Hi, have been reading things on this site for a while for some advice and thought id eventually just tell all my situation and see if anyone can help!

 

Im 27 and have a three year old daughter. My partner is 32 and not my daughters father (her father isnt named on the birth certificate and doesnt see her or want to). My partner is a Boilermaker/Metal Fabricator which is on the Critical Skills List for WA. We have only been together a few months and just before we met (and fell head over heels in love lol!) he applied for Skilled Migration State Sponsorship. This is still in process and he hasnt heard back yet.

 

We are all going to Thialand and Bali next month and then he id off to Oz (WA) on a Holiday Visa while he waits to hear about his other visa. Hes hoping to hear about it within the first few months and then be able to start work.

 

Id really like to join him over there, perhaps in April, but i really want to work and for my daughter to go to school/nursery. Im currently a Childrens Advocate for Looked After children, and was previously a Learning Mentor and before that a Residential Childrens Worker and a Mental Health Assistant. I have degree in Psychology and lots of other relevant social care/childrens courses. Im currently doing evening courses in ILM advocacy and Management and PTLLS (preparing to teach in life long learning sector).

 

I also have an Aunt who lives in northern austraila who is willing to sponsor me.

 

I dont think can get a working visa because i have a dependant, and i have looked into other visas but cant seem to find which one fits my criterea. Neil cant put me on his visa because i dont qualify as 'de-facto'.

 

I know i can go over anyway as i can go on a holiday visa and neil has said he will support myself and my daughter but i would really rather work and have my daughter in school. We have talked about getting married so i can come over with him but im not sure if this would benefit the visa situation anyway!

Reading your brief description, I am wondering whether you can be said to be a Child Care Co-ordinator 1295-11

The second link above is the detailed, authoritative description of the occupation in the ASCO Code, which is the bible for this purpose.

 

I ask because I heard last night that one of the State Government agencies in WA is willing to offer an immediate Permanent Residency on an employer sponsored visa to at least one person who can meet the ASCO criteria for a Child Care Coordinator. I didn't ask for the name of the agency but I can discover that quite easily.

Please tell Neil from me to stop dead in his tracks. Unless he has employer sponsorship for a visa, Australia is not planning to grant his visa any time soon, no matter what he might have imagined a month ago.

 

A shock announcement by DIAC on 23rd September 2009 has turned the entire General Skilled Migration Programme onto its head. It is essential that you and Neil read the following document and make sure that you understand it fully.

From what you say it sounds like Neil has State sponsorship from WA for a subclass 176 application. However he is not on the Cr

 

itical Skills List, therefore he is in Category 5 in the Minister's latest pecking order for visa processing priority. This means that Neil needs to read and to believe Q11 in the FAQ of 23rd September 2009.

 

Jamie Smith has managed to obtain facts and figures from DIAC. Please study Page 4 onwards of the thread below, with particular attention to Jamie's own posts:

The information which Jamie has obtained confirms that DIAC's timeline predictions in the FAQ are realistic rather than pessimistic.

 

Neil needs to re-think his entire visa strategy, I strongly suspect. I think it is highly probable that he is going to have to obtain employer-sponsorship if he wants to be able to start working in WA any time soon.

 

The various LNG projects in WA are creating a high demand for Boilermaker/welders, so it should be one of the fields where obtaining employer sponsorship may not be too difficult. That said, the world and his dog are currently on bended knee to every potential employer sponsor in WA as well.

 

Neil must be very, very careful and have a very clear plan mapped out in his mind, I would suggest.

 

If you fit the bill for Child Care Coordinator, it might well prove to be possible to get Permanent Residency for you sooner than it would be for Neil.

 

Could you please let me know what you both think/say so far and then we can try to move on a step further with all this.

Thanks for the quick response, were trawling through it now - iv read the Childcare Co-ordinator description already and dont think i meet the criterea as i dont provide care for children or young people, i advocate (speak up for, and challenge within Human Rights) for them; but not within a specific centre, its within the local authority and they are placed within independant residential provoders or foster carers.

 

We are reading the other stuff now and will respond ASAP. Thanks so much.

Hi Gill, we have read through all of the links and didnt know anything about the new priority ordering - it changes things! Neil isnt on the Critical Skills List and so we think you are correct in saying he will be fifth in line to be processed. He is on the list for WA but does that not add any weight to the application?

 

Also, he applied for GSM in August 2008 but was taken off the critical skills list in Jan 2009. He then applied for State Sponsorship in August 2009. Does this info change anything?

 

He knows some companies over there and is going to get in touch about employer sponsorship - but i dont think that helps with regards to me being able to go over there with him, as we havent been together for twelve months and i wouldnt qualify as de-facto? I cant even go over on a working hioday visa as i have a dependant?

 

As far as the requirements go for being classed as a child-care co-ordinator i will look into this further. Do you know how stringent they are around that being your profession (in terms of qualifications and work experience etc)? I used to work as a senior residential worker for children in care and was thinking i could use the experience from there? But even then, i couldnt put Neil as de-facto?

 

Bit of a mad thought, but do they check how long you have been together if a new application for employer/CSL was lodged and we were married?!
