the court orders. here I have a question. 1. Where should the Parents( we sponsors ) should be residing when we apply for Child visa offshore(101). Currently we are in london, (we will be just validating our visist to Aus in the month of April 2010 and will be back in UK. We will move permanenently to Aus in Dec 2011). We are planning for Court Orders for the child and we will getting it soon by end of Jan 2010. Can the Sponsors be in the UK when we apply for the offshore Child visa. Guest wanderer Posted October 20, 2009 Share Posted October 20, 2009 There is nothing on Child Visa (Offshore) (Subclass 101) to indicate positively that you cannot be in the UK when you lodge the visa on behalf of your child. One point of interest you will note under eligibility of sponsor is the reference to "welfare of the child" and requirement for a national police check via AFP but I imagine that can be worked through re being in the UK and only having been to Australia for validation. Check out the Booklet #2 for child visas, a link on the web site and if it is not clarified there I would ring/email AH to seek direction re that, contact details available by following contact link in top header bar. Its no where mentioned that the Parents /sponsors needs to be in OZ when applying for offshore child visa. However, it says that the sponsor needs to show the financial and other needs of the child. Is it just signing of undertaking or we need to physically present in OZ is the quest here.. Quite confusing... Hope to get some clear picture on this one!! Sponsor obligations As the sponsor, the parent must sign a sponsorship undertaking. On signing this undertaking, the parent must: be responsible for all financial obligations to the Australian Government that the child might incur while they are in Australia. ensure that adequate accommodation and financial assistance is available as required to meet the child's reasonable living needs. This assistance would cover the child's first two (2) years in Australia provide information and advice to help the child settle in Australia. provide support as required to enable them to attend any required English language classes. advise the department in writing if their circumstances change in a way that may affect the child's eligibility for a Child visa, or the sponsor's eligibility to sponsor the child. Guest wanderer Posted October 20, 2009 Share Posted October 20, 2009 It is written as though you are in Australia and that is why contact with immi is best to clarify and I think you'll find that there is the understanding that a dependant child is clearly part of the family. As such, there is even a section where one has only a temporary visa application in and a child is added before the grant and automatically is on the visa for when permanence may be granted. Short of contacting immi, an IA may comment or you could contact one but if you have done it as a DIYer, contact with immi should clarify it. Ashlondongal, For a Child subclass 101 visa, the child must be outside Australia to be granted the said visa. The sponsor does not need to be in Australia (although being in Australia won't be a problem), so long as the criteria to sponsor the child is met.
