using tourist visas whilst awaiting medical clearance

Has anyone attempted to holiday in Australia with a tourist visa whilst waiting for a more permanent visa to be granted? We are currently midway through a permanent spouse visa application, and have planned a holiday for next month. My husbands medicals have been sent to Australia for final clearance, and our CO has told us that he may be refused entry on a tourist visa if he is not medically cleared by the time we arrive in Australia. This is obviously of some concern to us, anyone had any experience of this?

You would expect the CO to know but if you're now in the UK and there's no recent health HR country that there has been a stay in I'm surprised the CO would say that for health examinations are not usually a requirement for short stay tourist visas.

Perhaps they do put a blocker against a persons name listing things that have to be cleared prior to a visa being granted and that flows on to even a tourist visa.

But in absence of one of the IAs knowing for sure I'd check back with the CO.

 

The other thing you ought to do is make sure the CO has registered the short trip intent if it goes ahead and has dates and an email address for contact just in case the visa is ready for final assessment while in Australia for it cannot be granted while you're here and you do not want to have your presence fouling up the granting.

Partner Visa: Offshore Temporary and Permanent (Subclasses 309 and 100) and

You must be outside Australia when:

 

  • you apply for this visa

  • your temporary Partner (subclass 309) visa is granted.

You may be either in or outside Australia when your permanent Partner (subclass 100) visa is granted.

If you have been together for more than 5 years, you may be eligible to have a permanent residency grant instead of the TR and then waiting two years, so if applicable also ask the CO about that as it could affect whether you do need to be outside of Australia for the visa to be granted.
